The Final Design Plan complies with the approved PUD guide as well as the criteria as outlined by the Design Review Guidelines. No Commissioner questions for staff. Patrick C. Art in Public Places Resolution 02-15 Staff briefly discussed the issue and recommended approval of the resolution. Commissioner Him would like an appreciation note to be included to the Arts Council. Commissioner Smith would like the potential future public art locations deleted add that future public art locations shall be formally approved by Council and Staff. Staff clarified that some forms of artwork do impede the vision at the roundabouts and that staff is interested in a review of the type of artwork in the roundabouts when they come up for rotation. Commissioner Smith makes a motion to approve Art in Public Places, Resolution 02-15 with modifications to the 2nd paragraph and a modification to the `future art work approval' language as recommended by the Commission. Staff read the revised resolution to the Commission, and Commissioner Karow seconded the motion. Motion carries unanimously. XIII. Adjourn Commissioner Him made a motion to adjourn, with Commissioner Smith seconding. The motion is approved unanimously. The meeting was adjourned at 7:10 PM. Call to Order The meeting was called to order at 6:00 pm. II. Swear in New Planning & Zoning Commission Member Buzz Didier was sworn in by Patty McKenny, Town Clerk, Town of Avon. III. Roll Call All current Commissioners were present with the exception of Commissioner Macik. IV. Additions and Amendments to the Agenda There is one amendment to the agenda. Pedro Campos of Design Workshop is unable to attend due to time restraints in a previous meeting; therefore, Item E under Other Business will be rescheduled for another meeting. V. Conflicts of Interest There were no conflicts of interest. VI. Consent Agenda The Meeting Minutes from the December 3, 2002 Planning & Zoning Commission were approved unanimously. Commissioner Karow motions for approval and Commissioner Smith seconds the motion. The motion passes unanimously. VII. Planned Unit Development Amendment (PUBLIC HEARING) A. Resolution 03-01 Lot 61, Avon Center at Beaver Creek Subdivision Project Type: PUD Extension Request Applicant: Michael Hazard Staff made a brief presentation of the file. The applicant, IDG3 represented by Michael Hazard, is requesting a second extension amendment for the Lot 61 PUD approved in 1999. The request is for a 12 -month extension, however, staff is recommending a 6 -month extension. The original extension was granted in order for the applicant to explore development opportunities related to the Town Center Plan. The transportation hub and road abandonment are the major concerns, and the applicant is seeking yet additional time to resolve these issues to come to a workable PUD plan without expiring the existing PUD development rights. A two-page letter to the Commission was distributed by Mr. Hazard; however, this letter was not presented or reviewed by Staff prior to this meeting. The letter requested an 18 -month extension and recommended conditions to this approval from the applicant. Chairman Evans asked Mr. Hazard why the extension would be beneficial since the last extension did not begin any processes and did not result in any dialogue with the Town regarding a revised PUD plan. Mr. Hazard would like additional time to redirect his numbers to current data rather than 3 -year-old information contained in the original approval. The application was opened for public comment, and seeing as there was no comment, the public hearing portion of the meeting was closed. Commissioner McClinton questioned the 18 -month extension, and asked if a year would be necessary to make progress on the revised plan. The Commission deliberated on the length of the extension, noting that 12 -months appeared adequate at this time. They noted that regardless of the amount of time the original PUD was extended to allow for a revised PUD plan to comply with the adopted master plans of the Town at that time, including the Town Center Plan. Commissioner Didier made a motion to recommend approval of Resolution 03- 01, recommending that Town Council approve the Lot 61 PUD Amendment to extend the expiration deadline from February 3, 2003 to February 3, 2004 with the following conditions: 1. The Applicant must incorporate the terms and conditions of the Town Center Plan with the Lot 61 development plan; 2. No further extensions of the Lot 61 PUD will be considered; Commissioner Him seconds the motion. The motion passes unanimously. VIII. Master Sign Program Variance A. Chapel Square Sign Program Variance Tract B-2, Chapel Square PUD Sign: Vail Valley Trading & Loan Applicant: Timberline Management LLC Matt Pielsticker, planning technician, made a brief presentation. Greg Gastineau, the applicant, is requesting a variance to the Master Sign Program at Chapel Square. The program states that a tenant will be allowed to have only one identity sign and only one sign per entrance. The Master Sign program permits a total of four signs on the west elevation, one for each tenant under each archway. There are no signs on the east elevation. Vail Valley Trading and Loan (VVT&L) has a lease with Mr. Gastineau that entitles the business to two signs for this space, even though this requirement does not comply with the Chapel Square MSP. Mr. Gastineau is requesting a time specific variance for these two signs until October 31, 2003 to satisfy tenant's lease requirements. Minutes of P&Z Meeting January 7, 2003 Page 2 Staff recommends denial as the applicant is not deprived of privileges enjoyed by the other tenants in this vicinity and the Town is not subject to the terms and restrictions of the private lease arrangement with WT&L. The Commission deliberated on the variance criteria, and found no criteria that satisfied the 'hardship' requirements per the sign code. The Commission also stated the WT&L has already been granted a previous sign code amendment to place a larger sign, and were concerned with the issuance of additional sign code amendments for this tenant. Commissioner McClinton motions for denial and Commissioner Smith seconds the motion. The motion carries 5 to 1. IX. Zoning & Design Review Proposed Fees A. Proposed Revised Fee Schedule Resolution 03-02 In November, 2002, Planning and Zoning Commission approved a revised fee schedule which was presented by Staff in Resolution 02-13. Concerns were expressed regarding how fees were derived. Resolution 03-02 addresses these concerns and is consistent with the approach being used by Engineering to revise their Right of Way and Subdivision Review fees. All fee revisions will be reviewed by Town Council on January 14, 2003. Commissioner Karow suggests that Council include annual adjustments as tied to the relevant consumer price index. Commissioner Karow moves to approve Resolution 03-02 and Commissioner Him seconds the motion. Motion passes unanimously. X. Other Business A. Town of Avon Buck Creek Drainage Project Anne Martens, Assistant Town Engineer Dealing with drainage from 1-70 to Eagle River by use of a natural design as opposed to the California concrete design to handle the overflow of heavy storms. Final Design is anticipated in February 2003. This project is being done to in conformance with the Avon Town Center plan. B. Town Core Signage Project This project arose from the former Town Council and former Town Manager, Bill Efting. There are 10 signs which are half paid for at this time. This is signage that is proposed to be placed in the Town core. The signs are designed with a removable panel for updates as tenants change. Placement to occur in the spring in areas noted on the map shown to the Commission. Some are on private property. It is currently being revised due to tenant changes. Minutes of P&Z Meeting January 7, 2003 Page 3 Commissioner Karow addressed that this should be a merchants expense item and should be maintained at the expense of the merchants association and not the Town. Chairman Evans motions for the Avon Merchant Business Directory be redesigned to comply with Town design guidelines, be reviewed and approved by Planning and Zoning Commission, and solely funded by the Avon Merchants Association or other private entity and not public funds. Commissioner Karows seconds it. Motion passes unanimously. C. Planning & Zoning Schedule 2003 A meeting schedule for 2003 was distributed to the Commission. This year, no meetings are on a holiday. D. APA Membership The Town of Avon has been paying for each Commissioners membership with the American Planning Association. It is approximately $125 each. It is recommended that Staff remain members and the Commission drop its memberships in light of budget concerns. Staff will have all materials available for review by the Commission. Chairman Evans motions to stop paying membership to the American Planning Association for P & Z members with the exception of Staff. Commissioner Smith seconds the motion and the motion passes unanimously. E. Design Workshop Presentation on Convey, Collect, and Connect: Transportation Alternatives in the Colorado Rockies Pedro Campos, Design Workshop (Deleted from Agenda) — will be rescheduled. XIII. The applicant continues to seek more time to explore the opportunities related to the Town Center Plan without lapsing the currently approved PUD, which expires on February 3, 2003. During the first extension request, staff did not meet with the applicant and make any progress on revising the plans. The PUD regulations allow for this type of amendment, and the applicant is not proposing any new development standards or any variations from the originally approved PUD plan as adopted by Ordinance 99-16. The first PUD extension request for six months was approved by Town Council (Ordinance 02-17) on July 18, 2002 and will expire on February 3, 2003. PUD Design Criteria According to the Town of Avon Zoning Code, Section 17.20.110, the following shall be used as the principal criteria in evaluating a PUD. It shall be the burden of the applicant to demonstrate that submittal material and the proposed development plan comply with each of the following design criteria, or demonstrate that one or more of them is not applicable, or that a particular development solution is consistent with the public interest. 1. Conformance with the Town of Avon Comprehensive Plan's Goals and Objectives. The proposed amendment conforms to the Town Comprehensive Plan, and is being requested in order to explore further possibilities for conformance with the newly adopted Town Center Plan. 2. Conformity and compliance with the overall design theme of the town, the sub -area design recommendations and design guidelines of the Town. The proposed amendment to the PUD is a direct response to the recent adoption of the Town Center Plan. The applicant is attempting to explore new development opportunities as they relate to the design recommendations outlined in the Town Center Plan. The proposed amendment to the PUD is a direct response to the recent adoption of the Town Center Plan. The applicant is attempting to explore new development opportunities as they relate to the design recommendations prior to submitting for final design approval. 4. Uses, activity, and density provide a compatible, efficient, and workable relationship with surrounding uses and activity. The PUD Amendment proposed will not vary the density, uses, or activities approved on the site through Ordinance 99-16. The extension of the PUD for another 6 months will allow the applicant to explore opportunities to create a more efficient and workable relationship of the property and surrounding properties as recommended in the Town Center Plan. 5. Identification and mitigation or avoidance of natural and/or geologic hazards that affect the property upon which the PUD is proposed. The proposed PUD amendment will not affect natural or geologic hazards. 6. Site plan, building design and location and open space provisions designed to produce a functional development responsive and sensitive to natural features, vegetation and overall aesthetic quality of the community. The extension of the PUD for another 6 months will allow the applicant to explore opportunities to create a more functional development of the property as recommended in the Town Center Plan. 7. A circulation system designed for both vehicles and pedestrians addressing on and off site traffic circulation that is compatible with the Town Transportation Plan. The extension of the PUD for another 6 months will allow the applicant to explore opportunities to create a more functional circulation system for both vehicles and pedestrians, addressing off-site traffic circulation in a manner that is consistent with both the Transportation Plan and Town Center Plan. 8. Functional and aesthetic landscaping and open space in order to optimize and preserve natural features, recreation, views and function. Landscaping and open space are not altered by this proposed amendment. 9. Phasing plan or subdivision plan that will maintain a workable, functional, and efficient relationship throughout the development of the PUD. The phasing plan shall clearly demonstrate that each phase can be workable, functional and efficient without relying upon completion of future project phases. The phasing plan is not being altered by this proposed amendment. 10. Adequacy of public services such as sewer, water, schools, transportation systems, roads, parks, and police and fire protection. The extension of the PUD for another 6 months will allow the applicant to explore opportunities to create a more functional circulation system for both vehicles and pedestrians, addressing off-site traffic circulation in a manner that is consistent with both the Transportation Plan and Town Center Plan. 12. Development Standards Development Standards including lot area, site dimensions, setbacks, height, density control, site coverage, landscaping and parking are not being altered by this proposed amendment. Staff Comments & Recommendation Staff recommends approval of this PUD Amendment limited to another six-month extension of the PUD expiration from February 3, 2003 to July 3, 2003. This approval should contain language limiting any additional extensions and cautioning the applicant to work with staff to accomplish compliance with the Town Center Plan. There were several concerns expressed with our proposal. Therefore, we revisited our labor and overhead costs associated with both zoning and design review applications and worked closely with the engineering department to arrive at a comprehensive revision to our fees. In several areas, this requires the creation of new fees for applications that we are now beginning to review and process (such as sketch plans and PUD Amendments). Since the adoption of the new design review guidelines, we have been unable to capture fees for the increased review and processing responsibilities associated with a two-step process. We have attached for your review a detail of time spent on a typical application. In light of recent budgetary concerns, fees have been adjusted to accurately reflect the average total hours spent on review and processing with reductions in application fees where appropriate. This fee schedule amendment is part of a comprehensive fee amendment (with subdivision and right-of-way fee changes proposed by the Engineering Department). We have also attached a comparison of other jurisdictions' respective fees. According to Title 2.16.150 (Fees) of the Avon Municipal Code, a fee schedule sufficient to cover the cost of town staff time, consultant fees, public notices and incidental expenses of the Commission shall be established (and updated as appropriate) by the Town Council. Staff recommends that you approve Resolution 03-02 and forward this proposal to Town Council for final approval and incorporation into a revised fee schedule. Attachments: A. The MSP states that a tenant will be allowed to have only one identity sign and no more than one sign per entrance. The application under consideration consists of a variance to the MSP to allow this tenant ("Vail Valley Trading & Loan") to have more than one sign, as well as allowing the second sign to be installed on the east elevation of Building D. The current tenant occupies a retail unit, but the west elevation permits a total of four (4) signs, one for each tenant under each archway. Sign Variance Considerations 1. Approval Criteria (15.28.090 B 2) Before acting on a variance request, the Planning and Zoning Commission shall consider the following factors: a. The relationship of the requested variance to existing and potential uses and structures in the vicinity; b. The degree to which relief from the strict or literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity; C. Such other factors and criteria as the Commission deems applicable to the requested variance. 2. Findings Required (15.28.090 B 3) The Planning and Zoning Commission shall make the following findings before granting a variance: a. There are exceptional or extraordinary circumstances or conditions applicable to the site of the variance that do not apply generally to other properties in the vicinity; iii. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the vicinity. Staff Finding: This variance would not achieve compatibility and uniformity of treatment among sites in the vicinity. The additional sign proposed would be located in the archway on the east elevation of Building D. The tenant was allowed the placement of a larger sign as an amendment to the Chapel Square MSP on August 21, 2001 when the tenant occupied two units; however, the additional sign was to remain on the west elevation. Without this variance, the applicant is not deprived of privileges enjoyed by the other tenants of other properties in the vicinity. Staff Recommendation Staff recommends denial of this variance to the Chapel Square Master Sign Program as listed in staff findings above. I understand that you have, before you a recommendation for a reduction of this time to six months. We understand the Town's concern is to have Lot 61 be further explored, relative to it's conformance to the Town Center Plan: Specifically the following points: ■ Incorporation of a Transportation Hub ■ Abandonment of Benchmark Road ■ Re -direction of vehicular traffic along the mall and through the west portion of lot 61 Please consider the following ■ Our current entitlements were developed to conform to all aspects of the Town Center Plan that was in force, at the time of our review, relative to the confines of Lot 61. ■ It is a good plan that was unanimously adopted by The Commission and The Town Council. Even if it were built as approved it would not limit most of the goals of the Town Center Plan. ■ Our current entitlements carry none of the financial compromises that were made for other major development sites in The Town. ■ It is of no advantage to The Town to have the current entitlements lapse. If this were to happen, the development opportunities for Lot 61 would greatly diminish and diminish the potential tax revenue to The Town ■ Both The Lot 61 Ownership and The Town need to maintain an atmosphere that encourages solutions for development. We propose a few changes and conditions to our approval for extension in an effort to address The Town's concerns and provide a framework that is conducive to both parties: Agree to a condition where the current entitlements of land area, development density, uses, height, etc. are, at a minimum, preserved or increased Agree to extend the PUD entitlement to 18 month with a stipulation requiring that either party (Town or Land Owner) have a period, not exceeding 6 months, to review and implement the Town Center features, noted above. Should the review determine, implementation of these features unfeasible, the current development entitlements would be preserved. Why is this proposal mutually beneficial?: ■ This extension framework allows The Town the ability to pursue the implementation of The Town Center Plan ■ The Town has the ability to keep a good development plan and improve upon it. ■ The Town maintains an open framework within which to encourage good quality development and have it occur sooner.
