Owner: Colorado World Resorts, LLC Public Hearing: Required File: #AEC18010 Prepared By: Matt Pielsticker, AICP, Planning Director Introduction The Applicant, TAB Associates, Inc., representing the owner, Colorado World Resorts, LLC, of the site located on Highway 6 & 24, has submitted an Alternative Equivalent Compliance (AEC) application. The application is for variations to the maximum irrigated area requirements of the Avon Development Code. The application materials include a written narrative and drawings (“Exhibit A”), along with referral comments from the Eagle River Water and Sanitation District (“Exhibit B”). A public hearing will be conducted at the November 20, 2018 meeting, and the Planning and Zoning Commission is the final review authority for this application. Alternative Equivalent Compliance Alternative equivalent compliance is a procedure that allows development to meet the intent of the design- related provisions through an alternative design. It is not a general waiver or weakening of regulations; rather, this application procedure permits a site-specific plan that is equal to or better than the strict application of a design standard specified in the Development Code. This procedure is not intended as a substitute for a variance or administrative modification or a vehicle for relief from standards in this Chapter. Alternative compliance shall apply only to the specific site for which it is requested, and does not establish a precedent for assured approval of other requests. AEC Request The minimum landscaped area required for the RH zone district is 25%, and the maximum irrigated area per code is 20% of the landscaped area. Additionally, up to 5,000 square feet of irrigated area is permitted for RH zoned properties regardless the size of the property or project. The Application proposes a landscape and irrigation plan that does not meet the maximum irrigated area requirement for Residential High (RH) zoned property. The Avon Development Code Table 7.28-6 permits 20% maximum irrigated area (of the 25% minimum landscaped area), up to 5,000 square feet. This alternative design requests 14,500 square feet of permanently irrigated landscape area. The finer details of the irrigation plan have been modified pursuant to comments received from the Eagle River Water and Sanitation District. Staff is supportive of this request given the efforts to utilize drought tolerant species. Additionally, the size of the property and building warrant additional plantings to help anchor and transition the project to the steep, wooded hillside that surrounds. The stated purpose of the landscaping standards in the Development Code is to ensure that Landscape Plans: (1) Integrates building sites with natural topography and existing vegetation; November 20, 2018 Planning and Zoning Commission Meeting – PUBLIC HEARING Colorado World Resorts: AEC 2 | Page (2) Minimizes disturbed areas; (3) Conserves limited water resources; (4) Reduces water use and off-site impacts which can affect the Eagle River; (5) Reduces the amount of reflected glare and heat absorbed in and around developments, (6) Breaks up large expanses of parking lots, and (7) Preserve residential neighborhoods by lessening the impacts of potentially incompatible uses. The updated Landscape Plan undoubtedly does a better job at integrating the building, and disturbed areas remain unchanged from the previous plan reviewed by the Planning and Zoning Commission. Water use has been carefully analyzed and sod area is minimal with the request. The rain garden will also help reduce any impacts to the Eagle River. AEC Review Criteria The PZC shall use the following review criteria as the basis for a decision on the application: 1. The proposed alternative achieves the intent of the subject design or development standard to the same or better degree than the subject standard; 2. The proposed alternative achieves the goals and policies of the Avon Comprehensive Plan to the same or better degree than the subject standard; 3. The proposed alternative results in benefits to the community that are equivalent to or better than compliance with the subject standard; and 4. The proposed alternative imposes no greater impacts on adjacent properties than would occur through compliance with the specific requirements of this Title [Landscape Code]. Staff Response: The proposed landscaping and irrigation design imposes no greater impacts on adjacent properties than would occur through compliance with the stepping requirement, and therefore staff is supportive of the request. The increase in permanently irrigated landscape area brings the property into closer compliance with the neighborhood aesthetic and is appropriate and proportional to the size of the site. The property is located within the Avon Comprehensive Plan’s ‘US Highway 6 Gateway Corridor’, with “community gateway” status near the Beaver Creek roundabout. The Application responds to the planning principles that seek to enhance the US Highway 6 right-of-way to strengthen Avon’s overall community image. Staff is fully supportive of the Avon Comprehensive Plan goals and policies cited in the Applicant’s written narrative and those are also incorporated into staff’s recommended findings and motion below. This AEC Application seeks approval for the revised landscape design which addresses the landscape-related comments included in the Staff Report dated 9/18, and the Planning Commissioner’s comments received at the P&Z Hearing on 9/18. Specifically, this application seeks approval for an increased permanent irrigation square footage. AEC Application submittal items included: 1. Land Development Application 2. Rain garden section detail Landscape Review from the Staff Report dated 9/18/18: The minimum landscaped area required for the RH zone district is 25%, and according to the landscaping standards the maximum irrigated area is 20% of the landscaped area, up to 5,000 square feet of irrigated area. To address comments from the Eagle River Water and Sanitation District, the amount of vegetation has been reduced since the originally submitted application. Additionally, other aesthetic changes have been made in response to PZC’s comments at the first public hearing. Boulders have been added to present a more “organic” appearance. As presented, the plans are generally compliant with the Landscaping standards in the Development Code; a modified plan to reduce irrigated area to the 5,000 sq. ft. area is recommended as a condition of approval. This would likely be achieved by reducing the turf area. Proposed Deviation: The applicant is requesting a deviation from the max. 5,000 square feet (SF) allowance of permanently irrigated landscape area. The requested amount of permanently irrigated area is an allowance up to 14,500 SF total. The enclosed drawings and water-use table outline a permanently irrigated area of 14,252 SF; however, the applicant is requesting 14,500 SF to allow for any slight deviations in designed areas as the project is implemented. The area of temporary irrigation shown is 25,535 SF; this refers to landscaped areas that will be temporarily irrigated for a period of approximately 2 years, or until the plants in these areas (trees and native grasses) are established (meaning, the root system is established enough to utilize ground-water, and the plants do not require supplemental irrigation). The following sections of this AEC application outline the specific reasons this deviation in permanent irrigation area is being requested, and the ways in which the applicant feels the increased irrigation area allowance will support the Avon Comprehensive Plan. CWR Avon Condos AEC Application - Landscape Specific Reasons and Justification for the AEC • The code allowance of max. 5,000 SF of permanent irrigation does not allow for an adequate amount of shrub / perennial plant beds to meet the landscape unit requirements, or to adequately provide an appropriate level-of-finish for the property that results in an attractive and well-maintained property that complements and enhances the Hwy 6 transportation corridor or The Town of Avon, as a whole. • The code allowance of max. 5,000 SF of permanent irrigation will not adequately support a landscape along the Hwy 6 frontage that meets the goals of the Town of Avon’s Comprehensive Plan. • Drought-tolerant, native shrub and perennial beds require irrigation. • The landscape area on the north side of the building (the public frontage along Hwy 6), will be in shadow for the majority of the day, and will therefore require partial shade-tolerant plants, which commonly require irrigation. • The deviation request to allow up to 14,500 SF of permanently irrigated area represents 1.6% of the Lot Area (914,760 SF), and 7.9% of the Developable Lot Area (184,198 SF). The applicant feels that this maintains a very low percentage of the property to be irrigated, and thus meets the Town’s goal to achieve water conservation and the implementation of water-wise, drought-tolerant landscapes. Response to Mandatory Review Criteria in 7.16.120 (d) (d) Review Criteria. The review authority shall use the following review criteria as the basis for a decision on an application for alternative equivalent compliance: 1. The proposed alternative achieves the intent of the subject design or development standard to the same or better degree than the subject standard; a. Applicant’s response: The increased allowance of permanently irrigated landscape area being requested will allow the property to be landscaped with drought-tolerant shrubs, trees and perennials to an appropriate extent that is more proportional to the size of the property (area of lot = 914,760 square feet). The applicant believes that the code allowance of max. 5,000 SF of permanently irrigated area is inadequate for a property of this size. The additional area of permanently irrigated area will allow the property to meet the number of landscape units required, based on property size. The deviation request to allow up to 14,500 SF of permanently irrigated area represents 1.6% of the Lot Area (914,760 SF), and 7.9% of the Developable Lot Area (184,198 SF). The applicant feels that this maintains a very low percentage of the property to be irrigated, and thus meets the Town’s goal to achieve water conservation and the implementation of water-wise, drought-tolerant landscapes. CWR Avon Condos AEC Application - Landscape 2. The proposed alternative achieves the goals and policies of the Avon Comprehensive Plan to the same or better degree than the subject standard; a. Applicant’s Response: The moderate increase in permanently irrigated landscape area will allow for the implementation of a drought-tolerant landscape that is proportional to the scale of the building and property, and meets Avon’s vision and values described in the Comprehensive Plan. Specifically, it allows the landscape design to respect the natural environment by visually connecting the property to both the upslope Spruce / Fir / Aspen forest and the riparian corridor of the Eagle River. Native introduced plants will provide a habitat link for local fauna, and minimize water-use in permanently irrigated areas. These landscape improvements will make a significant contribution to the Town’s distinctive built form and sense of place and character, as emphasized in the Comp Plan. The additional irrigated area is primarily located along the public-facing North side of the property, and will help beautify the building frontage and pedestrian experience along this frontage and adjacent bus stop. The improved landscape treatment that will result from the additional irrigation allowance will directly support Comp Plan – Built Form Goal A.2: Maintain a distinct physical and visual separation between Avon and its surrounding communities that preserves the natural beauty of the surrounding mountains and the Eagle River valley. And, the additional irrigated area will support a drought-tolerant landscape that meets the goals of Community Character, including the following: • Goal C.2: Create community gateways and streetscapes that reflect and strengthen Avon’s unique community character and image. • Policy C.2.1: Beautify the Town with landscaping and public art. • Policy C.2.2: Design and maintain streets and walkways as safe, inviting, and pedestrian/bicycle friendly public spaces. • Policy C.2.3: Reinforce community gateways along major roadway corridors that strengthen Avon’s community identity. • Policy C.2.4: Encourage landscaping and building locations that enhance neighborhood views and view corridors. • Policy C.2.5: Work with other entities to improve the streetscape along U.S. Highway 6 and lessen visual and noise impacts from I-70 and Highway 6 while preserving important views of Avon. CWR Avon Condos AEC Application - Landscape The increased irrigation allowance will support the implementation of indigenous trees and shrubs along the project’s public frontage along Hwy 6. District 2: Riverfront District Plant indigenous trees and shrubs to screen existing large residential buildings along U.S. Highway 6 and provide landforms and landscaping between residences and U.S. Highway 6. 3. The proposed alternative results in benefits to the community that are equivalent to or better than compliance with the subject standard; and a. Applicant response: The increased amount of permanent irrigation area requested will support an improved landscape character along the property frontage, and thereby benefit the Avon community by visually improving the Hwy 6. transportation corridor and scenic beauty of the area and visual continuity with the upslope Spruce / Fir / Aspen forest and Eagle River riparian corridor. 4. The proposed alternative imposes no greater impacts on adjacent properties than would occur through compliance with the specific requirements of this ordinance. a. Applicant’s response: The proposed alternative supports an improved landscape character that will benefit the neighboring properties, specifically the Ascent to the West by supporting additional plant screening between the two buildings. Additional P&ZC Comments Addressed in this AEC Application: During the Planning & Zoning Commission Hearing on 9/18, the Commissioners were generally in-favor of increasing the square-footage allowance for permanent irrigation above the 5,000 SF cap, and generally supportive of the approach depicted in the diagram presented, titled “Irrigation Diagram – Additional Permanent Irrigation Plan”, which depicts the proposed additional permanent irrigated area along the North frontage of the property, and a total permanent irrigated area of 14,500 SF. P&Z Commissioners comments and request for additional information on 9/18 included the following: • Irrigation o Provide more information / analysis of overall water budget for the project  Applicant’s response: Please refer to the updated water use and peak flow projections chart included in this AEC submittal. This chart outlines 319,916 gallons (0.98 acre-feet) of water use per year, based on the 14,252 square feet of permanently irrigated area depicted on the revised landscape plans (attached). Average peak season flow is 8 GPM, with a required tap size of ¾”. CWR Avon Condos AEC Application - Landscape o Clarify permanent vs. temporary irrigation zones  Applicant’s response: Please refer to the new irrigation zone diagram (sheet L3.1) included in the drawing set, in this submittal. • Rain garden / detention area o East side - concerns with design of inflow / outflow being next to each other. Recommend separating to improve bio-swale functionality.  Applicant’s response: Please refer to the revised detention / rain-garden design plan and section detail provided by Alpine Engineering, included in this submittal. The revised design now reflects the separation of inflow and outfall, resulting in a bio-swale through the bottom of the detention / rain garden area. o West side - request to consider armoring the bio-swale channel.  Applicant’s response: Please refer to the revised detention / rain-garden design plan and section detail provided by Alpine Engineering, included in this submittal. At the inflow to the pond, a 12” storm pipe will have cobbled D50=6” riprap at the pipe outfall to dissipate any storm flows. The applicant is recommending not lining the bio-swale with rock cobble for the entire length due to potential debris collection. The Civil Engineer (Alpine Engineering) does not anticipate a large volume of flow to this pond and armoring the swale is not necessary, in their professional opinion. o Add aspen trees to rain garden area to help bring hillside landscape character down into this area of property.  Applicant’s response: Please refer to revised planting plans; aspen trees have been added to this location, per Commissioner Glaner’s request. • West side of building landscaping o Based on Ascent resident’s public comments, request to clarify the landscape approach on this side of building.  Applicant’s response: Please refer to revised drawing set for the inclusion of one (1) illustrative elevation of West Bldg., depicting landscape character, and one (1) illustrative section of West Bldg. The drawings show the proposed plantings as well as the preserved existing Ash trees that are along the existing retaining wall at Ascent driveway. Four of these ash will need to be removed based on the Civil Engineer’s grading plan; however, the majority will be preserved and contribute to a screened-view of the CWR building from the Ascent property. The four removed ash trees will be mitigated with a combination of spruce and aspen trees in the immediate vicinity, as shown in the illustrative section / elevation drawings. The introduction of the spruce and aspen mix of trees will further screen building and visually connect the property to the upslope Spruce / Fir / Aspen forest. CWR Avon Condos AEC Application - Landscape • Overall landscape plan o As part of AEC application, Commissioners requested an overall update to the landscape plan.  Applicant’s response: Acknowledged. Please refer to the updated set of landscape drawings as part of this submittal package. • Consider utilizing Graywater capture and use, per Commissioner Dammeyer.  Applicant’s response: First, the applicant assumes that the Commissioner was referring to rain-water capture and not the capture and re-use of graywater from building fixtures. The applicant has researched the legality of rain-water capture and reuse and has found that it is allowed in Colorado. While it is legal and a possibility, the applicant proceeding with the assumption that maximizing on-site rainwater filtration through bio-swale and eventual outfall to the Eagle River is the preferred approach that better supports the overall intent of The Town of Avon’s Comp. Plan. The deviation from required roof overhang size requires an Alternative Equivalent Compliance application. Action: Commissioner Barnes motioned to approve the AEC application with the following findings: 1. The proposed application was reviewed pursuant to §7.16.080(f), Development Plan, §7.16.090(f), Design Review, and §7.16.120 Alternative Equivalent Compliance; 2. The AEC achieves the intent of the roof design standard to the same or better degree than the subject standard because the smaller overhangs and flatter sections are consistent with the preexisting forms the building; 3. The AEC achieves the goals and policies of the Avon Comprehensive Plan to the same or better degree than the roof design standards, including Policy A.1.5; 4. The AEC results in benefits to the community that are equivalent to compliance with the roof design standards; and 5. The AEC imposes no greater impact on adjacent properties than would occur through compliance with the specific requirements of the Avon Development Code.
