TC Resolution 19-19 Supporting Eagle County Ballot Issue 1A -Taxation of Tobacco and Nicotine Productsw �, .von coLoRaoo RESOLUTION 19-19 SUPPORTING EAGLE COUNTY BALLOT ISSUE 1A — FUNDING TO SUPPORT PUBLIC HEALTH PROGRAMS AND EDUCATION THROUGH THE TAXATION OF TOBACCO AND NICOTINE PRODUCTS WHEREAS, the Town of Avon, Colorado (the "Town"), is a duly organized and existing home - rule municipality of the State of Colorado, created and operating pursuant to Article XX of the Constitution of the State of Colorado and its Home Rule Charter of the Town of Avon, Colorado (the "Town Charter"); and WHEREAS, the Town Council hereby finds that tobacco and nicotine addiction is a leading cause of preventable death, that people should be deterred from starting the use of tobacco and nicotine products and encouraged to quit the use of tobacco and nicotine products, and that taxes on the sale of tobacco and nicotine products are effective at preventing and reducing tobacco and nicotine use; and WHEREAS, in 2018, the Avon electorate overwhelmingly approved a tax of $3.00 per pack of cigarettes and a 40% tax on all other tobacco and nicotine products, and the new taxes took effect on January 1, 2019; and WHEREAS, the Town Council hereby determines that it is in the interests of the Town, its residents, and Avon tobacco retailers to support a County tax of $4.00 per pack of cigarettes and a County tax of 40% on all other tobacco products to help promote equity among tobacco retailers in Eagle County and to enhance comprehensive tobacco prevention and control efforts to reduce youth and adult tobacco use rates; and WHEREAS, pursuant to C.R.S. §1-45-117(1)(b)(III), the Avon Town Council may pass a resolution supporting a ballot measure and report such passage through established, customary means; and NOW, THEREFORE, BE IT RESOLVED that the Avon Town Council fully supports and endorses Eagle County Ballot Issue IA.
