AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE TOWN OF
AVON, COLORADO, ADOPTING BY REFERENCE THE 1977 EDITION OF
THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES:"
REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING
PENALITIES FOR VIOLATIONS THEREOF
Whereas, the Town Council of the Town of Avon, pursuant
to Section 6.9 of Chapter 6 of the Charter for the Town of
Avon and Title 31, Article 16, Parts 1 and 2, C.R.S. 1973,
as amended, adopts by reference thereto,.the 1977 edition of
the "Model Traffic Code for Colorado Municipalities,"
promulgated and published as such by the State Department of
Highways, 4201 East Arkanas Avenue, Denver, Colorado 80222; and
Whereas, the Town of Avon has determined that the matter
of comprehensive traffic control regulations is of common
interest and for the protection of the public health, safety
and general welfare of the residents of the Town of Avon;
County of Eagle, State of Colorado;
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF P_VON :
Section 1. Adoption.
Pursuant to Section 6.9 of Chapter 6 of the Charter for
the Toi.rn of Avon and Title 31, Article 16, Parts 1 and 2, C.R.S
1973, as amended, there is hereby adopted by reference Articles
I to XXVI, inclusive, of the 1977 edition of the "Model Traffic
Code for Colorado Municipalities," promulgated and published
as such by the State Department of Highways, 4201 East Arkanas,
Avenue, Denver, Colorado 30222. The subject matter of the
Model Traffic Code relates primarily to comprehensive traffic
control regulations for the Town for the protection of the
public health, safety and general welfare. The purpose of
this Ordinance and Code adopted herein is to provide a system
of traffic regulations consistent with State law and generally
conforming to similar regulations throughout the State and the
Nation. Three (3) copies of the "Model Traffic Code" adopted
herein are now filed in the office of the clerk of the Town
of Avon, Colorado, and may be inspected during regular business
hours. The "Model Traffic Code," as finally adopted, shall
be available for sale to the public through the office the
Town Clerk at a moderate price.
Section 2. Penalties.
The following penalties, herewith set forth in full shall
apply to this Ordinance:
(A) It is unlawful for any person to violate any of the
provisions stated or adopted in this Ordinance.
(B) Every person convicted of a violation of any provision
stated or adopted in this Ordinance shall be punished by a
fine not exceeding three hundred dollars ($300.00), or by
imprisonment not exceeding ninety (90) days, or by both such
fine and imprisonment.
Section 3. Appliciation.
This Ordinance shall apply to every street, alley, sidewalk
area, driveway, park, and to every other public way or public
place or public parking area, either within or outside the
corporate limits of the municipality, the use of which this
municipality has jurisdiction and authority to regulate. The

provisions of Section 5-1, 5-2, 15-12, 21-13 and 23-3 of the
Adopted 'Model Traffic Code," respectively, concerning reckless
driving, careless driving, unauthorized devices, eluding
officer, and accident investigation shall apply not only to
public places and ways but also throughout this municipality.
Section 4. Validity.
If any part or parts of this ordinance are for any reason
held to be invalid,.such decision shall not affect the validity
of the remaining portions of ordinance. The Town Council
hereby declares that it would have passed this ordinance and
each part or Darts thereof, irrespective of the fact that any
one Dart or Darts be declared invalid.
Section 5. Repeal.
Existing ordinances or parts of ordinances covering the
same matters as embraced in this Ordinance are hereby repealed
and all ordinances or parts of ordinances inconsistent with the
provisions of this ordinance are hereby repealed, except that
this repeal shall not affect or prevent the prosecution or
punishment of any person or any act done or commited in violation
of any ordinance hereby repealed prior to the taking effect
of this Ordinance. The effective date of this ordinance shall
be the completion of publication as provided by the Charter
for the Town of Avon.
Section 6. Interpretation.
This Ordinance shall be so interpreted and construed as
to effectuate its general purpose to conform with the State's
uniform system for the regulation of vehicles and traffic.
Article and section headings of the ordinance and adopted
"Model Traffic Code" shall not be deemed to govern, limit, modify
or in any manner effect the scope, meaning or extent of the
provisions of any article or section thereof.
Section 7. Certification.
The Town Clerk shall certify to the passage of this
Ordinance and make not less than three copies of the adopted
Code available for inspection by the public during regular
business hours.

In accordance with the provisions.of sections 4-2 and 4-3 and

Section 26-6. Nonmotorized traffic and motor-driven
cycles excluded.
In accordance with the provisions of sections 9-2, 17-21 and
18-1, and when official signs are erected giving notice thereof,
no pedistrian, bicyclist or other nonmotorized traffic and no
person operating a motorized bicycle or a motor-driven cycle
shall use any of the following streets or highways or parts
thereof:

Section 26-7. Stopping, standing or parking during certain
hours on certain streets prohibited.
In accordance with the provisions of section 12-2, and
when official signs are erected giving notice thereof, no
person shall stop, stand or park a vehicle between the hours
specified herein of any day except Sundays and public holidays
as defined in section 25-5(c) upon any of the streets or
parts of streets as follows:

Section 26-8. Parking prohibited at all times on certain

Section 26-9. Parking time limited on certain streets.
In accordance with the provisions of section 12-2, and

person shall park a vehicle for a period of time longer than

Section 26-14. Weight limitations upon vehicles using
certain structures.
In accordance with the provisions of section 18-9, and
when official signs are erected giving notice thereof, no
person shall operate a vehicle with a gross weight in excess
of the amounts specified herein at any time upon any of the

Mayor, Town of Avon:
In accordance with Colorado Revised Statutes 1973 as amended and in
particular with reference to Title 43, Article 2, Section 135(1)(g) of said
statutes, Traffic Ordinance No. 78-2, Series of 19.78, of the Town of Avon
and traffic control schedules dated January 14, 1981, made a part of said
Ordinance are hereby approved as to all traffic and parking restrictions
contained therein, insofar as such traffic and parking restrictions pertain
to streets within the Town of Avon which are part of the State Highway
System, provided that such regulations are not in conflict with State
statutes.
This approval is considered to apply to State Highways from the date
said Traffic Ordinance No. 78-2, Series of 1978, became effective on local
streets not a part of the State Highway System.
