PZC Minutes 081313EART of the VALLEY Town of Avon Planning & Zoning Commission SPECIAL MEETING Tuesday, August 13, 2013 Office of Community Development Avon Municipal Building — 2nd Floor / One Lake Street Meetings are open to the public Draft Minutes I. Call to Order (4:00pm) The meeting was called to order at 4:03 pm. 11. Roll Call Commissioners Minervini, Clancy, Struve, and Prince were present at the meeting. Commissioners Losa and Bonidy attended via conference call and Commissioner Hardy was not present. III. Additions & Amendments to the Agenda There were no additions or amendments to the agenda. IV. Conflicts of Interest There were no conflicts of interest to disclose. V. Minor Design & Development Plan / Alternative Equivalent Compliance Property Location: Lots 21, 65-B, and Tract Q, Block 2, Benchmark at Beaver Creek Subdivision Property Address: 182 Avon Road, 142 Beaver Creek Place, and 83 Benchmark Road Applicant: Greg Hoffmann, Benchmark Investors, LLC Description: The applicant is proposing a color change for the Christie Sports building, Benchmark Shopping Center, and the Annex building. The colors will be a mix of earth - tones with red and brown hues, but also include a white hue that exceeds the Town's codified Light Reflective Value (LRV) maximum. Part of the application is requesting an Alternative Equivalent Compliance (AEC) approval for "Monterey White", which exceeds the LRV value of 60. These applications were partially approved on Tuesday, August 6, 2013, and continued in order for paint samples to be applied to the building. Discussion: Jared Barnes briefly overviewed the modifications and actions that have occurred since the last meeting. He highlighted the potential actions by the PZC. Commissioner Struve asked how the AEC request would apply to the other options for the "Monterey White" color. Jared Barnes responded that all of the options exceeded the LRV requirement and would need an AEC approval. Mark Zbrzeznj, NAI Mountain, representing Benchmark Investors LLC, discussed to color options and notified the PZC that the "Monterey White color was still the preferred color by the property owners. Bryan Crossley, NAI Mountain, also discussed the colors and further explained how the picture was taken while the colors hadn't dried therefore the appeared darker and shinier than what exists on the property. Commissioner dialogue ensued regarding the colors with each Commissioner discussing their preference. I I P a e Commissioners Prince and Losa both stated that the "Monterey White" color was too bright and there was not proper justification to approve the AEC request. Commissioner Prince suggested that the "Manchester Tan" color was much closer to the LRV maximum and was only nominally above that number therefore he could support that color. Commissioners Bonidy stated he was comfortable with all of the colors and would support the decision of the remaining members of the PZC. Commissioners Minervini and Struve echoed the comments by Commissioners Prince and Losa that a willingness to repaint did not warrant approval for non -conforming paint and/or colors. Commissioner Minervini further stated that CubeSmart and Walgreens were cited as applicants who were initially rejected and only approved after compliance in this area. Commissioner Clancy reiterated his hesitation with the LRV of the "Monterey White" color. He also commented that his original perception of the "Buckingham Garden" color was not favorable, but after seeing it on the building, he felt it would be a good accent color. Action: Commissioner Prince moved to approve the Minor Design and Development Plan and Alternative Equivalent Compliance applications for the Benchmark Shopping Center and Annex buildings with the following conditions: 1. The Christy Sports Building is approved as proposed; 2. The Benchmark Shopping Center is approved as proposed; and, 3. The Annex building colors were approved as follows: a. "Buckingham Gardens" was approved as proposed as an accent color; b. "Branchport Brown" was approved as proposed as a roof color; and, c. "Monterey White" was not approved, but "Manchester Tan" was approved as a base color. And with the following findings: 1. The LRV for "Manchester Tan" was nominally outside the Design Standards; 2. The Annex building is a one story building and there will be minimal visual impact as compared to a taller building; 3. "Manchester Tan" is substantially similar to what exists on the building today; 4. "Monterey White" was approved on the soffits of the Benchmark Shopping Center as it was limited to the ceiling of the walkways and will have limited application. 2nd motion, seconded by Struve.
