TC Minutes 07-21-1998MINUTES OF THE SPECIAL MEETING OF THE TOWN COUNCIL HELD JULY 21, 1998 - 2:00 P.M. A special-meeting of the Town Council of the Town of Avon, Colorado was held in the Municipal Building, 400 Benchmark Road, Avon, Colorado, in the, Council Chambers. The meeting was called to order by Mayor Jack Fawcett at 2:03 PM. A roll call was taken with Councilors Jim Benson, Jack Fawcett, Bob McIlveen, Buz Reynolds, Sr., and Mayor Protem Judy Yoder present. Councilors Richard Carnes and Buz Reynolds, Jr. were absent. Also present were Town Manager Bill Efting, Town Attorney John Dunn, Assistant Town Manager Larry Brooks, Town Clerk Kris Nash, Public Relations Specialist Kristen Kenney-Williams, Town Engineer Norm Wood, as well as members of the press and public. Resolutions: Resolution No. 98-42, Series of 1998, A RESOLUTION REGARDING THE PROPOSED ANNEXATION OF REAL PROPERTY TO THE TOWN OF AVON Mayor Fawcett asked for comments from Town Attorney Dunn. Town Attorney Dunn stated a petition for annexation has been filed, with the Town Clerk for the Confluence property. He reviewed the petition which makes all the allegations necessary for annexation of the property into the town and recommends adoption. Mr. Michael Sheldon, representative for the proponents of annexation addressed the' Council. He stated the resolution is a finding of substantial compliance of the petition. It' is based on Colorado Revised Statutes; the Annexation Act of 1965. The resolution also sets a date for, a public hearing on August 25, 1998 at 5:30 PM. Mayor Fawcett asked Mr. Sheldon if he planned to file the PUD prior to August 25. Mr. Sheldon stated yes. Mr. Sheldon also informed Council that a corrected legal description of the proposed annexation was filed with the Town Clerk prior to the meeting today. Mayor Fawcett asked for action from the Council. Mayor Protem Yoder motioned to approve Resolution No. 9842, Series of 1998. The motion was seconded by Councilor Benson. The motion carried unanimously. There being no further business to come before the Council, Mayor Fawcett called for a motion to adjourn. Councilor Benson motioned to adjourn.
