TC Minutes 05-27-1997• MINUTES OF THE REGULAR MEETING OF THE TOWN COUNCIL HELD MAY 27, 1997 - 5:30 P.M. A regular meeting of the Town Council of the Town of Avon, Colorado was held in the Municipal Building, 400 Benchmark Road, Avon, Colorado, in the Council Chambers. The meeting was called to order by Mayor Jack Fawcett at 5:39 PM. A roll call was taken with Councilors Jim Benson, Richard Carnes, Bob McIlveen, and Buz Reynolds, Jr. present. Mayor Protem Judy Yoder and Councilor Dave Gilman were absent. Also present were Town Manager Bill Efting, Town Clerk Patty Lambert, Town Attorney John Dunn, Town Engineer Norm Wood, Fire Chief Charlie Moore, Director of Community Development Mike Matzko, Planner George Harrison, and Administrative Assistant Jacquie Halburnt, as well as members of the press and public. Ordinances: Second Reading of Ordinance No. 97-5, Series of 1997, AN ORDINANCE APPROVING THE COURT AT STONEBRIDGE, PUD AMENDMENT NO. 1, TRACT B, EAGLEBEND SUBDIVISION, FILING NO. 3, TOWN OF AVON, EAGLE COUNTY, COLORADO Town Attorney John Dunn noted a problem with respect to the Ordinance which will amend the PUD for Eaglebend Subdivision, specifically for Stonebridge, which is a part of Eaglebend Subdivision. Because of the nature of the amendment to the PUD, the consent of the owners' association for the existing project - existing Stonebridge project - is necessary. The matter was proceeding upon the assumption of understanding that that consent had been obtained. That consent has not been provided by the owners' association. Until matters get resolved, between the applicant and the owners' association, Council can not proceed further. Therefore, Town Attorney Dunn requested the matter be tabled until the next meeting, when it is hoped it will be taken care of. Councilor Benson motioned to table Ordinance No. 97-5. Councilor Reynolds seconded the motion. Mayor Fawcett called for a roll call vote. The motion carried unanimously. Resolutions Resolution No. 97-32, Series of 1997, A RESOLUTION IN APPRECIATION OF JACK HUNN Mayor Fawcett acknowledged the presence of the Hunn family; Jack's wife, two daughters, and mother-in-law. Mayor Fawcett thanked Jack Hunn for all of his time and effort on behalf of the Town. Councilor Reynolds motioned to approve Resolution No. 97-32, Series of 1997. Councilor Reynolds stated he learned a great deal from Mr. Hunn and appreciated Jack's service on the P & Z. Councilor Benson seconded the motion. • Mayor Fawcett read Resolution No. 97-32, Series of 1997 in its entirety. The motion carried unanimously. Town Attorney Report Town Attorney Dunn informed he contacted the Clerk's office at the District Court in Eagle this morning. He was advised by the Clerk's office that no appeal has been filed by Mr. Grow, in connection with the action, of the Council on the 22nd day of April, affirming the decision of Planning & Zoning. The deadline, to file an appeal with District Court, was the 22nd day of May; 30 days after the action. So, that matter has been concluded apparently. Other Business: Councilor Reynolds asked if we were moving right along with the IGA. Town Manager Bill Efting responded that is correct. We have it scheduled for the 6th and so does Eagle County. Councilor McIlveen seconded the motion and the motion carried unanimously. There being no further business to come before Council, Mayor Fawcett called for a motion to adjourn.
