No. 1999-01J:\Planning & Zoning Commission\Resolutions\1999\Res 99-01 Lot C ACBC SRU parking.doc TOWN OF AVON PLANNING & ZONING COMMISSION RESOLUTION NO. 99-1 A RESOLUTION APPROVING A SPECIAL REVIEW USE PERMIT TO OPERATE A TEMPORARY PUBLIC PARKING FACILITY AS STIPULATED IN TITLE 17 OF THE AVON MUNICIPAL CODE, FOR LOT C, AVON CENTER AT BENCHMARK AT BEAVER CREEK SUBDIVISION, TOWN OF AVON, EAGLE COUNTY, COLORADO HEREAS, Victor Mark Donaldson, acting as the authorized agent for the owners of Lot C, Avon Center at Benchmark at Beaver Creek Subdivision, has applied for a Special Review Use permit to operate a temporary public parking facility, as described in the application and plan dated January 15, 1999, as stipulated in Title 17, of the Avon Municipal Code; and HEREAS, a public hearing has been held by the Planning & Zoning Commission of the Town of Avon, pursuant to notices required by law, at which time the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed Special Review Use permit application; and HEREAS, the Planning & Zoning Commission of the Town of Avon has considered the following: A. Whether the proposed use otherwise complies with all requirements imposed by the zoning code; and B. Whether the proposed use is in conformance with the town comprehensive plan; and C. Whether the proposed use is compatible with adjacent uses. OW, THEREFORE, BE IT RESOLVED, that the Planning & Zoning Commission of the Town of Avon, Colorado, hereby approves a Special Review Use permit to operate a public parking facility from January 30, 1999 to February 16, 1999, as described in the application and dated January 15, 1999, as stipulated in Title 17, of the Avon Municipal Code for Lot 38B, Block 2, Benchmark at Beaver Creek Subdivision, Town of Avon, Eagle County, Colorado, subject to the following conditions: 1. That gravel or other materials be used at the site’s entrance to lessen the amount of mud tracked onto West Beaver Creek Boulevard. 2. That the site be re-graded and re-vegetated as early as possible in the spring, 1999 and no later than May 29, 1999. 3. That a split rail fence be installed along the parcel’s West Beaver Creek Boulevard frontage as early as possible in the spring, 1999 and no later than May 29, 1999.
