TC Minutes 10-25-1994MINUTES OF THE REGULAR MEETING OF THE TOWN COUNCIL HELD OCTOBER 25, 1994 - 7:30 P.M. The regular meeting of the Avon Town Council of the Town of Avon, Colorado was held in the Municipal Building, 400 Benchmark Road, Avon, Colorado, in the Council Chambers. The meeting was called to order by Mayor Albert Reynolds at 7:30PM. A roll call was taken with Councilors Jack Fawcett, John Hazard, Celeste C. Nottingham, Jim Roof, and Judy Yoder. Councilor Tom Hines was absent. Also present were Town Manager Bill James, Town Attorney John Dunn, Town Clerk Patty Neyhart, Town Engineer Norm Wood, Planner Mary Holden, Director of Transportation Harry Taylor, Director of Recreation Meryl Jacobs, Police Chief Gary Thomas, as well as members of the press and public. First item on the Agenda Society of Travel Agents O'Malley. Mayor Reynolds announced Council at the Worksessil meeting. under Citizen Input was the American. - Transportation Request from Mr. Bob that Mr. Bob O'Malley addressed the :)n, prior to.this evening's Council Councilor Fawcett stated Mr. O'Malley's request was to provide in-kind service, being bus service, on two days, to take Travel Agents from the American Society of Travel Agents from Beaver Creek to restaurants in Vail, as well as out to the 4-Eagle Ranch. Councilor Fawcett motioned to fund up to $500 of-in-kind transportation for bus services on the dates. indicated on Mr. O'Malley's memo. Councilor Nottingham seconded the motion. Councilor Fawcett amended the motion to add that we issue special passes to the family members as well as the delegate to the American Society of Travel Agents for a period of three days. If they have their own identifying badges then that should be sufficient and they can ride the system at no charge. The amendment was seconded by Councilor Roof. Both, amendment and motion, carried unanimously. First Reading of Ordinance No. 94-21, Series of 1994, AN ORDINANCE AMENDING TITLE 8, CHAPTER 8.24 OF THE MUNICIPAL CODE OF THE TOWN OF AVON AS IT RELATES TO PUBLIC NUISANCES AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF Mr. Bill James informed that the town Staff and the Planning & Zoning Commission have reviewed the Ordinances regarding nuisances, on a town wide basis. Ordinance No. 94-21 includes recommendations that are lacking in our current regulations. Changes discussed were; a.) Section 8.24.111 - Recreation Vehicles from 24'hours to 1172 hours"; b.) newsracks - add, "without prior written permission from the Town", for placement of a newsrack on Town property. • i Councilor Yoder motioned approval of Ordinance No. 94-21, Series of 1994, on first reading, with the changes we have referred to, 8.24.111 - Recreational Vehicles - change from 24 to 72 hours, and, 8.24,.115 - Newsracks - add on the first line, no person shall place or maintain a newsrack on public sidewalks or other property owned by the Town without prior written permission from the Town and under C'any newsrack placed or maintained on public sidewalks or other property owned by the Town without said prior written permission shall be impounded. Councilor Hazard seconded the motion. The motion carried unanimously. Resolution No. 94-35, Series of 1994, A RESOLUTION APPROVING PRELIMINARY CONDOMINIUM MAP OF VAIL/AVON COMMERCIAL PARK, LOT 14/15, BLOCK 1, BENCHMARK AT BEAVER CREEK, TOWN OF AVON; EAGLE COUNTY, COLORADO Mayor Reynolds announced this is a public hearing. Mr. Norm Wood informed this is a preliminary plat for the condominiumization of a commercial project located on Metcalf Road. The project is currently under construction. The preliminary condominium map as presented is essentially in accordance with the plans that were approved through the Planning & Zoning Commission in the design review process. Mr. Wood noted he is not aware of any written input received through the public hearing process. The required notices have been posted. Staff recommends' approval of this Resolution. Councilor Fawcett motioned to approve Resolution No. 94-35, Series of 1994. Councilor Nottingham seconded the motion and the motion carried unanimously. Resolution No. 94-36, Series of 1994, A RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT OF DRAW SPUR TOWNHOMES, A RESUBDIVISION OF LOT 86, BLOCK 1, WILDRIDGE, TOWN OF AVON, EAGLE COUNTY,-COLORADO Mayor Reynolds announced this is a public hearing. Mr. Wood stated this is-a regular:townhome project for residential-units. This exceeds the four limit as it has four units, plus common area. The applicant has submitted a preliminary and final plat in,one action. Staff has reviewed and recommends approval of,Resolution.No..94-36,: Councilor Nottingham motioned to approve Resolution No. 94-36, Series of 1994. Councilor Fawcett seconded the motion and the motion carried unanimously. Resolution No. 94-38, Series of 1994, A RESOLUTION CANCELLING A' REGULAR TOWN COUNCIL MEETING AND SCHEDULING A SPECIAL TOWN COUNCIL MEETING Town Clerk Neyhart stated this Resolution cancels the November 8th regularly scheduled Council meeting due to the election and schedules a special Council meeting on November 15th. Councilor Roof motioned to approve Resolution No. 94-38, Series of 1994. Councilor Fawcett seconded the motion and the motion carried unanimously. 2 • • Resolution No. 94-39, Series of 1994, A RESOLUTION TO SET MILL LEVIES FOR 1995 BUDGET LEVYING GENERAL PROPERTY TAXES-FOR THE YEAR 1994, TO HELP DEFRAY THE COSTS OF GOVERNMENT FOR THE TOWN OF AVON, COLORADO, FOR THE 1995 BUDGET YEAR Mr. James announced good news . . . the Council authorized, through.this Resolution, just over a 2 mill reduction in the mill levy. The levy this year was 25.753 mills and next year it will go down to 23.551 mills. Councilor Nottingham motioned to approve Resolution No. 94-39, Series of 1994. Councilor- Roof seconded the motion and'the motion carried unanimously. The next item on the Agenda under New Business was the Change Request No. 15A / Recreation Center Site. Mr. Larry Brooks informed Change Request No. 15A was.done.for soils work in the parking lot that now exists-over what used to be the sedimentation pond by the former tennis, courts. This is the parking lot on the east side of the project, next to the Seasons. A & P and'Intermountain Engineering found it necessary to excavate 3 1/2' to 4' deeper than what was originally planned in the construction drawings. The cost of $11,198 reflects-the design changes that were incurred. Changes involved over digging the site, bringing in new structural fill, and putting the original design fabric down - but adding an additional 9" of road base before the pavement was put down. That was what was deemed necessary to stabilize that parking lot. This will be incorporated into what will be Change Order #2. Staff recommends approval of this Resolution. This amount was budgeted and addressed separately from the contract with A & P. Councilor Roof motioned approval of Change Request 15A, the Recreation Center Site. Councilor Yoder seconded the motion and the motion carried unanimously. The next item on the Agenda was the Mayor's Report. Mayor Reynolds announced he attended the CAST meeting in Durango. Discussion centered around Amendment 12. Mayor Reynolds announced he attended the Vail Valley Foundation's organizational meeting for the Ski Championships. Next on the Agenda was Other Business. Councilor Nottingham announced that October 23-30, 1994 is Red Ribbon Week; Drug and Alcohol Awareness. Next on the Agenda was the Consent Agenda: a.) Financial Matters b.) Approval of the October 11, 1994 Council Meeting Minutes. c.) Resolution No. 94-37, Series of 1994, A RESOLUTION APPROVING THIRD SUPPLEMENTAL PLAT AND CONDOMINIUM MAP, BRIDGEWATER TERRACE CONDOMINIUM, LOT 8, BLOCK 3, BENCHMARK AT BEAVER CREEK, TOWN OF AVON, EAGLE COUNTY, COLORADO 3 • 1 Councilor Yoder motioned to approve the Consent Agenda. Councilor Nottingham seconded the motion and-the motion carried unanimously.' There being no further business to come before Council, Mayor Reynolds called for a motion to adjourn.
