HELD APRIL 10, 2007
A regular meeting of the Town of Avon, Colorado was held at the Avon Municipal Building, 400
Benchmark.Road, Avon, Colorado in the Council Chambers.
Mayor Ron Wolfe called the meeting to order at 5:30 PM. A roll call was taken. and.Council
members present were Dave Dantas, Amy Phillips, and Brian Sipes. Rich Carroll, Kristi Ferraro
and Tamra Nottingham Underwood were absent. Also present were Town Attorney John Dunn,
Town Manager Lary Brooks, Deputy Town Clerk Debbie Padilla, and Town Engineer Norm
Wood.
APPROVAL OF AGENDA & DISCLOSURE OF POTENTIAL OF CONFLICT OF INTEREST
There were no changes to the agenda.
RESOLUTIONS
Norm Wood, Town Engineer, presented Resolution. No. 07-14, Series of 2007, Resolution
Approving New Public Road At-Grade Crossing Agreement Between Union Pacific Railroad
Company and the Town of Avon Covering the Construction, Maintenance and Use of the New.
Benchmark Road At-Grade Public Road Crossing at Railroad Milepost 308.24 - Tennessee
Pass Subdivision DOT NO., 924326U at or Near Avon, Eagle County, Colorado (Eastern
Crossing - UPRR Folder No.' 2245-46). He explained that the Resolution approves the
Agreement between Union Pacific and the Town of Avon, which establishes the terms &
condition for construction of the eastern crossing that will connect the new Transit Center with
the Pedestrian Plaza & Gondola in Riverfront Subdivision. He also noted that the B&B proposal
for construction was also on the agenda and the estimated cost for the construction of the
eastern crossing was $203K with construction to begin immediately.
Mayor Pro Tern Sipes moved to approve Resolution No. 07-14, Series of 2007, Resolution
Approving New Public Road At-Grade Crossing Agreement Between Union Pacific Railroad
Company and the Town of Avon Covering the Construction, Maintenance and Use of the New
Benchmark Road At-Grade Public Road Crossing at Railroad Milepost 308.24 - Tennessee
Pass Subdivision DOT NO. 924326U at or Near Avon, Eagle County, Colorado (Eastern
Crossing - UPRR Folder No. 2245-46). Councilor Phillips seconded the motion and it passed
unanimously.
Norm Wood, Town Engineer, noted that there would be no action on Resolution No. 07-15,
Series of 2007, Resolution Approving New Public Road At-Grade Crossing Agreement Between
Union Pacific Railroad Company and the Town of Avon Covering the Construction; Maintenance
and Use of the New Benchmark Road At-Grade Public ,Road Crossing at Railroad Milepost
308.31 - Tennessee Pass Subdivision DOT NO. 924325M at or Near Avon, Eagle County,
Colorado (Western Crossing - UPRR Folder No. 2245-.72). He explained that the materials had
been received, but 'the agreement was not yet in an acceptable format and action would be
delayed; staff recommended that no action be taken on the Resolution No. 07-15.
TOWN ATTORNEY
Town Attorney John Dunn distributed an opinion letter on the West Avon parcels adjacent to
Singletree. Further discussion on the topic would take place at a later meeting.
MAYORS REPORT
Mayor Wolfe noted that he no longer served as the Chairman for the Open Space Committee of
Eagle County and then presented an update as to the happenings of that group.
CONSENT AGENDA
Mayor Wolfe asked for a motion on only the Proposal from B & B Excavating, Inc. for
construction of the Eastern Benchmark Road At-Grade Public Road Crossing Per UPRP Folder
No. 2245-46. Mayor Pro Tem Sipes moved to approve the B&B Proposal; Councilor Sipes
seconded the motion and it passed unanimously.
There being no further business to come before the Council, the regular meeting adjourned at
5:50 PM.
