RESOLUTION NO.23-12
APPOINTING THE TOWN CLERK AS THE DESIGNATED ELECTION OFFICIAL,
AND DELEGATING THE AUTHORITY AND RESPONSIBILITY OF APPOINTING
ELECTION JUDGES FOR THE TOWN OF AVON'S SPECIAL ELECTION ON
AUGUST 29, 2023
WHEREAS, pursuant to the requirements of the Town of Avon Charter, a special municipal
election is to be conducted on August 29, 2023; and
WHEREAS, the governing body of any political subdivision may determine that an election may
be held by mail ballot; and
WHEREAS, the Town Council wishes to appoint the Town of Avon Town Clerk as the
Designated Election Official; and
WHEREAS, the election official of the Town of Avon has recommended that the Town Council
authorize a mail ballot election for the August 29, 2023, special municipal election.
NOW THEREFORE, THE TOWN COUNCIL, HEREBY RESOLVES the following:
Section 1 Registered voters shall have the opportunity to cast ballots in person as provided
by the Mail Ballot Election Act, C.R.S. § 1-7.5-101 etseq., at a polling place located in the Town's
Clerk's office at Town Hall, 100 Mikaela Way, Avon, Colorado.
Section 2 The authority and responsibility for appointing the election judges for this special
municipal election is hereby delegated to the Town Clerk, pursuant to Section 31-10-401 C.R.S.,
as amended.
Section 3 The ballots shall be paper ballots and recorded by sworn election judges.
Section 4 If any clause, sentence, paragraph or part of this Resolution or the application
thereof to any person or circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect the remaining provisions of this Resol
