INTRODUCTION
Jay Harkins, of Harkins & Asso., has submitted an application on behalf of Eaglebend
Affordable Housing Enterprise, to modify the Final Design Approval for Eaglebend, Phase
III and satisfy certain conditions of approval.
The application includes: reconfiguration of the west building on site; landscape plan
approval; playground equipment; site and building lighting; and dumpster enclosure and
location approval.
STAFF COMMENTS
Building Reconfiguration:
The west building has been changed due to the grading plan being finalized. The change
includes the building being broken up and stepping with the topography. Revised
elevations are attached to the report. The change to the building meets the height
requirement setforth in the PUD Guidelines. Our only concern is that the landscape plan
shows the west building encroaching into the 30' Mean Annual High Water Mark
Setback. Buildings, decks, roof overhangs, patios and other improvements may not be in
the 30' setback. The only encroachment allowed for this site is the following: "... an area
within a 12 foot radius of the northwest corner of Building A and the developer agrees to
restore that area to a level acceptable to Staff" This encroachment is only for
construction purposes and not permanent structures.
Landscape Plan:
The proposed landscape plan contains a variety of plant material. The only comment is
the plant material must meet the minimum sizes required by the Town. These are 2"
minimum for deciduous trees, 6' for coniferous, and 5 gallon for shrubs.
Dumpster Enclosures and Locations:
The proposed dumpster locations are at the ends of the parking area. Does the
Commission feel these locations are appropriate in terms of circulation for the trucks? Are
the locations appropriate for the tenants?
Information on the enclosures is provided in the attachments. The main comment
regarding the enclosures is the materials and colors match the main buildings.

Building and Site Lighting_
Three light poles and eight building mounted lights per building are proposed. Two of the
light poles will be 12' high, located at the ends of the parking, by the dumpster, and one
16' high pole in the island at the entrance. The building mounted lights must be low level,
and not overflow into motorist's eyes in the parking area or the Highway.
Playground and Picnic Equipment and Locations:
The landscape plan indicates a bar-b-que and play area. The play area is indicated within
the 30' Mean Annual High Water Mark setback, which is not an allowed use in the
setback. Detail must be provided on the areas and the play area located out of the 30'
setback.
STAFF RECOMMENDATION
Staff recommendation is for the Commission to approve the request with the following
conditions:
1. Conditions stated in Ordinance NO. 94-20 apply to this application.
2. The proposed location for the play area must be located out of the 30' Mean Annual
High Water Mark setback.
3. Specific site plans for the play and bar-b-que areas be submitted and approved by
Staff.
4. The trash enclosures match the main structures in color and materials.
5. The landscape plant material be the minimum size requirements of the Town of Avon.
6. Submit revised plans prior to a building permit application, clarifying location of the
west building, patios, deck, and roof overhangs. They may not encroach into the 30'
Mean Annual High Water Mark setback.
