Planner I ) Summary of Requests Snowball LLC has submitted a temporary use permit for temporary parking lots located on Lot 1, Filing 1, Village at Avon Subdivision ("the Property"). The application proposes using three separate parking areas: north rodeo lot, south rodeo lot, and an overflow parking lot located at the southwest corner of Post Blvd and E. Beaver Creek Blvd. The proposal includes providing approximately 1,000 vehicle parking spaces as well as temporary light fixtures, trash receptacles and a dumpster. The temporary parking lots will be used from Friday, March 2nd through Sunday, March 4`h. Background The Snowball Music Festival is in its second year of operation in Avon. The festival is permitted by the Town Council through the Special Event application for all operations on Town of Avon property. The Snowball Music Festival will contain four (4) tents and/or stages located on the Nottingham Park soccer field, Nottingham Park picnic shelter, East Municipal Parking lot, and Recreation Center Parking lot. In association with the event, Lake Street will be closed to traffic during the event, along with through traffic on Riverfront Lane. During the event access to the Westin Property will be maintained from the easterly end of Riverfront lane, and that traffic configurations have been coordinated with emergency response agencies. Process Chapter 7.24.080 of the Avon Development Code (ADC) regulates Temporary Uses and Structures on private property. According to this section, the PZC will make the final decision on any temporary use exceeding thirty (30) days or three hundred (300) people. In addition, all Temporary Use Permit reviewed by the PZC shall be publicly noticed through a mailing of all property owners within 300 feet. The mailing was performed on Thursday, January 27, 2012 by Town Staff. The Town Council will render the final decision, through the Special Event application, on all temporary uses and structures on Town of Avon Property, including Right of Ways. Property Description The Property is 111.18 acres (4,843,000 square feet) in size, and zoned Planned Unit Development (PUD). The site is developed with a temporary trailer, the rodeo grounds and associated parking, a recycling center, and the temporary Xcel Pipeline staging and parking area. The remainder of the lot is undeveloped and in a relatively natural state. The Property is located between the 1-70 corridor to the north, railroad tracks to the south, Chapel Square to the west, and Post Blvd to the east. Planning Analysis The Applicant has provided three separate parking lot layouts for the three separate parking areas. The North and South Rodeo lots are being utilized as they currently exist. These areas will not be enlarged and the existing access points will remain. The two lots can provide enough parking for 7Snowball Temporary Parking Lots [I H February 7, 2012 PZC Meeting approximately 853 vehicles, as seen in Attachment B. The applicant is proposing to place fourteen (14) trash cans around the parking areas as well as an eight (8) yard dumpster to the west of the property near the intersection of Chapel Place and E. Beaver Creek Blvd. The applicant is also proposing to locate two light towers adjacent to the entrance of each lot. The light towers are crack-up towers with the fixtures approximately twenty-eight (28) feet above grade. Each tower can illuminate approximately 4-5 acres and can be customized to limit the illumination area. The proposed trash receptacles and dumpster are sufficient in both number and location and provide adequate opportunities for disposing of waste. The two light towers also are sufficient in number, but the location needs to be addressed, and will be coordinated with Public Works and the Police Departments. Section 15.30.040(3)(g) of the Avon Municipal Code states, "Temporary (two [2] day or less) high intensity discharge floodlighting may be used for sports lighting and Town -sponsored events, provided that the lighting be turned off no later than one (1) hour after the event is concluded. The fixtures must be aimed so that their beams are directed and fall within the primary playing or performance area." The proposed event is three (3) days, but the light towers are temporary and should be subject to the intent of this code section. Furthermore, the intent of this section requires the lighting to be aimed at the area it is intended to illuminate, in this instance the parking lots. The light tower for the north lot has an adequate location, but the south lot's tower is positioned to spread light towards the residential properties to the south and across the railroad tracks. This tower should be repositioned to the southwest of the parking lot so that the light shines to the northeast, away from the residential properties. In addition the light towers should be turned off no later than one (1) hour after the event end each evening. Each lot will be staffed with four (4) event employees to provide assistance with collecting parking fees and parking the vehicles according to the proposed lot layout. The third lot, the overflow lot, is intended for overflow parking and will only be used if the previous two lots are filled. This lot is located southwest of the intersection of Post Blvd and E. Beaver Creek Blvd and is in the same location as the Xcel Pipeline projects temporary parking. The applicant is proposing to utilize this lot as it exists with the access point just north of the Xcel Pipeline Building and temporary silt fencing around the parking perimeter. This lot does not contain any trash receptacles, dumpsters, or light fixtures. Staff would recommend that the applicants provide four (4) trash cans placed throughout the lot when in use. As it is only used for overflow parking a light tower does not seem necessary. Review Criteria The following review criteria are the basis for a decision on an application for a temporary use permit: (1) The temporary use or structure shall not cause unreasonable negative impacts to properties, residents, business or public uses in the vicinity, which cannot be mitigated through the imposition of conditions on such temporary use or structure, such negative impacts to consider include, but are not limited to: visual, noise, vibration, trash, hours of operation, traffic congestion, parking, safety, soil and vegetation disturbance, natural resource impacts and reasonable expectations of enjoyment of property based upon zone district designations and community planning documents; (2) Facilities and services (including sewage and waste disposal, water, gas, electricity, police and fire protection, roads and transportation, as applicable) will be available to serve the proposed temporary use or structure while maintaining adequate levels of service for existing development; M0SnowballTemporary Parking Lots February 7, 2012 PZC Meeting 2 (3) The temporary use shall comply with all applicable general and specific regulations of this Section, other Town ordinances, and state law unless otherwise expressly stated; (4) The applicant has demonstrated that he or she possesses the requisite skills and experience to ensure that the particular activity will be conducted in a safe and orderly manner; (5) The temporary use or structure is not of a nature that will become impractical to cease or remove over time; (6) Adequate plans or sureties are proposed to guarantee restoration of the property after the temporary use or structure ceases; (7) All temporary signs associated with the temporary use or structure shall be properly permitted pursuant to Chapter 15.28, Sign Code and removed when the activity ends or permit expires, whichever occurs first; (8) The temporary use or structure shall not violate any applicable conditions of approval that apply to a principal use on the site; (9) The temporary use regulations of this section do not exempt the applicant or operator from any other required permits, such as food service or building permits; (10) The temporary use or structure, including any associated parking and traffic circulation, shall not disturb sensitive or protected resources, including required buffers, 100 - year floodplains, and required landscaping and the applicant shall agree to restore all disturbed areas of the site to the condition that existed prior to the temporary use or structure; (11) Tents and other temporary structures shall be located so as not to interfere with the normal operations of any permanent use located on the property, shall be anchored, and meet the requirements of the building official, including fire rating; (12) Off-street parking shall be adequate to accommodate the proposed temporary use or an acceptable parking plan shall be approved with the temporary use or structure; (13) The temporary use will not result in excessive demands for police, ambulance, fire, or other essential public services which may negatively impact the capacity of existing public services to meet existing public service demands or the applicant agrees to mitigate the increased demands for public services; (14) The size, nature, or location of the temporary use or structure is not reasonably likely to cause a clear and present danger of injury to persons and property; (15) Another temporary use permit application has not been received prior in time or has already been approved for the same time and place requested by the applicant or so close in time and place to that required by the applicant that the issuance of both permits would cause undue traffic congestion; (16) The location of the temporary use or structure will not substantially interfere with any construction or maintenance work scheduled to take place upon Town streets; and (17) The temporary use or structure shall be for a duration which is appropriate considering the location, use, planned development and activities in the vicinity and impact on nearby properties; however, in no event shall a temporary use be granted for more than three (3) years. The South Rodeo Lot's light tower be coordinated with Public Works and Police Departments, and be moved to the southwest corner of the lot and angled to shine northwest onto the parking area; 2. The Applicant is proposing to replace the existing "Finnegan's Irish Wake" sign with a "Montana's Cantina and Grill" sign as well as repaint the existing dark blue wood siding and window trim with a golden yellow wood siding and dark brown window trim. The applicant has painted a portion of the south elevation and Staff is requesting that all Commissioners visit the site prior to the meeting to assess the color selection. Property Description The Property is 1.94 acres (84,506 square feet) with frontage on E. Beaver Creek Blvd and Beaver Creek Place on the northern property line and Benchmark Road on the southern property line. The Property is relatively flat and currently contains a commercial shopping center, with offices on the second floor and restaurants and retail stores on the main level. The surrounding uses are all commercial properties with Christy Sports to the south, Benchmark Plaza, with offices and restaurants to the west, and the Annex Building to the east. Planning Analysis As stated earlier in the report the applicant is proposing two separate applications, a Minor Design and Development Plan and a Sign Design. Due to the complimentary nature of the two requests, Staff is presenting the two proposals for a single review. The first request is a Minor Design and Development plan for a color change. The applicant is proposing to repaint the existing dark blue with "Bryant Gold" (Benjamin Moore HC -7). The proposed color has a Light Reflective Value (LRV) of 42.99, which is compliant with the design standards. The existing dark brown trim will remain as seen in Attachment B. The second request is for a Sign Design. The applicant is proposing to replace the existing "Finnegan's Wake" sign on the south side of the building with a "Montana's Cantina and Grill" sign. The sign will be constructed of metal dimensional letters with a copper sun logo. The proposed sign will contain two separate colors: BMSpectra Blue (PMS 319C) for "Montana's" and MAP metallic silver for "Cantina and Grill". The sign has a total area of approximately fifteen (15) square feet. The Benchmark Shopping Center signage is governed by a Master Sign Program. The sign program was approved in 1987 and amended in 1991. A portion of the amendment specifically applied to Cassidy's Hole in the Wall, which is the same space Montana's is occupying. The amendment required that the signage be constructed of routed wood or sandblasted with raised letters and limited to fifty-five (55) square feet for the main sign on the south side of the building. February 7, 2011 PZC Meeting The proposed sign complies with the sign program amendment, with the exception of its material. Section 15.28.080(16)(c) of the Avon Municipal Code allows the PZC to approve a sign that does not comply with a sign program, so long as written approval is granted by the owner or association. The association has provided written approval (Attachment D). In 2005, the PZC used this section of the code to approve the "Finnegan's Wake" sign on the south elevation. This sign also used metal dimensional letters, but did include a routed wood sign on the west elevation of the building. Review Criteria §7.16.080(f), Development Plan (1) Evidence of substantial compliance with the purpose of the Development Code as specified in §7.04.030, Purposes; (2) Evidence of substantial compliance with the §7.16.090, Design Review. (3) Consistency with the Avon Comprehensive Plan; (4) Consistency with any previously approved and not revoked subdivision plat, planned development, or any other precedent plan or land use approval for the property as applicable; (5) Compliance with all applicable development and design standards set forth in this Code, including but not limited to the provisions in Chapter 7.20, Zone Districts and Official Zoning Map, Chapter 7.24, Use Regulations, and Chapter 7.28, Development Standards; and (6) That the development can be adequately served by city services including but not limited to roads, water, wastewater, fire protection, and emergency medical services. §7.16.090(f), Design Review (1) The design relates the development to the character of the surrounding community; or, where redevelopment is anticipated, relates the development to the character of Avon as a whole; (2) The design meets the development and design standards established in this Development Code; and (3) The design reflects the long range goals and design criteria from the Avon Comprehensive Plan and other applicable, adopted plan documents. §15.28.070, Sign Design Review Criteria (1) The suitability of the improvement, including materials with which the sign is to be constructed and the site upon which it is to be located; (2) The nature of adjacent and neighboring improvements; (3) The quality of the materials to be utilized in any proposed improvement; (4) The visual impact of any proposed improvement, as viewed from any adjacent or neighboring property; (5) The objective that no improvement will be so similar or dissimilar to other signs in the vicinity that values, monetary or aesthetic, will be impaired; (6) Whether the type, height, size and/or quantity of signs generally complies with the sign code, and are appropriate for the project; and (7) Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether the sign is appropriate for the determined orientation. As you may or may not be aware, there is a Master Sign Program that governs the allowed signage on the Benchmark Shopping Center and this space in particular. The sign program for this space requires wood signs instead of the metal/copper ones that are proposed. Our Municipal Code allows the Planning and Zoning Commission (DRB) to approve signs not in conformance with the Master Sign Program, so long as they receive written evidence of approval from the Owners/Association. As the Association/Owners Rep, I was hoping that you could provide me with an email that states your approval of the sign, specifically the material difference. The approval pertained to both a Major Development Plan (MJD) and Alternative Equivalent Compliance (AEC) application. The AEC application was modified during the meeting to include a design that did not comply with the design standard requiring garage doors to be recessed from the front fagade of a residence. The PZC approved this modified AEC application with the condition that the garage doors be modified to use a brown color, similar to the representation on the colored renderings, instead of the proposed tan color. The PZC stated that this modification, along with the decks above the garages, mitigate the garage door from being the focal point of the residences and shall be construed as a porch. As seen in Attachment A, the applicant is requesting to remove the condition and use the same garage door colors as exhibited on Units 1-3 (Phase 1). The applicant has provided photographs of the garage doors for Phase 1. Staff is requesting that the PZC drive by the site prior to the meeting to look at the colors during the daylight and use the photographs as a reference during the meeting. Attached. A. At the P&Z mtg for Phase 2, the color of the garage doors was discussed, and the Board stated it would like to see a dark brown color used. Major Design and Development Wildstar Property Location: Lot 9, Block 5, Wildridge Subdivision 11015 W Wildwood Road Applicant. Michael Pukas, MPP Design Shop / Owner. WildAvon Enterprises Description: A development proposal for four (4) single-family residences accessed off a private court drive. The proposed residences will be approximately 2,700 to 2,800 square feet and primarily finished in stucco with wood siding accents. The proposed four (4) single- family residences will be located on the same lot and accessed off the same drive and the existing three (3) single-family residences. Discussion: Jared Barnes presented Staffs report and highlighted the site features and constraints with developing this phase of the project. Commissioner Prince asked why this would be a condominium type subdivision. Jared Barnes responded that the newly created lots would not meet minimum zoning standards. Jared Barnes went through the code requirements related to Landscaping and why the applicant is proposing an AEC application. Commissioner Prince asked if there have been cases where trees have been allowed in the snow storage easements. He also questioned the lack of landscaping to east of Buildings 5, 6, and 7. Commissioner Prince questioned if the guidelines specify a difference between permanent and drip irrigation. Jared Barnes responded that permanent irrigation is limited to 20% of the landscape area, and there is a specified time -frame (2 years) for temporary irrigation. Commissioner Green questioned how the new process works and what the options should the Commission act on this application. Jared Barnes explained that the options are the same as a Final Design Review. Michael Pukas explained the rationale behind the design of the structures as it relates to the current economy and product on the market. He went through the AEC requests and the building design and materials. The goal of the design was to have low maintenance buildings. He went through each building design. Commissioner Green asked how the design has changed with these buildings. Michael Pukas responded that the same materials were used wood siding and stucco, asphalt shingles. He also stated that the coloring helped tie the project together, Commissioner Losa questioned Building 4's site in the interim. Michael Pukas stated that Building 4 has been addressed on the grading and drainage plan. Michael Pukas stated that they intend to design and build Building 4. Commissioner Clancy stated he was okay with the AEC application for the separation because of the approval for Phase I. He also stated he foilows the logic on the AEC for the landscape units, and agrees that bicycle parking is more suited to a multi -family unit project. He also commented that the architecture is consistent with what we see in that neighborhood. Commissioner Prince is okay with the AEC application. Regarding landscaping, the east side needs additional landscaping and he recommends strategically placed trees on east edge. He did state that the proposed Landscaping has fruit bearing trees, those should be replaced with non -fruit bearing trees. He stated the design fits the overall theme of the existing three homes that are under construction. He did comment that Building 5 could use additional wood accents. 71Page Commissioner Minervini stated this is a terrific project given the current economy. He did comment that some screening on the East side of Buildings 5, 6, and 7 should be part of this application. Commissioner Struve commented if the approved 13' building separation worked for the first three Buildings then the proposedl4' is acceptable. He disagreed with Commissioners Prince and Minervini that trees should be added to the east of buildings 5, 6, and 7. He stated the lack of hillside stability on east side is a problem for plant material. He commented that the proposal includes lots of asphalt and it would be nice to have some of the proposed asphalt in Phase Il removed. Encourage the applicants to look at Building 1's use of materials as the builder mills beetle kill. He commented that should be looked at for these homes. Commissioner Losa commented on the AEC application. He was not finding a hardship with the proposed building separation. He preferred that Staff have the final decision on additional landscaping to the East side of Buildings 5, 6, and 7. He stated that Building 5's lack of wood seems awkward. He stated that Building 6's south elevation has an awkward step with materials. Commissioner Green likes the landscape plan's lack of sod and use of native materials. He stated that it is dangerous for the PZC to mandate trees on the backside of Buildings 5, 6, and 7. He stated that he takes no exceptions to three AEC applications. He does have concern with the architecture and colors. He stated that he agrees with the Building 5 materiality comments from the other commissioners. He likes the variation in housing types to add character of each unit. Michael Pukas commented that there is a type of crabapple tree that might not flower and that is what he is proposing. He also commented that planting on the East side of Buildings 5, 6, and 7 is prohibited by Staff. Michael Pukas brought additional AEC request, the garage fagade alteration, to the commission's attention in order to expedite the approval of this code variation for the 2' step back on all garage doors. A lengthy discussion ensued with regard to the intent of the garage door recess requirement and how it should be handled in the instance of this application. Action: Commissioner Clancy moved to approve the application with the three staff recommended conditions and the following conditions: 4. Final Design Gandorf Tract B Property Location: Tract B, Block 1, Wildridge Subdivision 12101 Saddle Ridge Loop Applicant: Phil Matsen /Owner. Gandorf Tract B LLC Description: A final design review of two duplexes. The duplexes will be designed in modern mountain architecture. One duplex will measure approximately 31 feet tall and each unit will be approximately 2200 square feet, while the other duplex will be approximately 25 feet tall and 1700 square feet. Discussion: Jared Barnes presented the staff report to the Commission, highlighting the history of the property and the PUD approval. The PUD approved slightly different development standards for each duplex, including height. Commissioner Anderson questioned if the 25% site coverage includes impervious and building coverage. Staff explained that the calculation only includes the building coverage. Commissioner Anderson asked if the 4:12 roof pitch was a °guideline" or a °requirement'. Jared Barnes explained that generally the "guidelines" require a 4:12 pitch, except for some secondary roof exceptions. Commissioner Anderson questioned if there was a civil site plan prepared. Jared Barnes mentioned that engineering reviewed the drawings and it was determined that a civil plan was not warranted for this design submittal. Commissioner Anderson asked if there was parking in front of the garages. Jared Barnes responded that the parking requirement was two spaces per unit. Some units have a two car garage in which case all of the required parking is covered, and the other units have a one car garage with surface parking in addition which meets the parking requirement. Commissioner Anderson explained that once a truck parks in front of the garage you will not be able to get to the side parking spots. He continued to discuss parking and felt that there will be difficulty pulling out of the spaces since there is no hammerhead to turnaround. Commissioner Anderson questioned if there was a swale in the back of westerly units. Phil Matsen responded that they are planning to sheet drain in a general direction away from the structures. Commissioner Anderson responded that the grades shown are heading towards the westerly unit in the back. Commissioner Anderson said that it looks like there is room for a swale in the back of this unit and he would suggest one. Commissioner Anderson felt that the 'similar but different' looks, was achieved with this submittal. Commissioner Struve would like to see the colors reconciled, and asked if the colors are similar to the project on Highway 6. His impression was that the colors seem dark. Additionally, the east building's south elevation has small windows towards center of the building that do not compliment the design. He commented that he likes the proposed light fixtures, but the glass needs to be addressed to ensure compliance. He suggested that the glass may be coated so that light does not show through. Commissioner Goulding commented on the proposed colors specifically the cement boards. He stated while they are individually earth tone colors, when the colors are put together it may be too much, especially for the confined lot size they are dealing with. Michael Pukas, Architect, decided to use the same cedar trim for all of the units, but wanted each unit to have some individuality to identify the units therefore the proposed colors. Michael Pukas agreed that this was a bold move, but they are comfortable with how this played out. Commissioner Struve asked if the four proposed cement board colors could be acceptable after an on-site mockup. Commissioner Patterson was trying to understand what the implications would be if the whole area started to turn to this type of color scheme. Michael Puckas stated that he was inspired by an area in Eagle Ranch where there is a cul-de-sac and there are four single family homes with varied color schemes and it worked very well. Phil Matsen explained that they are utilizing either masonry or concrete for the colored areas and in this way it will be a sharp appearance when painted. The Commissioners discussed whether or not if they stuck with two of the brighter colors that would be approvable and if they desired four colors then this should be reviewed on site. Commissioner Goulding commented on the landscape plan. He felt that the caliper should be varied, and that the taller 8' trees should possibly be scattered for a more established appearance. Commissioner Goulding asked Staff how irrigation and SFEs worked, and what the correlation was to landscaping. Justin Hildreth, Town Engineer, explained that irrigation assumptions were built into the water allocation. Commissioner Patterson asked if the landscaping might interfere with the site distance of the fire district vehicles. Justin Hildreth stated this was reviewed for potential interference and it was determined that the design was adequate for site distance. Action: Commissioner Anderson moved to approve with all the conditions from staffs report, with the exception of Condition #3. He also moved to add a condition that the grading is away from all sides of each building. This motion was discussed. Commissioner Struve added a condition that there will be a review by PZC via an on-site mockup of the proposed colors for the cement board area. Staff Report —1-70 Regional Transit Facility Work Session February 7, 2012 Planning & Zoning Commission Meeting Report date February 2, 2012 Project type New Commercial Construction Legal description Lot 1A, Swift Gulch Subdivision Zoning Public Facilities (PF) Address Prepared By 500 Swift Gulch Road Matt Pielsticker, Planner XP Summary of Requests The Town of Avon, represented by Mark Donaldson of Victor Mark Donaldson Architects and CDM Smith, has submitted three concurrent applications for the development of the 1-70 Regional Transportation Operations Facility on Lot 1A, Swift Gulch Subdivision, and Tract AA, Mountain Star Subdivision ("the Property"). The applications include a Major Development Plan, Alternative Equivalent Compliance (AEC) application, and a Comprehensive Plan Amendment application. The proposal is to move the existing office building, and construct a Bus Maintenance and Storage Building (aka "Bus Barn") and associated site improvements to be used as a regional transportation operations and maintenance facility. This project is 80 percent funded by federal and state grants, and is a partnership with ECO Transit of Eagle County. This agenda item will be discussed as a Work Session on February 7, 2012. A complete application will be presented at the February 21, 2012 meeting. Background The scope and function of this project was originally envisioned as early as 1995 with the construction of the existing Fleet Maintenance building, bus wash, and fueling island. Future plans at that time included a bus storage building and an administration building. In 2007, the master plan for Public Works development was updated as described in the "Facilities Needs Assessment" (RNL/MDG, 2007) and advanced further in the "Swift Gulch Project Preliminary Design Report" (CDM, 2008). The Facilities Needs Assessment and Preliminary Design Report recommended implementation of the following proposed site programming at full buildout: • Bus Wash Building (3,600 sf) • Bus Barn for 40 stalls (39,000 sf) • Administrative building (14,000 sf) • Underground parking garage (42 stall) • Surface Parking (64 stall) • PW shops storage (14,000 sf) • Large Equipment Storage Building (14,000 sf) • Total Paving (212,000 sf) Transit -related improvements at the site were eligible for numerous federal and state grant funds. The Town applied for Final Design Approval in 2009 to match pending grant applications submitted by the Town at that time and to position the Town to be `shovel ready' per grant requirements. In July, 2009, the Planning and Zoning Commission (PZC) approved a Final Design application for a portion of the construction recommended in the 2007 and 2008 reports (See attached 2009 Drawings — Exhibit A). The 2009 approval included a 40 stall bus barn, driveway behind the fleet building, 16 outdoor storage spaces for buses on the upper bench with associated grading, excavation, and infrastructure, and a transit administration building. The 2009 design approval 1-70 Regional Transportation Facility AVON February 7, 2012 PZC Meeting stipulated that the building have a sloped roof, rather than matching the flat roof on the existing fleet building, and the architecture follow a mountain contemporary style. There are numerous changes to the project scope relative to what the PZC approved in 2009. The changes are a result of shrinking the project to meet actual awarded grant funds from the Federal Transit Administration and Colorado Department of Transportation, along with local match funds from the Town of Avon Capital Improvements Program. The changes include: • Downsizing the bus maintenance and storage building from 40 stalls to 24 stalls; • Removal of the 16 outdoor bus parking spaces and the associated excavation and grading on the upper bench; • Keeping the existing upper bench access at its current location, thereby eliminating the associated grading, excavation and retaining walls. Elimination of the driveway behind the fleet building; • Removal of the transit administration building; and, • Addition of a mezzanine to the bus storage building for transit administration offices. On January 24, 2012, the Town Council directed Staff to accommodate the existing modular office building on-site by placing it where the cinder pile is located (as opposed to moving it to Lot 5, Village at Avon). In order to do this, 19 additional parking spaces will also be required and the cinder pile will be moved approximately 250 linear feet to the north. The design team has been working on a revised design since receiving this direction at the January 24, 2012 Council meeting and a draft is attached (Pages 28 & 29 of Exhibit A). Process After reviewing the attached materials during the Work Session, a complete application will be presented to the Planning and Zoning Commission on February 21, 2011. Chapter 7.16 of the Avon Development Code (ADC) regulates the Development Review Procedures for all new construction in the Town. The PZC will make the final decision on the Major Development Plan and AEC applications. The PZC will review the Comprehensive Plan Amendment application and provide a recommendation to the Town Council after conducting a public hearing. The Town Council shall render the final decision the Comprehensive Plan amendment. Site & Building Design The Property is the combination of three different parcels of land: Lot 1A (9.96 acres), Lot 1B (4.19 acres), and Tract AA (9.71). The Property is zoned Public Facilities (PF). Lot 1A is currently developed with several bus and passenger vehicle parking spaces, a 4,900 sf. office building occupied by the Transit and Public Works divisions, and a fuel station. The fleet maintenance building is located on the adjacent Lot 1 B, and contains approximately 2,000 sf. of office space, in addition to several full-service vehicle bays, shop areas, and mezzanine storage, totaling approximately 23,800 sq. ft. total. Tract AA is currently being used for cinder storage and long term storage for plow trucks, other vehicles, bulk materials, and miscellaneous yard storage. 1-70 Regional Transportation Facility - February 7, 2012 PZC Meeting 2 The Property is located at the mouth of Swift Gulch, a naturally occurring V-shaped valley with a drainage gully. The site is defined by the dry creek bed on the western edge of the current (and proposed) improvements. This drainage area will be improved in response to the drainage studies that were performed last year to increase conveyance capacity. The Bus Barn is being positioned in the middle of the asphalt parking area on Lot 1A for maximum functionality and vehicle circulation without impacting existing operations at the adjacent Fleet Maintenance facility. Please refer to Exhibit A (Sheet 15 of 29) to better understand the auto -turn analysis that was completed for full-size buses using the site. Staff and public parking spaces are provided at the perimeter of the property, similar to the current configuration, and in a separated surface parking lot on the north end of the site on Tract AA. The parking arrangement minimizes conflict with bus traffic circulating the Bus Barn. Also included in the project is the relocation of the modular office building to the north end of Lot 1A and construction of associated employee parking. Utilizing the existing benches in the hillside above this parking area will be temporary bus parking stalls, new cinder storage, and overflow parking area. Additional site modifications include the removal of a portion of the MSE retaining wall system below the fleet building adjacent to Swift Gulch Road on the south side of the Property, and additional landscaping stretching the length of the Swift Gulch tiered retaining walls. Finally, a new fuel canopy will be installed north of the current fueling island location. The building materials for the Bus Barn are durable, high quality, and low maintenance. The exterior materials include: stone panel system to form the base, pre -finished RPR Metal wall panel system for the majority of the exterior, stucco, ornamental steel roof support brackets and outriggers, standing seam roof system, and aluminum window system. The color board will be presented at the meeting. The attached drawings are the result of a coordinated design effort that has been reshaped by available grant funding, extensive value engineering, recent direction from Town Council for keeping the modular on the property, and design feedback from previous hearings with the PZC and the Council. AnU 1-70 Regional Transportation Facility 5 February 7, 2012 PZC Meeting Alternative Equivalent Compliance (§7.16.120) As submitted, and as noted above in Tables 1-3, the design of the Project conflicts with some of the applicable review Standards. Below is a list of the standards that require the processing of an AEC application. The first one relates to a site design principle, while the latter three relate to conflicts with architectural standards for "non-residential" development. §7.28.090(F)Q)(iii) Parking. Parking shall be located behind buildings, underground or at the interior of the lot. Surface parking areas are prohibited between the front fagade of the building and the street. §7.28.090(0)(4)(iii) Compatible Design. All buildings within a development, including freestanding and accessory buildings, shall be organized around an architectural theme in terms of the character, materials, texture, color and scale of buildings... Architectural features which create compatible design include: (1) Overhangs, (2) Canopies, etc. �7.28.090(i)(4)(v)(B) Scale and Massing. Buildings greater than thirty (30) feet in height shall be designed to reduce apparent mass and visually anchor the building to the site by including a clearly identifiable base, body and top, with horizontal elements separating these components. &7.28.090(0)(4)(ix)(B) Roofs. All primary roofs and secondary roofs shall have pitches of no less than four -to -twelve (4:12) This AEC application must be reviewed concurrently with the Development Plan application. The PZC may approve the alternative design if they find that the proposed alternative meets the review criteria listed below. It is important to consider the context of this municipal use which is isolated, and in some ways designed to limit public access. This Property is intended to serve as "back -of - house" for various Town and regional transportation -related operations (i.e. snow maintenance vehicles, repair, and storage). Pursuant to §7.16.120(d), Alternative Equivalent Compliance Review Criteria, the following criteria must be considered when considering the merits of this design plan: (1) The proposed alternative achieves the intent of the subject design or development standard to the same or better degree than the subject standard; (2) The proposed alternative achieves the goals and policies of the Avon Comprehensive Plan to the same or better degree than the subject standard; (3) The proposed alternative results in benefits to the community that are equivalent to or better than compliance with the subject standard; and (4) The proposed alternative imposes no greater impacts on adjacent properties than would occur through compliance with the specific requirements of this ordinance. Responses to the AEC criteria demonstrating how the design improves upon the code requirements are included in Exhibit B. Avon Comprehensive Plan Amendment Background The Property was originally designated as a Specially Planned Area (SPA), the predecessor to what is now referred to as Planned Unit Development (PUD) zoning. PUD zoning was established for the Property in 1994 (Ord. 1994-19). The PUD defined allowable uses (e.g. Mechanical Equipment Storage, Transit Storage, Offices, CDL Training Course, etc.) and also set forth the AvONV1-70 Regional Transportation Facility 6 February 7, 2012 PZC Meeting typical development standards such as setbacks, site coverage, and height. The allowable height was set at 48'. The most recent amendment to the subject PUD was in 1998, whereby a new site plan and development standards were established. In 2008, the Town processed a rezoning application to change from PUD to Government, Park, and Employee Housing (GPEH). One of the driving forces behind the 2008 rezoning application was to permit the construction of employee housing as a use by right, which the then -current PUD did not contemplate. The GPEH zone district also increased the building height to 60'. Between gaining design approval in July 2009 for the previous bus barn plans and the most recent design effort, the Town adopted the Avon Development Code (ADC) and subsequently rezoned the Swift Gulch property to Public Facilities (PF). The height was inadvertently lowered to 40' when the ADC was approved, and the new Zoning Map changed the zoning of the property. Conflicts with ADC At the January 24, 2012 Town Council Meeting, this project was discussed and the conflict with the PF district's allowable height was highlighted by Staff. The PF zone district is intended to provide sites for public uses such as community centers, police and fire stations, and governmental facilities. The uses permitted in this district are identified by location in the Avon Comprehensive Plan. The Swift Gulch property is identified in the Avon Comprehensive Plan as the site for the Town's Public Works and Transportation Departments (Avon Comprehensive Plan (2006), Swift Gulch District 26 Planning Principles). The planning principles for the future development of the property do not provide specific details concerning the size, scale or dimensions for future facilities on the property. Unless otherwise set forth in the Comprehensive Plan, the PF zone district dimensional requirements will apply to the Swift Gulch project (AMC, Sec. 7.20-080(e)), Public Facilities). The proposed design of the Swift Gulch facility complies with the lot width, lot coverage, and setback requirements of the PF zone district. The maximum building height of the project is 51 ft. The maximum building height permitted in the PF zone district is 40 feet. The proposed Comprehensive Plan amendment (Exhibit C) language will address the long term vision of the Swift Gulch property and allow for the currently designed 51' tall Bus Barn. AvONy1-70 Regional Transportation Facility 7 February 7, 2012 PZC Meeting The PZC must review the attached amendment and determine if it complies with the review criteria set for in §7.16.030(c), Comprehensive Plan Amendment, ADC; and listed below: (1) The surrounding area is compatible with the land use proposed in the plan amendment or the proposed land use provides an essential public benefit and other locations are not feasible or practical; (2) Transportation services and infrastructure have adequate current capacity, or planned capacity, to serve potential traffic demands of the land use proposed in the plan amendment; (3) Public services and facilities have adequate current capacity, or planned capacity, to serve the land use proposed in the plan amendment, (4) The proposed land use in the plan amendment will result in a better location or form of development for the Town, even if the current plan designation is still considered appropriate; (5) Strict adherence to the current plan would result in a situation neither intended nor in keeping with other key elements and policies of the plan; (6) The proposed plan amendment will promote the purposes stated in this Development Code; and, (7) The proposed plan amendment will promote the health, safety or welfare of the Avon Community and will be consistent with the general goals and policies of the Avon Comprehensive Plan. Recommendation Staff is recommending that the PZC conduct a Work proposed Bus Barn as it relates to the Design Standards. Comprehensive Plan Amendment is also being sought February 21, 2012. The nature of this Municipal Use within such an isolated site with limited public access. This Municipal Use is traditionally a town's "back -of -house" for many forms of street, public way and pedestrian way maintenance, storage, repair and operations. 2. The nature of the industrial activities of cinder storage, crushing and distribution, Truck, Snow Plow and Public Bus ingress, egress, turning radii, maintenance, limited fuel dispensing and frequent large vehicle movements. 3. The conformance conflicts between existing development (now zoned "Public Facilities" but previously zoned GPEH and PUD sequentially) on this site with the newly adopted ADC; 4. The apparent aesthetic concerns by Town Council, Planning & Zoning Commission and Town Staff related to design, roof forms and architecture of the existing Fleet Maintenance Facility, by which create conformance conflicts among various portions of the ADC. Exhibit B §7.28.090(j)(3)(iii) Parking. Parking shall be located behind buildings, underground or at the interior of the lot. Surface parking areas are prohibited between the front fagade of the building and the street. Response: Some parking exists today between front facades of buildings and the street; our proposal simply minimizes those with the strategic placement of the proposed structure, thereby improving the existing non-conformance. §7.28.090(j)(4)(iii) Compatible Design. All buildings within a development, including freestanding and accessory buildings, shall be organized around an architectural theme in terms of the character, materials, texture, color and scale of buildings... Architectural features which create compatible design include: (1) Overhangs, (2) Canopies, etc. Response: It is the intention of this proposal to create that "organization around an architectural theme" with our primary building while acknowledging pre-existing, non- conforming structures that must remain. This is due to site programming, ongoing and improved function, substantial capital investments previously made and the Federal Funding requirements connected with this proposal. This design includes differing architectural elements and is of substantial size to dominate the site organization while increasing conformity to current design requirements. §7.28.090(j)(4)(v)(B) Scale and Massing. Buildings greater than thirty (30) feet in height shall be designed to reduce apparent mass and visually anchor the building to the site by including a clearly identifiable base, body and top, with horizontal elements separating these components. Response: The accompanying Comprehensive Plan Amendment Application is intended to adjudicate the reduction of 20' in allowed building height which occurred inadvertently during the most recent adoption of the Avon Development Code. This design includes forms that reduce apparent massing, visually anchors the building to the site with a stone/masonry base supporting the body with varying elements to separate and appropriately marry the components into logical forms for such industrial uses. §7.28.090(j)(4)(ix)(B) Roofs. All primary roofs and secondary roofs shall have pitches of no less than four - to -twelve (4:12). Response: Efforts to reduce massing are limited by interior program function and future interior expansion. Our roof pitches do not conform specifically as any increase above 3:12 will simply add volume and mass, without providing any functional benefit; likewise, ongoing utility costs would increase incrementally. To do so would breach reasonable building heights and disallow effective clerestory/day lighting effects reducing lighting loads and power consumption. Resorting to flat roofs would further increase non-compliance and recreate architecture already apparently not considered appropriate by Town Council, Planning & Zoning Commission and Town Staff. Inasmuch as snow plowing operations are a primary service performed by vehicles residing within this site, the removal of resulting roof snow discharge will be readily managed. END RESPONSE.
