TO: Cultural, Arts & Special Events Committee Planning and Zoning Commission FROM: Max Morgan, Town Planner RE: Multi -use Skate Plaza Project Review — Work Session Avon DATE: October 31, 2023 C O L O R A D O STAFF REPORT OVERVIEW: This report is intended to advise the Cultural, Arts & Special Events Committee ("CASE"), and the Planning & Zoning Commission ("PZC") on the proposed multi -use skate plaza concept in Harry A. Nottingham Park ("Park"). A joint -committee work session will be held on November 7, 2023 with PZC and CASE. Staff is soliciting feedback on the design, look, use, and overall development of the space. Following the November 7 work session, feedback from CASE and PZC will be added to a report and provided to Avon Town Council prior to the November 14, 2023 Avon Town Council ("Council") meeting. INTRODUCTION: In June 2023, Town Council directed Staff to contract with Zehren & Associates ("Zehren"), in addition to a third -party skateboard design firm, to pursue the conceptual design for a multi- use plaza that includes areas intended for skateboarding and other wheel -based activities. In September 2023, Staff, Zehren, members of the Avon Skate Coalition ("ASC") and New Line Skateparks started the process of conceptual design for the project (ATTACHMENT A — New Line Skate Plaza Concept), now intended for review by CASE and PZC. The purpose of CASE and PZC review is to provide recommendations to Council for their November 14, 2023 review, and final direction on whether to pursue the concept or an iteration of the concept. BACKGROUND: In 2022, the ASC received an initial $25,000 grant from the Colorado Health Foundation to conduct a public engagement process related to a potential skatepark in the Town. Simultaneously, the Town began planning for La Zona, a multifaceted redevelopment project intended to improve the Pedestrian Mall and overall connectivity to the Park, enhance the Avon Rec Center, and consider modifications to areas in and around the Park. As a result of the potential compatibility of the two initiatives, the Town decided to support the skatepark project and participate in the public engagement process for skatepark planning conducted by the ASC. During spring 2023, ASC along with Staff completed the public engagement process in the form of a public meeting series. Through these meetings, the ASC and Staff confirmed that diversity, equity, social justice, personal wellness, and inclusion could all be promoted through a well-designed, effectively sited multi -use plaza with features designed for skateboarding. Staff also recognized that a skate plaza - concept represents a potential space for a variety of users with considerations for functionality, seasonality, and alternative -abilities applied throughout, where several Goals & Policies in the Avon Comprehensive Plan (2017) could be achieved. Y Yr •� h r' Figure 1 - Old Fire Station / Skate Plaza Diagram The La Zona plans initially indicated 351 Benchmark Road, locally known as the "Old Fire Station," — as the preferred site for the skate plaza project. This 16,000 square foot property in a Town -owned parcel where a now -vacant fire station, sits adjacent to the Avon Public Library and Rec Center, as well as public transportation amenities and facilities, including the nearby Avon Transit Center (Figure 1). After a series of work sessions with PZC and Council, the Town ultimately elected to pursue the project at 1 Lake Street, the "Old Town Half' site, and applied the new concept to a previous proposal for redevelopment in the Park from 2021 (ATTACHMENT B — 2021 Park Redevelopment Proposal Staff Report). Staff researched the impacts of plaza spaces and multi -use spaces, including interviews with planners and recreation directors in Colorado, to assess these essential questions. Research conducted by Staff concluded that: • Skateparks and skate plazas are well -represented in larger parks in Colorado mountain towns including: Alma, Aspen, Breckenridge, Carbondale, Cortez, Edwards, Frisco, Gunnison, Leadville, Manitou Springs, Ouray, Ridgway, Salida, Snowmass Village, Telluride. • The relationship between skateboard -oriented space and a larger park host -site represents a win- win scenario related to safety and space -activation. • The east section of Harry A. Nottingham Park is likely not at risk of "over -programming" as it lacks many amenities commonly found in large parks across the state, or those existing amenities in the Park are located a significant distance from the proposed skate plaza site. • Skateparks and skate plazas can be designed so that they can be closed during events, specifically concerts, without issue, or alternatively host events. In September 2023, Staff hired New Line Skateparks to develop a conceptual design for the project. The initial concept is ready for review from the CASE and PZC, and is included with this report. WHEREAS The ASC is serving as the community driven entity in partnership with the Education Foundation of Eagle County ("EFEC"), a registered 501(c)(3) organization located in Eagle County, Colorado, and outlines the terms and conditions of the agreement between parties. WHEREAS The TOWN grants permission to the ASC to support and facilitate the planning, design, and potential construction of the proposed skateboard plaza ("PLAZA") at 1 Lake Street or such other location as determined appropriate by the Town ("SITE"); and WHEREAS The TOWN and the ASC are co-partners in the project to plan, design, construct, and maintain the proposed PLAZA; and WHEREAS The TOWN, EFEC, and ASC contributed to an equity -centered public engagement process to connect members of the skateboard community as well as individuals who self -identify as a representative of at least one of several unique communities including Black f Indigenous 1 Person of Color ("BIPOC"), Lesbian 1 Gay I Bisexual I Transgender 1 Queer ("LGBTQ"), Female, 55 years of age or older, Having a learning disability or Having an altemative physical disability TERMS & CONDITIONS: The parties agree to the terms and conditions listed below: 1. The term of the Agreement is July 1, 2023 ending on December 31, 2030. 2. The TOWN remains the owner of the SITE and related PLAZA 3. The ASC shall follow procedures required by the Avon Municipal Code related to planning and construction of the SITE and related PLAZA. 4. The ASC shall follow procedures required by the Avon Municipal Code related to events and special uses of the SITE and related PLAZA 5. The TOWN grants permission to the ASC to visit the SITE prior to and during planning, construction, and maintenance of the SITE for purposes related to planning, and potential construction of the SITE and related PLAZA. 6. (1) Evidence of substantial compliance with the purpose of the Development Code; (2) Consistency with the Avon Comprehensive Plan; (3) Physical suitability of the land for the proposed development or subdivision; (4) Compatibility with surrounding land uses; (5) Whether the proposed rezoning is justified by changed or changing conditions in the character of the area proposed to be rezoned; (6) Whether there are adequate facilities available to serve development for the type and scope suggested by the proposed zone compared to the existing zoning, while maintaining adequate levels of service to existing development; (7) Whether the rezoning is consistent with the stated purpose of the proposed zoning district; (8) That, compared to the existing zoning, the rezoning is not likely to result in adverse impacts upon the natural environment, including air, water, noise, stormwater management, wildlife and vegetation, or such impacts will be substantially mitigated; (9) That, compared to the existing zoning, the rezoning is not likely to result in significant adverse impacts upon other property in the vicinity of the subject tract; (10) For rezoning within an existing PUD, consistency with the relevant PUD Master Plan as reflected in the approval of the applicable PUD; and (11) Adequate mitigation is required for rezoning applications which result in greater intensity of land use or increased demands on public facilities and infrastructure. Conformance with General Review Criteria in AMC §7.16.010(f)(1), General Criteria, which provides criteria that are applicable to all development applications: (1) Review Criteria. The reviewing authority shall be Director when the Director has the authority to administratively approve a development application. The reviewing authority shall be the PZC and/or Town Council for all development applications which are subject to public hearing. The reviewing authority shall review development applications for compliance with all relevant standards and criteria as set forth in the specific procedures for the particular application in this Development Code, as well as the following general criteria which shall apply to all development applications: (i) The development application is complete; (ii) The development application provides sufficient information to allow the reviewing authority to determine that the development application complies with the relevant review criteria; (iii) The development application complies with the goals and policies of the Avon Comprehensive Plan; and (iv) The demand for public services or infrastructure exceeding current capacity is mitigated by the development application.
