No. 1979-01ORDINANCE NO.'4q - AN ORDINANCE AUTHORIZING THE PAYMENT OF COMPENSATION TO MEM- BERS OF THE TOWN COUNCIL OF THE TOWN OF-AVON; AUTHORIZING REIMBURSEMENT FOR CERTAIN EXPENSES INCURRED BY MEMBERS OF THE TOWN COUNCIL; DEFINING THE TERMS USED HEREIN; SETTING OUT THE DUTIES OF THE TOWN CLERK WITH RESPECT THERETO AND SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. WHEREAS, the Town Council of the Town of Avon has de- termined that service by its Members is an undertaking re- quiring a substantial amount of time, a commitment to service and a sacrifice of personal pursuits, and WHEREAS, the Town Charter for the Town of Avon con- templates and authorizes the payment of compensation to Mem- bers of the Town Council, and WHEREAS, the Council desires to encourage the maxi- mum attendance by its Members at each meeting, NOW THEREFORE, be it ordained,by the town Council of the Town of Avon, Colorado, that: Section 1. Definitions. a. "Councilmembers" shall include any natural per- son, during his term of office, who is either elected at a general municipal election or special municipal election or who has-been chosen by a majority vote of the Town Council to fill a vacancy on the Town Council of the Town of Avon pursuant to the provisions of the Charter for the Town of Avon, including any legally enacted amendments thereto or revisions thereof. b. "Official Meeting" shall include all regular meetings as defined by Section 5.1 of the Town Charter for the Town of Avon and all special meetings as defined by Sec- tion 5.2 of the Town Charter fdr the Town of Avon and shall not include workshops or executive sessions held by the Coun- cil, but the fact that a workshop or executive session was held immediately prior to, during or immediately following a regular or special meeting which would otherwise be an of- ficial meeting shall not operate to disqualify such regular or special meeting from being an official meeting. c: "Attendance" shall mean the continuous physical presence of a Councilmember during the entire duration of an official meeting.subject to reasonable and necessary inter- ruptions, and in order to be considered "in attendance," a Councilmember must be physically present both when the meet- ing is called to order and when the meeting is adjourned. Section 2. Duties of Town Clerk. a. The Town Clerk shall maintain a list of all official meetings held by the Town Council and shall record with reference to each meeting the names of all Councilmembers who were in attendance at that meeting. b. At the end of each calendar month or as soon thereafter as practical, the Town Clerk shall determine the number of official meetings attended by each Councilmember and, based on this computation, the Town Clerk shall then prepare and issue and cause to be prepared and issued checks drawn on the General Fund of the Town of Avon, which checks shall be made payable to the Councilmember:for services, ac- cording to the following schedule: (1) Twenty-five Dollars ($25.00) per Member for each official meeting attended,.not to exceed One Hundred Fifty Dollars ($150.00) per month per Member,. and (2), With respect to the Mayor, Thirty- five Dollars ($35.00) for each official meeting attended, not to exceed Two Hundred Ten Dollars ($210.00) per month.. - 2 - c. The Town Clerk shall, upon'order of the Council, and pursuant to Section 4.8 of the Town Charter for the Town of Avon, also prepare and issue and cause to be pre- pared and issued, checks drawn on the General Fund of the Town of Avon to Councilmembers, upon their request, as re- imbursement for their necessary and actual expenses incurred in the performance of their duties as Councilmembers. Section 3.. Substitute. At any official meeting at which the Town Clerk is not present, the Mayor shall appoint another person to record the names of those Councilmembers in attendance, as set out in Section 2a above. Section 4. Retroactive Effect. The provisions of this Ordinance are intended to take effect as of January 1, 1979, and the Town Clerk is hereby directed, at such time as this Ordinance is passed, or as soon thereafter- as prac- tical, to determine which Councilmembers were present at official meetings beginning January 1, 1979, through the date on which this Ordinance is passed, and to prepare and issue and cause to be prepared and issued checks drawn on the General Fund of the Town of Avon,;to the various Council- members, according to the schedule set out in Section 2b above. Section 5. Severability. If any provision, clause phrase or section of this Ordinance,or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions, clauses, phrases or sections or applications of the Ordinance which can be given effect without the invalid provisions or applications and to this end the provisions or applications of this Ordinance are declared to be severable. - -3--- - INTRODUCED, PASSED, READ, APPROVED AND ORDERED PUBLISHED THIS DAY OF , 1979. TOWN OF AVON ) • NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN of a public hearing before the Town Council of the Town of Avon, Colorado, at 7:30 p.m. of the 27th day of February 1979, at the Town Hall for the purpose of considering the adoption of an ordinance AN'ORDINANCE AUTHORIZING THE PAYMENT OF COMPENSATION TO MEMBERS OF THE TOWN COUNCIL OF THE TOWN OF AVON; AUTHORIZING REIMBURSEMENT FOR CERTIAN EXPENSES INCURRED BY MEMBERS OF THE TOWN COUNCIL; DE- FINING THE TERMS USED HEREIN; SETTING OUT THE DUTIES OF THE TOWN CLERK WITH RESPECT THERETO AND SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. A copy of said Ordinance is attached hereto and is also on file at the office of the Town Clerk and may be inspected during regular business hours. Following this hearing, the Council may consider final passage of this ordinance. This meeting is open to the general public.
