AN ORDINANCE AMENDING Chapter 8.24 OF
THE MUNICIPAL CODE OF THE TOWN OF AVON
TO DEFINE AS A NUISANCE ALLOWING DOGS
WITHIN PART OF TRACT G, BENCHMARK
AT BEAVER CREEK SUBDIVISION AND PROVIDING
PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON AS FOLLOWS:
Section 1. Amendment.
Chapter 8.24, Title 8 of the Municipal Code of the Town
of Avon is amended by the addition of a new Section 8.24.051
to read as follows:
"8.24.051 Permitting Dogs at Nottingham Lake.
The permitting of any dog to be within the
following described portion of tract G, Benchmark
at Beaver Creek Subdivision within the Town of
Avon:
That area lying between Nottingham Lake
and immediately beyond the outermost bike
paths in said Tract G;
That area twenty (20)' feet south of the
uncovered portion of Metcalf Ditch in said
Tract G;
That area between the uncovered portion of
Metcalf Ditch and Buck Creek in said Tract G;
and
That area within twenty (20)%feet of either
side of Buck Creek.
As more specifically appears on Exhibit "A"
attached hereto and incorporated herein, (to
the extent shown therein)
shall be deemed a public'nuisance•'.
Section 2. Violations and Penalties.
It is unlawful for any person to violate any provision
hereof. Any person who violates any provision of this
Ordinance shall be punished by a fine of not more.than five
hundred dollars or by imprisonment for a period of not more
than ninety days or by both such fine and imprisonment;
provided,'no person under the age of eighteen years shall be
punished by imprisonment. Any such person shall be guilty
of a separate offense for each and every day during any
portion of which a violation of any provision of this code
is committed, continued, or permitted by such person and
shall be punished accordingly.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, THIS 9TH day of FEBRUARY, , 1982
and a public hearing on this Ordinance shall be held at the
regular meeting of the Town Council of the Town-of Avon,
Colorado, on the 23RD day of FEBRUARY 1982 at
7:30 P.M. in the Municipal Building of the Town of Avon,
Colorado.

A_NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL OF
THE TOWN OF AVON, COLORADO., AT 7:30 P.M. ON.THE 23RD DAY OF FEBRUARY,
1982 AT THE MUNICIPAL BUILDING, 400 BENCHMARK ROAD, AVON, COLORADO FOR
THE PURPOSE OF CONSIDERING THE ADOPTION OF ORDINANCE N0.#82-7,.SERIES
OF 1982:
AN ORDINANCE AMENDING ORDINANCE N0.#17, SERIES OF 1979, TO.DEFINE AS A
NUISANCE ALLOWING DOGS WITHIN-TRACT G, BENCHMARK AT BEAVER CREEK SUB-
DIVISION AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
A copy of said Ordinance is,attached hereto and is also on file at the
office of the Town Clerk and may be inspected during regular-business
hours.'
Following. this hearing, the Council may consider final passage of the
Ordinance.

Avon, Colorado.
