02-09-2004 MARCIN ENGINEERING LLC MOUNTAIN VISTA COMMERCIAL CONDOMINIUM MAP FOR LOT 4 OF THE MOUNTAIN VISTA RESORT SUBDIVISIONMARCIN ENGINEERING LLC February 9, 2004 Mayor Buz Reynolds, Jr. Town of Avon PO Box 975 Avon, CO 81620 I_)car Honorable Mayor Reynolds: 'I'lic Mountain Vista Commercial Condominium Map for Lot 4 of the Mountain Vista Resort Subdivision was approved by the Avon Town Council on November 25, 2003, pending completion of technical corrections. According to the Avon Municipal Code section 16.24.030: the subdivider shall cause the FTrial Plat and Restrictive Covenants, if any, to be recorded within ninety days from the date of approval and acceptance of the town council. In the event that the plat is not so recorded, the approval of the town council shall be deemed to be void and such plat shall not thereafter be recorded, unless and until the mayor executes a written authorization for recording such final plat. Unfortunately there have been delays in completing the Amended Final Plat which must precede this Condominium Map due to an issue with a sewer easement on Lot 4. Once the issue with this easement is resolved, it will not take long to complete the necessary technical corrections and file the map with the Town. We have been in contact with your staff throughout this period and they are aware of the issues and the reasons for the delay. As the representative of Points of Colorado, Inc. for this amended final plat, I am therefore requesting that this plat be authorized for recording by the mayor. Sincerely, Stephen R.
