TC Ord. No. 1980-10r • TOWN OF AVON ORDINANCE NO. 10 SERIES OF 1980 AN ORDINANCE LICENSING BUSINESSES AND ESTABLISHING A FEE THEREFOR: AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, AS FOLLOWS: Section 1. License. A. It is unlawful for any person or corporation to engage in the business of furnishing of services in the Town without first having obtained a license therefor. B. Such license shall be granted and issued by the Town Clerk upon payment to the Clerk by the applicant of a license fee of ten dollars. The license shall be in force and effect until the first day of July of the year it is issued, unless sooner re- voked. C. Such license shall be granted and renewed only upon application stating the name and address of the person or cor- poration desiring such license, the name of such business, the location, and such other facts as the Town Clerk may require. Section 2. Renewal. It shall be the duty of the licensee on or before the first anniversary date of the issuance of a license to obtain a renewal thereof, if the license remains in the business of furnishing services. -1- 40 r Section 3. Contents--Display Required--Nontransferability. Each license shall be numbered and shall show the name, residence, place, and character of business of the license, and shall be posted in a conspicuous place in the place of business for which it is issued. No license shall be transferable. Section 4. Separate Licenses Required for Separate Addresses. In case business is transacted at one or more separate pre- mises by one person or corporation, a separate license for each place of business shall be required. Section 5. Exemptions. No license shall be required of any person or corporation holding a valid contractor or sales tax license. Section 6. Penalties. Any person, firm or corporation violating any of the pro- visions of this ordinance shall be deemed guilty of a violation of this Ordinance and any such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation is committed, continued or permitted, and upon conviction of any such violation, such person, firm or corporation shall be punished by a fine of not more than $300.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. -2- 0 0 Section 7. Saving Clause. If any part, section, subsection, sentence, clause or phrase of this Ordinance are for any reason held to be invalid, such dec- isions shall not affect the validity of the remaining sections of this Ordinance; the Town Council hereby declares that it would have passed this Ordinance in each part, section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared to be invalid. Section 8. Effective Date. This Ordinance shall become effective July 1, 1980.
