TC Minutes 05-26-1981• • MINUTES OF THE REGULAR MEETING OF THE TOWN OF AVON, COUNCILMEMBERS HELD MAY 26, 1981 - 7:30 P.M. The regular meeting of the Town Councilmembers of the Town of Avon, Colorado was held in the Town Offices, second floor, Benchmark Shopping Center, Avon. The meeting was called to order by Mayor Alpi at 7:45 p.m. A roll call was taken with the Councilmembers in attendance with the exception of Steve Erickson who was absent. Also present was Town Attorney John Dunn as well as members of the press and public. The Mayor announced that Lawrence C. Kumpost was appointed to fill the seat on the Town Council. At that point Mr. Kumpost was sworn in as the new Town Councilmember. Second reading of Ordinance No.#81-2, Series of 1981, AN ORDINANCE ESTABLISHING REGULATIONS FOR MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF AVON AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. Allan Nottingham moved to table this Ordinance until the next regular Council Meeting of June 9, 1981. The motion was seconded by A.J. Wells and was unanimously carried. Second reading of Ordinance No.#81-11, Series of 1981, AN ORDINANCE ESTABLISHING A PEDESTRIAN MALL ON A PORTION OF TRACT G, BLOCK 2, TOWN OF AVON; MAKING THE DETERMINATIONS REQUIRED BY LAW; SETTING FORTH REGULATIONS FOR USE OF THE PEDESTRIAN MALLS BY VEHICLES; STATING THAT THERE WILL BE NO ASSESMENTS FOR THE COSTS OF ESTABLISHMENT AND IMPROVEMENTS OF THE MALLS IN ACCORDANCE WITH THIS ORDINANCE EXCEPT AS AGREED TO BY ADJACENT PROPERTY OWNERS; SETTING FORTH THE MANNER OF PAYMENT OF COSTS AND CLAIMS FOR THE ESTABLISHMENT OF A PEDESTRIAN MALL; MAKING FINDINGS AND RULINGS ON THE CLAIMS FOR DAMAGES SUBMITTED TO THE TOWN COUNCIL; AND SETTING FORTH DETAILS IN RELATION TO THE FOREGOING. A.J. Wells moved to table this Ordinance until the Town receives the signed Mall Agreement from Marcos M. Suarez, seconded by Bill Doyle and was unanimously carried. Tom Glass from Northwest Colorado Council of Governments(NWCCOG)approached the Council. He reported on several programs. EMS, A-95's, senior citizens program and also the Watershed District Ordinance. Mr. Glass stated that they hold every other month planners meetings to discuss county- wide planning problems as well as providing input into the work programs. They also have a agency in a aging program in a six county area, they buy Vans and have three meal sites, Minturn, Eagle and Basalt. He discussed the water quality. The most promising thing for this area has to do with non-point sources and point sources trade- offs. The Mayor asked if there were any funds available to help municipalities with the system. Mr. Glass stated that if they could get the trade-off accepted, there may be funds available. Mr. Glass stated that he would like to report to the Council approximately every 3 months if that would be possible. The Mayor thanked Mr. Glass for zomng. • Barry Paull from Avon Resort Services, also present were Bob and Al Hariker from that firm. Mr. Paull wanted to introduce to the Council a new service that they would be offering as of June 1st, 1981. He stated that the move from the Vail Association to discontinue reservations referral service to properties outside the Gore Valley has left a tremendous void as far as reservation referral services are concerned, especially for the rapidly growing areas of Eagle Vail and Avon. This company would like to, fill that void. He stated that by June 1st, 1981 there would be approximately 100 units available as short term rentals in the Avon, Eagle Vail area. He stated that this would be a computer reservation service only. The listing fees would be $30.00 per unit, per year plus a 5% referral fee on the lodging portion. The Mayor thanked the gentlemen for coming. Second reading of Ordinance No.#81-12, Series of 1981, AN ORDINANCE PERTAINING TO REVENUE AND AMENDING ORDINANCE NO.#80-6, SERIES OF 1980, TO CLARIFY THE RELATION OF THE REAL ESTATE TRANSFER TAX TO TRANSFER OF DENSITY UNITS. There was discussion and additions to this Ordinance. In Section 1(A) after the last sentence add, "Any transfer of density units shall be deemed to be related to the cash paid or value of property delivered and shall be taxable under the provision of this Ordinance.". With that addition A.J. Wells moved approval on first reading Ordinance No.#81-12, Series of 1981, AN ORDINANCE PERTAINING TO REVENUE AND AMENDING ORDINANCE NO.#80-6, SERIES OF 1980, TO CLARIFY THE RELATION OF THE REAL ESTATE TRANSFER TAX TO TRANSFER OF DENSITY UNITS. The motion was seconded by Bill Doyle. A roll call was taken with all the Councilmembers voting yes. First reading of ordinances No.#81-13,81-14,81-15,81-16,81-17,81-18,81-19, Series of 1981. These Ordinances deal with the adoption of reference the 1979 edition of the "Uniform Building Code". The Town Attorney stated that the purpose of these Ordinances would be to bring the Town up-to-date on building and other technical codes and to delete some of the technicalities of the Ordinances. There was discussion, deletions and additions to these Ordinances. Ordinance No.#81-13, Series of 1981, AN ORDINANCE REPEALING ORDINANCE NUMBER 79-2, AND AMENDMENTS THERETO, ADOPTING VARIOUS BUILDING CODES; ORDAINING AN ADMINISTRATIVE CODE APPLYING TO THE CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION OF BUILDINGS AND STRUCTURES AND OTHER CONSTRUCTION RELATED ITEMS IN THE TOWN OF AVON, COLORADO, LISTED HEREAFTER; AND PROVIDING A PENALTY FOR THE VIOLATION HEREOF. The purpose of this Ordinance would be to repeal all the previous building code Ordinances and to establish an administration code relating to the construction of the Town. In the title of this Ordinance change "lited" to "listed". Ordinance No.#81-14, Series 1981, AN ORDINANCE PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, USE, HEIGHT, AREA AND MAINTENANCE OF BUILDINGS OR STRUCTURES IN THE TOWN OF AVON, COLORADO; ADOPTING BY REFERENCE THE 1979 EDITION OF THE "UNIFORM BUILDING CODE: AND THE 1979 EDITION OF THE "UNIFORM BUILDING CODE STANDARDS"; MODIFYING AND AMENDING SAID CODES; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. This Ordinance adopts the 1979 building code and establishes additional requirements for atriums. On page 5,(7) Section 3801(d) was deleted. Ordinance No.#81-15, Series of 1981, AN ORDINANCE PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REGULATING THE INSTALLATION AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING AND REGRIGERATION SYSTEMS IN THE TOWN OF AVON, COLORADO FOR THE PURPOSE OF PROVIDING A UNIFORM MECHANICAL CODE CONSISTENT WITH AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGHOUT THE TOWN; DEFINING CERTAIN TERMS; ESTABLISHING MINIMUM REGULATIONS; ADOPTING BY REFERENCE THE 1979 EDITION OF THE "UNIFORM MECHANICAL CODE": MODIFYING AND AMENDING SAID CODE; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. This Ordinance adopts the 1979 Mechancial Code. -2- Continued Page 2 Uniform Building Code Ordinance E Ordinance No.#81-16;: Series of 1981, AN ORDINANCE-ADOPTING BX-REFERENCE-_THEiUNIF.ORM FIRE CODE, 1979 EDITION AND THE NATIONAL FIRE CODE, 1979 EDITION, INCLUDING THE LIFE SAFETY CODE, NFPA PUBLICATION NO.101, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. In the title after "1979 Edition" add "and", after "National Fire Code" add "1979 Edition including", change "NFPA Publication No.l" to "No.101", in Section 1(a) change "1976" to "1979", Section 1(b) change "1976" to "1979". Ordinance No.#81-17, Series of 1981, AN ORDINANCE PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REGULATING THE INSTALLATION, ALTERATION, REPAIR, AND MAIN- TENANCE OF PLUMBING AND DRAINAGE SYSTEMS AND THE INSPECTION THEREOF IN THE TOWN OF AVON, COLORADO, FOR THE PURPOSE OF PROVIDING A PLUMBING CODE CONSISTENT WITH AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGHOUT THE TOWN; DEFINING CERTAIN :TERMS; ESTABLISHING MINIMUM REGULATIONS; ADOPTING BY REFERENCE THE 1979 EDITION OF THE "INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS PLUMBING CODE", MODIFYING AND AMENDING SAID CODE; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. This Ordinance adopts the "International Conference of Building Officials Plumbing Code". Ordinance No.#81-18, Series of 1981, AN ORDINANCE PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY; REGULATING THE INSTALLATIONS, ALTERATIONS, REPAIR AND MAIN- TENANCE OF ELECTRIC CONDUCTORS AND EQUIPMENT WITHIN OR ON PUBLIC AND PRIVATE BUILDINGS AND OTHER PREMISES IN THE TOWN OF AVON; DEFINING CERTAIN TERMS; ESTABLISHING FUNDAMENTAL SAFEGUARDS AND EXAMINATION OF EQUIPMENT FOR SAFETY; ADOPTING BY REFERENCE THE 1981 EDITION OF THE "NATIONAL ELECTRICAL CODE"; MODIFYING AND AMENDING SAID CODE; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. This Ordinance adopts the "National Electrical Code". On page 2(3) after the word "light" add "and", delete "and an adjoining automatic washer". Ordinance No.#81-19, Series of 1981, AN ORDINANCE ADOPTING BY REFERENCE THE COLORADO MODEL ENERGY EFFICIENCY CONSTRUCTION AND RENOVATION STANDARDS FOR NON-RESIDENTIAL BUILDINGS OF THE STATE OF COLORADO AND THE COLORADO RECOMMENDED ENERGY CONSERVATION "PERFORMANCE" CODE FOR NEW CONSTRUCTION AND RENOVATION OF RESIDENTIAL BUILDINGS, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. This Ordinance adopts the Colorado recommended Energy Conservation "Performance" Code. It was requested that an index be made for these Ordinances. With these modifications A.J. Wells moved approval on first reading of Ordinances No.#81- 13 through 81-19, Series of 1981 as read by title by the Town Attorney and as corrected. The motion was seconded by Bill Doyle. A roll was taken with all the Councilmembers voting yes. Resolution No.#81-8, Series of 1981, RESOLUTION CONCERNED WITH DEVELOPMENT REVENUE BOND POLICY, PROCEDURE AND GUIDELINES. The Town Attorney stated that this Resolution was based on the County. It was adopted April 28, 1981. Mr. Dunn stated that the aspects of the bonds. Allan Nottingham moved approval of the Accounts Payables with the exception of the TRIOND invoice. The motion was seconded by Sheila Davis was was unanimously carried. -3- 0 0 The Mayor reported on the vacancy seat that is now on the Design Review Board. It was suggested that the Council maybe consider a Professional to fill that seat. The East Beaver Creek Boulevard was discussed. It was requested that more information be researched regarding the donation of $30,000 from Pacific Heritage. It was reported that the Police Officers will be qualified Saturday, May 30, 1981.
