Applicant: Saltwater Cowboy, LLC d/b/a Saltwater Cowboy Address: 48 E. Beaver Creek Blvd., Suite 105 Manager: Stephen W. Bullock Type of License: Hotel and Restaurant Liquor License 4. ADJOURNMENT AT 5:25 PM Avon Council Meeting. 08.12.09 Page 3 of 5 TOWN OF AVON, COLORADO MINUTES OF THE LOCAL LIQUOR LICENSING AUTHORITY MEETING HELD DECEMBER 9, 2008 The Avon Town Council acting as the Local Liquor Licensing Authority for the Town of Avon, Colorado convened at 4:45 PM at the Avon Municipal Building, One Lake Street, Avon, Colorado. A roll call was taken and Board members of the Authority present were Ron Wolfe as Chairperson, and Board members Rich Carroll, Dave Dantas, Kristi Ferraro, Amy Phillips, Buz Reynolds, and Brian Sipes. 3. PUBLIC HEARING FOR SPECIAL EVENTS PERMIT Applicant: Vail Junior Hockey Association Trade Name Vail Eagle Hockey Event Manager: Andy Clark Event Name: Rocky Mountain Pond Hockey Tournament January 2009 Event Location: Harry A. Nottingham Park Event Dates: January 24, and January 25, 2009 from 10 am until 4 pm The Town Clerk noted that all materials were in order on the application. Event Manager Andy Clark was present to highlight the event to be held on two separate weekends in January. The special event permits were requested for January 24th and 25th. The diagram of the proposed license premises was reviewed. With no further questions from the Authority, Chairman Wolfe opened the public hearing, no comments were made and the hearing was closed. Board Member Phillips moved to approve the special event permit for Vail Junior Hockey Association Trade Name Vail Eagle Hockey; Board member Sipes seconded the motion and it passed unanimously. PUBLIC HEARING FOR NEW LIQUOR LICENSE APPLICATION a. Applicant: Saltwater Cowboy, LLC d/b/a Saltwater Cowboy Address: 48 E. Beaver Creek Blvd., Suite 105 Manager: Stephen W. Bullock Type of License: Hotel and Restaurant Liquor License Mayor Wolfe presented the application for Saltwater Cowboy as continued from the December 2, 2008 meeting per a request from the applicant. At that meeting, Stephen Bullock requested that he be able to submit additional court documents that were to be sent from Florida related to his background history. Town Attorney Eric Heil reviewed the statute guidelines related to the background history for applicants. Detective Paul Arnold and Police Chief Brian Kozak were present to address the revised police report which addressed the additional court materials submitted by the applicant. Several questions were asked by Authority members to the applicant about the drug and alcohol incidents that showed on the background investigation. Mr. Bullock addressed each of them in detail, stating that he moved to Colorado to start over and leave the past behind. Chairman Wolfe opened the public hearing asking for comments; the following people spoke in support of Stephen Bullock's character: ♦ Michael Campbell, former colleague at the Ore House and insurance agent ♦ Kevin Hart, former colleague at the Ore House and friend over the years Board member Phillips moved to approve the new hotel and restaurant liquor license application for Saltwater Cowboy, LLC d/b/a Saltwater Cowboy; Board member Ferraro seconded the motion and it passed unanimously. There was some discussion about whether or not a change in moral character or criminal act unrelated to the operation of a license premise could be considered by the liquor authority as a reason for future suspension or revocation of the liquor license. Attorney Eric Heil noted that he would further research the question and follow up with an answer to the Liquor Authority. CONSENT AGENDA Board member Ferraro moved to approve the consent agenda; Board member Phillips seconded the motion and it passed unanimously. a.
