Legal Description Lot 31, Block 1, Benchmark at Beaver Creek
Introduction
The project is a three-story building to house a veterinary hospital, associated retail,
boarding facilities and 4 units of employee housing, located on the north side of
Nottingham Road, about a block east of the intersection with Metcalf Road. This project
was reviewed by the Commission in February and March, and received approval (by
special review) for the uses described in this application, with the exception of two
residential units instead of the four units now proposed. (The zoning ordinance has been
revised to allow four residential units accessory to the business, rather than the original
two). The building has also been modified somewhat, particularly the window openings on
the south elevation, and the building has been extended approximately 20 on the west end.
Parking and snow storage meet the minimum allowed by the zoning code.
Design Review Considerations
The Commission's Procedures, Rules & Regulations, Section 6.10, provide the
framework for evaluation of this project. Additional guidelines and regulations are
contained within (but not limited to) the Comprehensive Plan, the Design Guidelines, the
Zoning Ordinance and the Subdivision Regulations. Section 6.10 is included below:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
2. The suitability of the improvement, including type and quality of materials of which it
is to be constructed and the site upon which it is to be located.
3. The compatibility of the design to minimize site impacts to adjacent properties.
4. The compatibility of the proposed improvements with site topography.
5. The visual appearance of any proposed improvement as viewed from adjacent and
neighboring properties and public ways.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity
that values, monetary or aesthetic will be impaired.
7. The general conformance of the proposed improvements with the adopted Goals,
Policies and Programs for the Town of Avon.

Staff Comments
The project is in general conformance with the Comprehensive Plan, Zoning Ordinance
and the Commission's Procedures, Rules & Regulations. The uses proposed are much
more suited to the IC Zone District than the current location next door to Wal-Mart (SC
Zone District).
Staff Recommendation
Contingent upon the front parking lot setback variance being granted, staff recommends
approval as presented.
