AN ORDINANCE AMENDING ORDINANCE NO.
79-12, SERIES OF 1979, TO REQUIRE
APPROVAL OF THE DESIGN REVIEW BOARD
WITH RESPECT TO CHANGES IN PLANS FOR
DEVELOPMENT; AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF
WHEREAS, the Town Council of the Town of Avon finds
that some ambiguity may exist with respect to the requirement
of Design Review Board approval of changes in plans of develop-
ment, contained in the rules and regulations of the Design
Review Board as well as in Ordinance No. 79-12, Series of 1979;
and
WHEREAS, the Town Council finds and determines that
it was the intent of the Council, in enacting said Ordinance
and in approving said rules and regulations to make such a
requirement;
NOW, THEREFORE, BE IT ORDAINED by the Town Council
of the Town of Avon as follows:
Sec. 1. Amendment. Section 4.2 of Ordinance No. 79-12,
Series of 1979, is amended by the addition of a paragraph (e)
as follows:
"(e) No building or other structure or improvement
shall be erected or constructed except in compliance with
the plan of development approved by the Design Review
Board. Nor shall any completed building or other structure,
or improvement be reconstructed or altered, as to use,
density, parking lot requirements, height, or lot coverage,.
unless such reconstruction or alteration shall have first
been approved by the Design Review Board.
Sec. 2. Violations and Remedies
(a) The erection, construction, reconstruction,
alteration, moving, conversion or maintenance of any building
or structure and the use of any land, structure or building
which is continued, operated or maintained contrary to any
provisions of this Ordinance is hereby declared to be a viola-
tion of this Ordinance and unlawful.
(b) Any person or corporation, whether as principal,
agent or employee, who violates any provision of this Ordinance
shall be, for each offense, punished by a fine of not exceeding
three hundred ($300.00) or imprisonment for a period of not
more than ninety (90) days, or both such fine and imprisonment.
Each day any violation of this Ordinance shall continue will
constitute a separate offense.
