This application (Attachment A) seeks approval for an updated Sign Program that allows greater flexibility in lighting, design, and location of signs. Property Description The Seasons building is a large, well established structure between Benchmark Road and the Main Street Mall. It hosts various uses that have different needs. Summary of Sign Program Amendment Monte Park (the Applicant) is presenting a MSP Amendment proposal for the property that uses the Town’s definition of sign area, creates more flexibility with lighting, adds push-through letters internally lit on a raceway panel, changes the sign locations and types for tenants occupying multiple spaces (Attachment A, 5), and veers away from the West Town Center Investment Plan. This MSP is the first being processed under the new standards as outlined in Chapter 7.16.160. “Major” MSP amendments that propose additional sizes, new locations, or other drastic changes require a public hearing and decision by PZC. The application is the result of a single tenant occupying multiple spaces on the south side of the property wanting greater flexibility, and some other subsequent cleanup. The Amendment maintains the same size and location of signs except for tenants of multiple spaces. Staff is generally supportive of this change, but wants to be clear about the type and locations of signs that the flexibility would allow. As applied, a tenant occupying multiple spaces would be allowed placement of any sign desired, pending approval by the building owner. This seems too ambiguous for staff, and a greater attention to the specific examples allowed or disallowed are cites as a condition of approval. The West Avon Town Center Investment Plan (WATCIP) was implemented in August, 2007 and seeks to guide design decisions in the area. Since the Great Recession, lower tenant occupancy in The Seasons, and decreased development pressure in the town led to the document being relatively toothless. While the 2010 MSP being modified in this application seems to adhere to the letter of the Plan, the applicant feels a departure from that standard may result in a better outcome for the building. Below is applicable wording pulled from the sign section: Intent: Because the architecture and design of every building will differ, this entire strategy is intended to act as a guideline and to remain flexible to allow for creativity. Imaginative sign layouts are encouraged. Priority Guidelines: • Signs must be externally illuminated. Sign lighting components must bear the U.L. label. • Exposed crossovers between letters or words are not permitted. All raceways, transformers, ballasts, conduit, boxes, electrode boxes and other wiring shall be concealed from public view. • Metal sign material, fastenings and clips of all types, shall be hot-dipped galvanized iron, stainless steel or brass. Black iron materials of any type are not permitted. • Sign height above floor for projecting or suspended signs in pedestrian zones: bottom of sign to be a minimum of 9 and ½ feet above the finished floor. • Signs are to be controlled by a time clock and must be on a separate circuit from other lighting. • The tenant is responsible for all signs, permits, power sources, connections and installations. Guidelines: • Integration of signage into the building architecture is encouraged. It is recommended that the signage be compatible with the color and material palette of the individual tenant. • It is recommended that signs remain illuminated during shopping center business hours. • Letter size and location proportional to the overall storefront design and in compliance with district design criteria are encouraged. Proportional letters are also encouraged. • Creative sign design is encouraged. Staff response: Staff is sympathetic to a reinterpretation of these guidelines with regard to the current application, specifically with allowing unlit signs. The sheer size of the building (and its low occupancy) is an argument for more diversity in sign type allowed. That is, from end to end, different uses may benefit from different types of signs. Review Criteria According to the Avon Municipal Code, the Planning and Zoning Commission shall consider the following items in reviewing proposed Sign Programs: 1. Evidence of substantial compliance with the purpose of the Sign Code as specified in Section 7.32(A) Sign Code Purposes; Staff Response: The application strikes a balance for (7): “Provide a reasonable balance between the right of an individual to identify a business or express a message, and the right of the public to be protected against the visual discord resulting from the unrestricted proliferation of signs and similar devices.” 2. The suitability of the improvement, including materials with which the sign is to be constructed and the site upon which it is to be located; Staff Response: The material choices of the MSP are more a list of potentially banned styles. Reverse pan channel and push through letters are proposed to be added to the list that may be scrutinized. 3. The nature of adjacent and neighboring improvements; Staff Response: Neighboring commercial buildings include the Wyndam, and Avon Center. The sign types are diverse but generally present a unified design. For example, the signs below are all internally lit cabinet design. The applicant has pointed out that several sign types in the West Town Center area do not comply with the letter of the WATCIP. 4. The quality of the materials to be utilized in any proposed improvement; Staff Response: Staff does not anticipate any diminished use of material with this amendment, however wants to be sure that the style of the arcade sign proposed will be compatible with other signs on the building. 5. The visual impact of any proposed improvement, as viewed from any adjacent or neighboring property; Staff Response: The sheer size of the building means that the property can be viewed from many adjacent properties. The impact of the specific design on the north side (Attachment A, 4) is anticipated to be minimal, but staff wants to point out the uncertainty that this amendment opens up. 6. The objective that no improvement will be so similar or dissimilar to other signs in the vicinity that values, monetary or aesthetic, will be impaired; Staff Response: Not applicable. 7. Whether the type, height, size and/or quantity of signs generally complies with the sign code or sign program, and are appropriate for the project; Staff Response: The Program allows for individuality, while maintaining consistency with sign placement and general design parameters with consistent size and location standards. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether the sign is appropriate for the determined orientation. Staff Response: Not applicable. Staff Recommendation: Staff recommends approval of the Case #19007 with the following findings and conditions. Condition 2 through 4 are carried over from 2010 conditions made by PZC. Findings: 1. The application is complete; 2. The application provides sufficient information to allow the PZC to determine that the application complies with the relevant review criteria; 3. The proposed application was reviewed pursuant to §7.16.160(f), Sign Plan. The application meets the sign standards established in the Avon Development Code; 4. The application complies with the goals and policies of the Avon Comprehensive Plan; 5. No extra demand for public services is made by the application; 6. The design relates the development to the character of the surrounding community; and 7. The application is not so restrictive as to eliminate individuality but provides for the expectation of attractive sign installation. Conditions: 1. Specific locations for additional sign locations shall be added to the “sign placement for tenant signs” sheet and approved by staff; 2. The MSP shall state that tenants that occupy both a first and second story unit shall only receive a first story sign; 3. The MSP shall state that tenants that occupy a second story unit shall only receive a sign on the second story; 4. The MSP shall state that tenant signage is encouraged to be three dimensional (i.e. blades and/or dimensional creative signs) and the fees may be waived by Town; and 5. The Applicant shall produce a single document Master Sign Program that complies with the regulations outlined in Chapter 7.34.101(h) before any sign applications will be accepted for the property. Recommended Motion: “I move to Approve Case #SGN19007, a Sign Program Amendment application for Lot 62/63 Block 2 Benchmark at Beaver Creek Subdivision with the findings and conditions as recommended by staff.” Attachments: A. Allow concrete to cure per concrete manufacturers guidelines. Step 3 (Recycled Post Only): Install the Surface Mount Bases to the bottom of the Posts. Align the holes on the Bases with the holes on the Posts. The Bases should fit snuggly around the Posts. Fasten them together with the provided 5/16" Hex Head Lag Bolts. Step 4: With two people place the Instrument Assembly with Posts attached onto the concrete pad and mark the center of the holes on the surface mount bases. After you have made your marks, set aside the Instrument in order to drill for anchor holes. With a hammer or rotary drill, drill through concrete at marked locations. Drill to a minimum depth of 4". A 3/8" masonry drill bit will be needed. Step 5: Place the Instrument back over the drilled out holes. Insert provided anchor bolts into aligned holes. Position anchor nut so that it is flush with the top of the bolt. Pound anchor bolts into the hole until the anchor washer is flush with the surface mount bases. Tighten anchor bolts until they are snug. Cover remaining bolt sections with provided nut caps. Step 6: Verify the correct placement, levelness, and finished height of the Instrument. Pound anchor bolts into the hole until the anchor washer is flush with the post base. Tighten anchor bolts until they are snug. Step 4: Install the Drums over the Anchor Discs. Predrill (4) 1/8" holes in a 90 cross pattern, 1" up from the bottom of the drum. Drill through both Drum and Anchor Disc. When predrilling holes, make sure they clear the previously installed anchor bolts, and that there is clearance for the 2" screws to be installed without interfering with the other drums. Secure Drums to Discs with the provided #10 Butten Head Screws and Driver. Step 5: Check for sufficient clearance around instruments. A 36" clearance is recommended around the the entire Drum arrangement for wheelchair accessibility, however this is not required for proper function.
