Inter-Mountain Engineering Design Services Proposal
Summary: Inter-Mountain Engineering, Ltd. submitted the attached Proposal for
Engineering Design Services for the Eaglebend Drive Streetscape Improvements Project.
This Proposal is an update of a Proposal previously approved by Council January 2001. The
project was placed on hold shortly thereafter and no work was performed under the Proposal.
The 2001 Proposal was for a total cost not to exceed $37,510.00. This proposal has been
expanded to include the design for replacement railings on the Stonebridge Road Bridge over
the Eagle River. These railings are not in conformance with today's standards and are
reconunended for replacement in the bi-annual Bridge Inspection Reports performed by the
Colorado Department of Transportation. The design costs associated with replacement of
these railings is $13,110.00 and the proposed total fee for all design services is not to exceed
$48,572.50.
We recommend approval of the Inter-Mountain Engineering, Ltd. Proposal for Design
Services for Eaglebend Streetscape Improvements ill an amount not to exceed $48,572.50.
Background: The Eaglebend Drive Streetscape Improvements Project is described in
the Capital Projects Fund Budget as:
"Extend Streetscape Improvements Including Curb, Gutter, Streetscape Lights and
Bikepath along Eaglebend Drive from Nottingham Station to Stonebridge Drive and
extend Bikepath to US Highway 6."
Budget for this Project is: 2005 $ 40,000 2006 $ 380,000
Special Funds: Eaglebend Housing Authority $ 50,000
CDOT Enhancement Grant Funds (Tentative) $ 149,000

Dear Norman,
Inter-Mountain Engineering, Ltd. (IME) is pleased to present this proposal for
engineering design services for Eaglebend Drive and Stonebridge Road
Streetscape and Street Improvements. We feel that we are uniquely qualified for
this project due to our solid working relationship with Town staff and the fact that
we are a local firm with extensive experience designing and building projects of
this size and scope.
Over the years, IME has successfully completed many similar projects for the
Town and other clients. During the course of this work, we have developed
stable partnerships with all the prospective members of our team. We are well
versed in the Town's design standards and familiar with Town expectations,
which will help lead to a successful project team and a superior product. Plus,
we feel that being local is a significant asset that will allow us to be more
responsive to the Town's needs during design.
Team Description and Profile
Inter-Mountain Engineering is a multi-disciplined civil engineering firm. We have
the in-house capability to provide the roadway, grading, drainage, and utility
design services required for this project.

Architectural Engineering Consultants is an electrical engineering firm with
offices in Avon, Colorado. The firm provides road and path lighting, tree and
sculpture spot lighting, power, security, video surveillance, fire alarm, lightning
protection and multi-media communication systems design services.
Hepworth-Pawlak Geotechnical, Inc. (H-P Geotech) is a full-service geotechnical
engineering consulting firm with offices in Glenwood Springs and Denver,
Colorado. Their staff of highly skilled professionals has considerable experience
with projects in the Eagle/Vail Valley.
Lonco, Inc. specializes in structural, environmental and transportation
engineering services. Work on this project will be performed from their Denver
office. The firm has an excellent reputation for providing quality bridge design
services and conducts bridge inspections for Colorado Department of
Transportation in this area.
Below are the key personnel that will participate in the project:

Ms. Mendonca has been IME's engineering manager since October 1999. She
has more than twenty-one years experience with civil project planning, design
and construction. Mr. Tobias joined IME in 2001. He has more than eighteen
years experience with civil project planning, design and construction. Both
individuals have very diverse backgrounds and, between them, are able to
provide project management, public involvement, engineering, and construction
oversight services.
The Town of Avon has worked extensively with Jeff Spanel, Duke Fehringer,
Sandi Mendonca and Fred Tobias on a variety of projects including Buck Creek
Drainage Improvements, Metcalf Ditch Improvements, Nottingham Road
Improvements, West Beaver Creek Boulevard Street Improvements Construction
Services, East Avon Street Improvements, Master Drainage Study, Swift Gulch
Road Improvements, Streetscapes, Recreation Center, Nottingham Lake
Sedimentation Pond and several aerial surveys.

Dave Young of H-P Geotech and Stan Humphries of Architectural Engineering
Consultants have also worked with IME and/or the Town on several past
streetscape projects. Both have comprehensive knowledge of the Town's
standards and protocols regarding their disciplines.
Dan Bechtold of Lonco, Inc. has comprehensive knowledge of CDOT's standards
and requirements related to the recommended safety improvements for the
bridge rails on the Avon-Eaglebend Bridge over the Eagle River on Stonebridge
Drive.
Statement of Work
The scope of services, as defined by Town staff includes:
• Adjusting the centerline of Eaglebend Drive north (from the intersection
with Stonebridge Drive approximately 1000 feet to the west) sufficiently to
allow two 12' foot travel lanes, 2.5' curb and gutter both sides, and a 10'
wide attached asphalt path on the south side of the road.
• Locating a bus pull-out on Eaglebend Drive near the west end of the
proposed improvements..
• Adjusting the centerline of Stonebridge Drive to the east (from the
intersection with Eaglebend Drive to the intersection with Highway 6)
sufficiently to allow two 12' foot travel lanes, 2.5' curb and gutter on the
west side of the road, and a 6' to 10' wide attached asphalt path on the
west side of the road. If space allows, the Town would prefer to retain a
shoulder and drainage channel on the east side of the road.
• Re-surface existing paths leading from Stonebridge Drive down to the
Eagle River at the bridge.
• Locate Town standard streetlights at 100' o.c. adjacent to paths with two
lights at the bus stop.
• Remove the cul-de-sac on Eaglebend Drive.
• Replace the bridge rails, rail transitions, approach rails and approach rail
ends to meet AASHTO guidelines (in accordance with the 6-22-04 bridge
inspection report).
• Soils testing as necessary to recommend a typical pavement thickness
design.
The basic scope of services does not include design or construction documents
for a custom shelter at the bus pull-out.

Phase I - Information Gathering
IME will gather available data, plans, and right-of-way documents from our files
and utility company as-built drawings during the first week of the project. IME will
perform the supplemental topographic survey necessary to design the proposed
improvements. Existing property corners, drainage improvements and other
surface features will be field located during the survey, as necessary. Duke
Fehringer will oversee the field survey.
IME will prepare a base map using this information on which to overlay the
proposed improvements. It will include existing elements such as drainage
channels, culverts, edge of pavement, paths/walks, curb and gutter, driveways,
signs, retaining walls, buildings, utilities, trees and other landscape features that
must be considered during the design phase.
H-P Geotech will drill four borings along Eaglebend Drive and Stonebridge Road
in two locations each. They will use the data and test results from these borings
to recommend an appropriate pavement section.
As soon as sufficient survey data is available, IME will prepare a section across
Stonebridge Road at the Eaglebend Clubhouse to determine whether the typical
section included in the scope of services is feasible. If so, the design criteria
described above will be used to develop a horizontal alignment for the proposed
improvements. If not, the design criteria and scope of work will be revised as
necessary before a horizontal alignment is developed.
IME has scheduled one meeting during the initial phase of the work that will be
attended by Town staff. This meeting will be held after the section through
Stonebridge Road near the Eaglebend Clubhouse is available to establish and
communicate project goals, schedule and budget, and clearly define the
expected results. IME will produce and distribute minutes from the team meeting
to Town staff.
IME will also initiate preliminary contact with CDOT during this phase of the
project to identify, up front, their concerns about and suggestions for the project.
Phase II - Preliminary Design and Plans
IME will develop a horizontal alignment for the proposed improvements. After the
horizontal alignment is fixed, IME will complete preliminary design (50-60%) of
proposed improvements on Eaglebend Drive and Stonebridge Road. We will
continue to consult with our team specialists and CDOT staff during this phase of

the work. The preliminary plans will specify the type, location and elevation (if
appropriate) of proposed road widening, paths, curb, gutter, a bus pull-out and
associated, pre-fabricated furnishings (i.e. a "Handi-Hut" shelter at the bus stop).
The preliminary plan set will include plan/profile sheets and some typical details.
IME will meet with Town staff one time during this phase of the work to identify
opportunities and constraints for the project and to ensure that the designs
developed are feasible and appropriately address the identified issues. In this
meeting, IME and Town staff will define the expected results of and develop an
agenda for a public meeting at which IME staff will present the preliminary design
and cost estimate for the proposed improvements. Presentation materials will
include mounted plans and typical street sections. [ME will produce and distribute
minutes from the meetings to Town staff.
Phase III - Final Design and Preparation of Construction Documents
IME will complete the design of proposed improvements on Eaglebend Drive and
Stonebridge Road incorporating comments received from the public meetings
and Town staff. IME will generate 1:1 cross sectional information at 100-foot
intervals along the horizontal alignment and at intersections and driveways.
Cross-sectional information will extend beyond the right-of-way, as necessary.
IME will continue to consult with our team specialists and CDOT during this
phase of the work.
The lighting design provided by AEC will be based on the preliminary plans and
the scope of work defined in the statement of work. AEC will specify the location
of decorative mounted pole lights matching the new Town of Avon standard (to
be provided to IME by Town staff). Luminaire type, light standard type and
mounting height, bracket arm type and length, and pole base details will be
provided. Utility transformers will be located and the power distribution required
for the lighting and service outlets defined.
The bridge and approach rail details provided by Lonco, Inc. will be based on
their 6-22-04 inspection report and CDOT input.
The construction plan set will include a title sheet with vicinity map and general
notes, site plan, plan/profile sheets with grading, drainage, erosion control,
signage and pavement markings, cross sections, lighting and electrical plan, and
typical details. IME will compile the plan sets from our documents (including the
typical pavement section recommended by H-P Geotech and Lonco, Inc. bridge
and approach rail details) and those of AEC. (The construction contractor will be

expected to prepare and submit the Construction Traffic Control Plan with his bid;
however, IME's specifications will clearly outline the constraints and limitations
for work scheduling and traffic control that will be imposed by the Town.)
IME will compile a complete Project Manual with Technical Specifications, Bid
Tabulation Sheets, and Town Standard Front End Contract Documents and a
cost estimate for construction, with input from all team members.
IME will meet with Town staff one time during this phase of the work to ensure
that the plans developed are feasible and appropriately address the identified
issues. In this meeting, [ME and Town staff will define the expected results of
and develop an agenda for a public meeting at which IME staff will present the
construction plans and final engineer's estimate for the proposed improvements.
Presentation materials will include mounted plans. IME will produce and
distribute minutes from the meetings to Town staff.
The completed plans will also be delivered to CDOT for review and comment.
The final design and construction documents will be finished by the end of
September 2005.
Phase IV - Legal Descriptions and Right-of-Way Acquisition
IME will prepare the required legal descriptions for right-of-way acquisition and/or
temporary construction easements; however, the number, and thus the cost, is
not fixed at this time. The fees for this additional service will be negotiated with
the Town after completion of the design stage of the work.
Phase V - Construction Administration
When Construction Documents are complete, IME's team would be pleased to
assist the Town any desired construction contract administration services. Under
the basic scope of services, IME staff will aid the Town staff with the pre-bid
conference, addendums, evaluation of construction bids, and the pre-
construction meeting.
Although it has not been included in the basic scope of work, [ME staff could also
provide the Town with services related to construction survey, clarification of the
plans and specifications, review of requested changes and corrections, periodic
field visits, construction quality control and construction contract administration
during construction. Finally, IME staff could perform a survey of the completed
project and produce of record drawings of the completed project. All such extra

services, if desired, can be provided for additional fees (to be negotiated when
the project is ready for construction).
Fee
The estimated fee for the proposed basic services is $48,572.50. We will not
exceed this fee without prior approval. Our fees are detailed as follows:

A spreadsheet, which indicates the projected time devoted to each stage of the
work, is also enclosed.
The services are inter-related. The total fee is broken down into tasks solely to
facilitate communication of the scope of work and the preparation and approval
of progress billings.
Hourly rates for all services are listed in the attached fee schedule.
Revisions in the scope of services or extra engineering required by the Town
(except for minor or insignificant changes) may necessitate changes to the plans
and an associated increase in the cost of the services. All work outside the
described scope of work will be billed at the normal billing rates for the individuals
assigned to the project. IME will not perform out-of-scope work without
authorization from the Town.
Conclusion
This proposal is written in response to your request. The proposal includes an
overview of our approach to the project to demonstrate our understanding of the
scope of services requested, our fee schedule, and a cost estimate for the basic
services.

General Conditions
THESE GENERAL CONDITIONS ARE INCORPORATED INTO AND MADE A PART OF AGREEMENTS
FOR SERVICES BY INTER-MOUNTAIN ENGINEERING, LTD.
L Responsibilities of Inter-Mountain Engineering Ltd.:
A. IME will perform professional engineering and/or professional surveying services as specified under "Basic
Services" and when authorized, "Additional Services".
ll. Responsibilities of Client:
A. Provide all criteria and full information as to the requirements of the project. Furnish all appropriate tests, reports,
and surveys not included in Basic Services. A Title Insurance policy shall be provided when a survey is included in
Basic Services. IME shall be entitled to rely upon the accuracy and completeness of such information.
B. Render approvals and decisions as expeditiously as necessary for the orderly progress of IME services.
C. Give prompt notice to IME of any development that affects the scope or timing of its services.
D. Coordinate the work of IME with that of others.
E. Give complete and careful consideration to services and recommendations provided by IME.
F. Provide "Right of Entry" for IME and all necessary equipment. IME will take reasonable care to reduce damage to
property, however, it is understood that in the normal course of work, some damage will occur, the repair of which is
not part of this agreement.
G. Delineate the location of all utility lines and subterranean structures within the property. IME shall not be
responsible for damage resulting from their incorrect location.
Ill. Compensation:
A. IME shall submit invoices to client monthly and a final bill upon completion of services. Invoices are due upon
presentation, and past due 30 days after the invoice date, client agrees to pay a service charge of 1 3/4 percent per
month on past due accounts.
B. If it becomes necessary to enforce collection, client agrees to pay all costs of collection, including attorney's fees.
C. It is understood that estimates of professional fees are based upon the preparation of designs, reports, or
surveys for a single design concept or site plan, and that charges to that concept or additional engineering required
by governing agencies (except normal "Redlines") shall constitute an increase in the scope of services. Additional
Services ("Additional Services") shall be billed at the normal billing rates for the individuals assigned to the work. No
Additional Services will be provided without prior authorization.
IV. Standard of Care:
A. Services of IME under this agreement will be performed in a manner consistent with that level of care and skill
ordinarily exercised by reputable members of the profession currently practicing under similar conditions in the
locality of the project.
B. IME liability for damages to client arising from negligent acts, errors or omissions, will be limited to an aggregate
amount not to exceed $50,000 or the total fee under this agreement, whichever is greater. This limitation shall apply
to IME, its officers and employees.
V. Ownership of Documents:
A. All reports, drawings, specifications, notes and other documents prepared by IME in the course of providing
services are instruments of service and shall remain the property of [ME. These documents are not intended to be
suitable for reuse on extensions of this project or for use on any other project. Documents shall not be altered in any
manner without the permission of IME.
Vl. Construction:
A. Client agrees to require the construction contractor to assume sole and complete responsibility for the
construction of the project including the safety of persons and property and the means, methods, techniques and
sequences of construction.
B. If IME is not providing services during the construction process, client hereby agrees to contact IME if construction
documents are unclear or if errors or discrepancies are discovered. IME shall not be liable where client and/or
contractor makes his own interpretations of and/or revises the intent of the construction documents and design
drawings.
C. If construction observations are provided, the term "Observation" implies only that IME would observe the
progress of the contractors work, and perform tests, from which to develop an opinion as to whether the work
essentially complies with the job requirements. Our efforts shall be directed at providing the client with a greater
degree of assurance that construction is proceeding in accordance with project requirements. The presence of ]ME
representatives will be for the purpose of providing observation and/or testing. IME work does not include
supervision or direction of actual work of the contractor, his employees or agents. Neither the presence of IME
representatives or their observations or testing shall excuse the contractor in any way for defects discovered in his
work.
D. Any opinions of project cost rendered by IME represents it's best judgment and are furnished for general
guidance. IME makes no warranty as to the accuracy of such opinions as compared to bid or actual costs.
VIL Soils and Materials Testing:
A. Client recognizes that subsurface conditions may vary from those encountered at the locations where explorations
are made, and that data, interpretations and recommendations made by IME are based solely on the information
available to it.
B. Client represents that Client has made a reasonable effort to evaluate whether hazardous materials are on or
near the project site and has informed IME of any information or findings relative to the possible presence of such
materials. Should unanticipated hazardous material be discovered in the course of the performance of services
under the Agreement, such discovery shall constitute a changed condition mandating a renegotiation of the scope of
work or termination of services. Should the discovery of unanticipated hazardous materials require IME to take
immediate measures to protect health and safety, Client agrees to compensate IME for costs incident to taking such
measures and for any equipment decontamination required. IME agrees to notify Client promptly when
unanticipated hazardous materials or suspected hazardous materials are encountered. Client agrees to make any
disclosure required by law to appropriate government agencies. Furthermore, Client agrees to defend, indemnify
and hold IME harmless from any and all liability arising from discovery by anyone of unanticipated hazardous
materials or suspected hazardous materials.
C. [ME will discard samples 30 days after submission of reports on those samples.
IX. Insurance:
A. IME and it's employees are protected by insurance which meets or exceeds statutory requirements for Workman's
Compensation, Public Liability, Property Damage and Professional Liability. Certificates evidencing coverage will be
provided upon request. [ME shall in no event be responsible for any loss or damage beyond the amounts, limits and
conditions of such insurance.
X. Miscellaneous:
A. This agreement shall be governed in accordance with Colorado law.
B. Services are for the exclusive use of the Client for this specific project. These services are not to be relied on by
others without the specific authorization of IME.
C. Neither party shall assign or transfer any interest in this agreement.
D. This agreement may be terminated by either party upon 7 days written notice to the other, in which case IME shall
be paid for all services provided up to termination, plus all additional cost incurred by IME due to said termination.
