On Tuesday, February 5, 1991, the Vail Town,Council passed, on first reading,
an ordinance which prohibits the installation of fireplaces or wood-burning
stoves in new construction. The ordinace includes limitations on the overall
number of gas burning appliances allowed. The Council also directd staff to
draft an ordinance that would require the conversion of existing wood burning
devices to gas or EPA Phase-III rated appliances (Highly efficient and-clean-
burn;ing) within five years.
MINTURN
On February 6, 1991, the Minturn Town Council passed, on first reading, an
ordinance to repeal and reenact Chapter 8.16 "Air Quality Control" of the
Minturn Municipal Code. The code revisions effectively prohibit the installation
of any new solid fuel burning device (except pellet stoves) in Minturn. In
addition, no mobile home may be moved in and hooked up that has a solid fuel
burning device in it. The replacement of an existing solid fuel burner is
allowed if the new unit meets or exceeds certain emission standards or is
listed as an EPA Phase III appliance. The ordinance goes on to encourage the
conversion of existing solid fuel burning devices to a burning device which can
only utilize gaseous fuels (natural gas, propane, etc.). That portion of the
building permit fee involved in the direct cost of such conversion is waived.
EAGLE COUNTY
Eagle County is currently considering amendments to.both their Building resolution
andflLand Use regulations. The Land Use regulation changes involve the pro-
hibition of wood burning devices where natural gas is readily available (only .
in high density zone districts), unless it is to replace an existing woodburner
with an EPA Phase III appliance.
In areas where natural gas is not readily available, woodburners will. be limited
to one per dwelling unit. No new woodburners will be allowed to be added to
existing units after the regulations are amended. The Building resolution will
be amended to allow only EPA Phase III stoves, add language regulating fireplace
construction and to waive building permit fees for voluntary conversion to a
gaseous burning device.
