TC Minutes 06-30-19980. ! MINUTES OF THE SPECIAL MEETING OF THE TOWN COUNCIL HELD JUNE 30, 1998 - 5:30 P.M. A special meeting of the Town Council of the town of Avon, Colorado was held in the Municipal Building, 400 Benchmark Road, Avon, Colorado, in the Council Chambers. The meeting was called to order by Mayor Jack Fawcett at 5:30 PM. A roll call was taken with Councilors Jim Benson, Buz Reynolds, Sr., Buz Reynolds, Jr., and Mayor Protem Judy Yoder present. Councilors Richard Carnes and Bob McIlveen were absent. Also present were Town Manager Bill Efting, Town Attorney John Dunn, Assistant Town Manager Larry Brooks, Town Clerk Kris Nash, Public Relations Specialist Kristin Kenney-Wlliams, Town Engineer Norm Wood, Fire Chief Charles Moore; Police Chief Gary Thomas, Recreation Director Meryl Jacobs, Special Events Coordinator Dana Mauer, Town Planner George Harrison, Town Planner Karen Griffith as well as members of the press and public. Citizen Input: Salute to the USA Update Special Events Coordinator Dana. Mauer approached the Council_ to give an update on the July 4d' celebration at Nottingham Park. Resolutions: Resolution No. 98-40-1, Series of 1998, A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE OF PETITION NO. 1 FOR ANNEXATION TO THE TOWN OF-' . AVON OF A PARCEL OF LAND, AND SETTING A HEARING THEREON Mayor Fawcett asked for comments-from Town Attomey,John Dunn'. Town Attorney Dunn stated"two petitions for annexation have been filed with the Town Clerk. Petition for Annexation No. 1 is taken up by Resolution No. 98-40-1.',T6wn Attorney Dunn has reviewed the allegations of Annexation No. 1 and finds that the allegations of the petition allege the matters which are required by State Statute for annexation. It is Town Attorney Dunn's opinion that Council should adopt Resolution No. 9840-1, making a determination of substantial compliance and setting a date for a hearing for proof of substantial compliance on August 11 with notice published in the meantime. Mayor Fawcett asked for a motion. Councilor-Reynolds, Sr. motioned to approve Resolution No. 9840-1, Series of 1998. Councilor Benson seconded the motion. The motion carried unanimously. Resolutions: Resolution No. 98-40-2, Series of 1998, A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE OF PETITION NO.2 FOR ANNEXATION TO THE TOWN OF AVON OF A PARCEL OF LAND, AND SETTING A HEARING THEREON Mayor Fawcett asked for comments.. Town Attorney Dunn stated he had nothing further to add than what was said for Petition No. 1. Mayor Fawcett asked for a motion. Councilor Benson motioned to approve Resolution No. 98-40-2, Series of 1998. -Mayor Protem Yoder seconded the motion : The motion carried unanimously. Resolutions: Resolution No. 98-38, Series of 1998, A RESOLUTION APPROVING THE ISSUANCE OF EAGLEBEND DOWD AFFORDABLE HOUSING CORPORATION OF MULTIFAMILY HOUSING PROJECT REVENUE BONDS, SERIES 1998, IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $11,100,000; AUTHORIZING A PROJECT AGREEMENT; AND AUTHORIZING INCIDENTAL ACTION Mayor Fawcett asked for comments. There being no comments, Mayor Fawcett asked for a motion. Councilor Reynolds, Sr. motioned to approve Resolution No. 98-38, Series of 1998. Mayor Protem Yoder seconded the motion. The motion carried unanimously. Town Manager Report: Press releases will go out July 6 and 7 to let people know that on July 8 we will be enforcing the yield to pedestrians and speed of the roundabouts. Town Attorney Report: Town Attorney Dunn stated that Legislature has amended the statute to provide for. double fines for passing a school bus when it is signaling to stop. Town Attorney Dunn asked if Council wished to amend the Town's ordinance to provide the same. It was Council's consensus to do an amendment. There being no further business to come before the Council, Mayor Fawcett called for a motion to adjourn. Mayor.Protem Yoder motioned to adjourn.' Councilor Benson seconded the motion.
