Please find below the Avon Town Council motion that approved the funding request on February 22, 2011; this motion will become part of the permanent record in the minutes for that meeting. These draft minutes will be reviewed and approved at the March 8, 2011 meeting. Councilor Goulding moved to fund the Avon / Beaver Creek Express Shuttle, both daytime and nighttime service, and if the Westin Riverfront Resort & Spa contributes to this service, the difference would then be split between Beaver Creek Resort Company and the Town of Avon, with an amount not to exceed $70,152 for the ski season. Councilor Phillips seconded the motion and it passed with a four to two vote (Evans, Goulding, Phillips, and Reynolds — aye; Dantas, Ferraro - nay). I am enthusiastic about the opportunity which lies before us to enhance the collaborative and cooperative relationship between the Town and Beaver Creek. Together, we give ourselves the best opportunity for success in our endeavor to appropriately represent the common interests of all our various constituents. Town of Avon / Beaver Creek Shuttles Throughout the last several winter seasons and for the first half of the current season, Beaver Creek has operated two (2) shuttles which serve the public for transportation between the Town of Avon and the Beaver Creek Village. 1. The first shuttle is an express, 10 minutes daytime shuttle which runs between the main Avon Transportation Center and the Covered Bridge Transportation hub in Beaver Creek. 2. The second is an Evening "Restaurant" shuttle which runs between various stops in the Town of Avon core (Westin, Avon Station, and a minimum of 2 other stops convenient to lodges and hotels in Avon) and the Beaver Creek Village. Details of both of these shuttle services may be found in the attached memorandums. As has been the understanding in the past based on mutual benefits these transportation services provide to the Town of Avon and Beaver Creek, Beaver Creek entered the season with the expectation that a cost sharing arrangement would continue to be acceptable to both the Town and Beaver Creek.. However, in November 2010, we were informed that Town Council had directed staff to cancel participation in the cost of these shuttles. We believe there lays strong mutual benefit of maintaining a connection for the public between the Town of Avon and Beaver Creek. Beaver Creek guests, residents, and employees rely heavily on this connection to take advantage of the many amenities which lie within the Town of Avon. These amenities are considered vital for our collective community and both the Town of Avon and Beaver Creek should together highly value their accessibility. At the same time, Avon citizens, Avon lodging guests and merchants rely heavily on this connection to access Beaver Creek which is a tremendous selling point for the Town community. Given the strong mutual briefly discussed above, the request to come before the Avon Town Council next week is to ask that you re- consider Town participation in the cost of the shuttles and authorize Town Staff to enter into a cost sharing agreement with Beaver Creek based on the service costs described in the attachment. Evening Restaurant Shuttle: One (1) shuttle providing service every day at approximate thirty- minute intervals between Avon and the Beaver Creek Plaza transit stop(s). The operating hours will be between 6:00 p.m. to 10:30 p.m. In Avon, the shuttle bus shall stop at the Westin, the Avon Station transit center and a minimum of two other stops which are convenient to lodges and hotels in Avon's town core area (typically based on rider request). This service will be provided during the period from December 10, 2010 through April 3, 2011. WHEREAS, Avon, BCRC and BCMD desire to cooperate and agree to provide shuttle bus services between the Town of Avon and the Beaver Creek resort area; WHEREAS, Avon and BCMD are authorized by Colorado Constitution, Article XIV, Section 18(2)(a) and Section 29 -1 -203, Colorado Revised Statutes, to cooperate and contract with each other to provide any function, service or facility lawfully authorized to each; WHEREAS, BCRC desires to provide shuttle bus vehicles, drivers, administrative support and other equipment and services to provide shuttle bus services as described in this Agreement; WHEREAS, Avon desires to provide financial contributions to support the shuttle bus services as described in this Agreement; WHEREAS, Avon, BCMD and BCRC are authorized to provide bus transit services within their respective boundaries; and, WHEREAS, Avon, BCMD and BCRC desire to enter into this funding agreement for the 2009 -2010 winter visitor season. NOW, THEREFORE, in consideration of the covenants, conditions and agreements set forth herein, the Parties agree as follows: 1. Term: This Agreement shall be in full force and effect from November 24, 2010 to April 17, 2011. 2. Shuttle Bus Service: BCMD and BCRC agree to provide the following described shuttle bus services: a. Avon Skier Shuttle: Two (2) shuttle buses providing service every day during the Term of this Agreement, such service shall include shuttle bus service every ten (10) minutes between the Avon Station transit stop located on West Benchmark Road and the Beaver Creek Plaza transit stop located at the Covered Bridge on Village Road between the hours of 8:00 a.m. to 11 :00 a.m. and 2:30 p.m. to 5:30 p.m. for a total estimated number of hours of 1,740. This service will be provided during the period from November 24, 2010 through April 17, 2011. b. Evening Restaurant Shuttle: One (1) shuttle providing service every day during the Term of this Agreement excepted as provided below.
