TC Minutes 02-10-19811 r: MINUTES OF THE REGULAR MEETING OF THE TOWN OF AVON, COUNCILMEMBERS HELD FEBRUARY 10, 1981 - 7:30 P.M. The regular meeting of the Town Councilmembers of the Town of Avon, Colorado was held in the Town Offices, second floor, Benchmark Shopping Center, Avon. The meeting was called to order by Mayor Alpi at 7:40 p.m. A roll call was taken with all the Councilmembers in attendance with the exception of Steve Erickson who arrived late. Also present were Town Attorney John Dunn, Chief of Police Dave Martinez as well as members of the press and public. Allen Gerstenberger approached the Council. He came before the Council to talk to them about the need of a housing authority for senior citizens in Eagle County. Also present were Danny Williams and Keith Troxel, county commissioners and members of the human resource committee that has been working on the elderly needs and trying to get senior citizen programs going. Dr. Dick Truchses approached the Council. He is Chairman of the human resource committee. He presented each Councilmember with a summary of the findings report. The committee is composed of people from around the county and in that sense has input of di-fferent needs and different perceptions. He stated at this time there was not a need for a nursing home for older people in the county, but would be more realistic in the mid '90's, but now would not be to early to start planning. Right now though, there was a need for affordable housing. He stated that there was need of rent subsidy housing for people who are essentially able to live on their own, but need some financial assistance and that was one of the major reasons for recommending a housing authority. He stated that the regulation of the housing authority set up by the county exclude municipalities unless the municipality specifically petition to be included. Mr. Gerstenberger showed some data that illustrates the logic that was used to come up with a conclusion that a housing authority was a good solution for Eagle County. Mr. Gerstenberger presented a Resolution to be signed if and when the Council decided to join the housing authority. After discussion Steve Erickson moved approval of Resolution No.#81-2, Series of 1981 as it stands and recommended that the Town join the housing authority, however, Councilman Erickson stated, he would like to emphasize that the Council was becoming part of the housing authority because the authority has the senior citizens as first priority and that the Town be represented by one member. The motion was seconded by A.J. Wells and was unanimously carried. Lawrence Fox approached the Council. He was asking permission from the Council to obtain a permit to run a catering service in the Town. There was some question as to where he would set up his base kitchen. Mr. Fox stated that he would run two trucks with the regulation commercial canteen refrigerated back. The foods that would be served would be hot sandwiches, coffee, canned soup, snacks, fruit drinks and doughnuts in the mornings. After discussion Steve Erickson requested that no action be taken on the application until the chief of police had an opportunity to make a background check on the applicant. 0 0 Second reading of Ordinance No.#81-1, Series of 1981, AN ORDINANCE ADOPTING A SIGN CODE FOR THE TOWN OF AVON;PROVIDING DEFINITIONS AND REGULATIONS; ESTABLISHING A PERMIT SYSTEM PROVIDING PENALTIES FOR VIOLATION THEREOF; AND SETTING OUT ADDITIONAL DETAILS IN RELATION THERETO. The Town Attorney reported that he researched the legality of real estate signs. He stated that being a municipality, the Town may not prohibit real estate signs. After lengthy discussion the Council agreed to change (f-2) from "4" to "2" square feet and in section (4-i) add "unless displayed from inside of a window and may not be any larger than 2 square feet". Shelia Davis moved approval of Ordinance No.#81-1, Series of 1981 on second reading with the correction in section (f-2) and (4-i). The motion was seconded by Steve Erickson. A roll call was taken with all the Councilmembers voting yes. First reading of Ordinance No.#81-2, Series of 1981, AN ORDINANCE PROVIDING REGULATIONS FOR MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF AVON AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. After discussion Steve Erickson moved to table Ordinance No.#81-2, Series of 1981 and that the Council invite the owners, operators and any of the tenants of the Benchmark Village Mobile Home Park for some input. The motion was seconded by Hugh Price and was unanimously carried. The financial reports were next presented to the Council. Hugh Price moved approval of the accounts payables, seconded by Bill Doyle and was unanimously carried. A.J. Wells moved approval of the capital project fund, seconded by Steve Erickson and was unanimously carried. The minutes of the January 27th meeting were next presented to the Council. Allan Nottingham moved approval of the January 27th meeting with these corrections,"Penwell" and "associates". The motion was seconded by Hugh Price and was unanimously carried. The Mayor reported that Sunridge would donate $30,000 to the park and recreation for tennis courts, this would occur some time in May. It was noted that on Lot#13, Block#l, there were time frames submitted from the owners of the said Lot,on the contingencies that had to be completed on the building. Chief of Police Dave Martinez discussed the violations that took place in the Town during the month of January. Lou Acosta, accounting officer reported on the computer terminal. Mr. Acosta stated that for an American tele-data, terminal CRT screen and printer, the rent per month would be $246.00 and that the Town could buy the whole system at the end of two years for a total of $1,293.00. There being no further business, Steve Erickson moved that the Council adjourn and Hugh Price seconded the motion.
