TC Minutes 10-03-1978E MLN TIES OF SPECIAL MEETING OF THE TOWN OF AVON HELD OCTOBER 3, 1978 E A special meeting of the Town CouncilTreembers of the Town of Avon, Colorado, was held in the Town Office, Second Floor, Benchmark Shopping Center, Avon, Colorado. The meting was called to order at 6:45 by Mayor Angelo V. Alpi. Councilmembers in attendance were: Richard Allen, Joyce Allred, Angelo Alpi, William Doyle, Steven Erickson, and Carol Richards. Allan Nottingham was absent. Also present were : George Rosenberg, Town Attorney; lbn Allred, Benchmark Architec- tural Control Committee and the Upper Eagle Valley Sanitation District. Richard Allen moved to approve the Minutes of the Regular Meeting of September 26, 1978. Seconded by Carol Richards. Notion carried. Following a brief discussion of the proposed 1979 Budget, Joyce Allred moved that the Council adopt the proposed 1979 Budget. Seconded by Carol Richards. Unanimously carried. A copy of the 1979 Budget is attached. The 1978 Budget has been submitted to the lst Bank of Vail for their information with regard to issuing the Town a loan. The Town should be receiving the loan within a week. The Town received its first Conservation Trust Fund distribution which will be earmarked as such and placed in a savings account. It was noted that the Town should retain an auditor to help set up the Tbwn's accounting and bookkeeping system. Using Avon's current assessed valuation it was determined that the 1978 mill levy should be 15 mills. This will generate approximately $39,000 in the spring of 1979. Richard Allen moved to adopt 15 mills as the 1978 mill levy. Seconded by Carol Richards. Unanimously carried. The mill levy must be certified to the Board of County Commissioners by November 1, 1978. With regard to the second reading on the Uniform Building Code, it was suggested that Les Douglas, of Eagle County Depart-ent of Planning and Development, be invited to attend the next Council meeting to explain the difference between the 1973 Uniform Building Code and the 1976 Uniform Building Code. 0 • Ki cn Allen rrnved that the Second reading on the Uniform Building Code by continued until Les Douglas can corre before the Council to explain these differences. Nation carried. kDn Allred of the Benchmark Architectural Control Comd-tee dismissed the Committee's function and now it interrelated with the County Planning DepartTent's and the Town Council's jurisdiction. The Control CcnTnittee is chiefly concerned with the esthetics of an applicant's project, the County with the technical aspects, and the Town with zoning and planning. It was suggested that,to expedite matters, applicants submit a ca wlete set of plans to each of the three bodies simultaneously for consideration. Next the Council considered the proposed Beal Estate Transfer Tax Ordinance which calls for a 1% tax on all nonexempt transfers of real property valued in excess of $500. These funds are to be deposited in the General Fund until the Town has reached $150,000 or January 1, 1980, whichever shall occur first, at which titre 50% of the revenues shall be deposited in the General Funds and 500 of the revenues shall be deposited in the Public Works Fund. George Isenberg lead the discussion explaining the proposed Ordinance section by section. Following some discussion, Rich Allen moved to accept the Real Estate Transfer Tax Ordinance on first reading. Seconded by Carol Richards. Unanimously carried. George Pbsenberg then introduced the proposed Sales Tax Ordinance which calls for a 1% sales tax on all retail sales of tangible personal property and on the furnishing of services for calendar 1978, to be increased to 2% for 1979, 3% for 1980 and 4% for 1981 and all subsequent years. Joyce Allred moved to accept the proposed Sales Tax Ordinance on first reading. Seconded by Steve Erickson. Notion unanirrously carried. Joyce Allred roved that the Council authorize the Mayor, Al Alpi and the Town Clerk, Leslie Allen, to sign the draw note to be issued by the 1st Bank of Vail. Seconded by Richard Allen and unanimously carried. It was decided that the Council appoint a purchasing committee of two CouncilrrenberS to approve all purchase orders. Joyce Allred moved that Al Alpi and Carol Richards be appointed as the purchasing committee. Seconded by Steve Erickson and so carried. It was brought to the Council's attention that there is a building in the Mobile Horre 11, Park illegally in oormercial use. The Council agreed that Mayor Alpi would discuss this problem with the manager of the Mobile Home Park. The Council received a letter from the Eagle Vail Fire D`partrrent regarding a proposed privately sponsored day care center to be located in the Mobile Hcn-e Park. Although it was discussed briefly, no action was taken. Ron Allred of the Upper Eagle Valley Sanitation District cam before the Council to ask Council's consideration regarding the A-95-201 Facilities Plan Extension. It was agreed that Council invite Jim Collins, of Local Govern rent Management Consultants, Inc., to attend the next regular Council meeting, October 10, 1978, to explain the proposed study. Steve Erickson moved that the public hearing on the Real Estate Transfer Tax Ordinance and the Sales Tax Ordinance be held Tuesday, October 10, at 7:30 in the Tcwn Office. Seconded by Joyce Allred. Notion carried. Ron Allred then discussed the problem of shortage of To wn office space. The Council agreed to examine the office space currently available in the Benchmark Building to determine the additional space necessary for the Town.
