PZC Res No. 89-5 Riverside PUDTOWN OF AVON PLANNING AND ZONING COM2MISSION RESOLUTION NO. 89 - 2 SERIES OF 1989 A RESOLUTION FROM THE TOWN OF AVON PLANNING AND ZONING COMMISSION RECOMMENDING THE AVON TOWN COUNCIL APPROVE ORDINANCE 89 -,!6'-AMENDING THE ZONING MAP OF THE TOWN OF AVON BY APPROVING A SITE PLAN ESTABLISHING DENSITIES, ALLOWABLE USES AND OTHER ZONING CRITERIA FOR THE RIVERSIDE SUBDIVISION SPECIALLY PLANNED AREA WHEREAS, Golden Buff Enterprises, a Colorado partnership has filed application with the Town of Avon for approval of a plan to establish densities, allowable uses and other zoning criteria for Riverside Subdivision Specially Planned Area in an existing Specially Planned Area zone district of the Town of Avon; and WHEREAS, public hearings have been held by the Planning and Zoning Commission of the Town of Avon, pursuant to notices required by law, at which the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed site plan; and WHEREAS, following such public hearings and consideration of such information as presented, the Planning and Zoning Commission finds as follows: 1. The proposed plan, densities, allowable uses and other zoning criteria is compatible with the surrounding area; 2. The proposed plan, densities, allowable uses and other zoning criteria is in harmony with the character of the neighborhood; 3. The proposed development would generally have a positive effect on the immediate area; 4. The proposed plan, densities, allowable uses and other zoning criteria will have a positive effect upon future development of the area; 5. The exceptions from the zoning ordinance requirements and limitations are warranted by virtue of the design of the plan and amenities incorporated in the plan; 6. Land surrounding the proposed Specially Planned Area can be planned in coordination with the proposed site plan; 7. The proposed site plan is in conformance with the general intent of the Master Plan and general zoning ordinance; 8. The existing and proposed streets are suitable and adequate to carry anticipated traffic within the area and in the vicinity of the area; 9. The existing and proposed utility services are adequate for the proposed development; 10. The proposed plan creates a desirable environment; 11. The proposed plan makes it possible for the creation of an innovative and efficient use of the property.. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE TOWN OF AVON, COLORADO, THAT: The Planning and Zoning Commission of the Town of Avon, Colorado hereby recommends the Town Council of the Town of Avon, Colorado, adopt ORDINANCE 89 - 6, SERIES OF 1989, AN ORDINANCE PROVIDING FOR THE APPROVAL OF A PLAN ESTABLISHING DENSITIES, ALLOWABLE USES AND OTHER ZONI14G CRITERIA FOR THE RIVERSIDE SUB- DIVISION SPECIALLY PLANNED AREA, SUBJECT TO AND CONDITIONED BY THE FOLLOWING: 1. The provision for a Town of Avon access and maintenance easement .from Lot 1, Riverside Subdivision to Tract A, Riverside Subdivision as part of the zoning and subdivision approval. 2. There shall be no intrusion into the rear setbacks for built recreational as proposed. 3. Exception to 10'-0" parking setback from the front property line shall be limited to a maximum of 200 ft. to allow for the construction of access ramp to underground parking facilities. 4. Zoning approval shall be contingent upon approval and recording of Final Subdivision Plat conforming with proposed zoning. 5. The Assigned Density for Lot 1 be revised to read: 150 Accommodation Unit Development Rights are assigned, which may be developed only in accordance with Allowed Uses. 6. The Allowed Uses for Lot 1 be revised to read: 150 Accommodation Unit, Hotel, Lodge or Motel, with a maximum of 5,000 net square feet of commercial use which may consist of retail shops, restaurants, personal service shops, cocktail lounge and office.
