Introduction
The proposed residence was originally approved for final design by the Planning and Zoning
Commission on April 20, 1993. As you are aware, Design Review approvals are valid for two
years; the original approval has expired and the applicant is requesting final approval again.
The site is a flag pole lot located near the end of Flat Point Road on the south side of the street.
It is 1.13 acres in size with steep slopes to the south ranging from 38 % to 48 ° o.
The structure is a single story with a walk out basement, approximately 3, 500 square feet in area
The proposed exterior is finished in wood siding with a semi -transparent stain. The roof is asphalt
composition. Accents include a gray blue juniper stain for shutters and flower boxes.
Staff Comments
The design includes a 12 foot high retaining wall that encroaches into the 7.5 foot side yard utility
easement on the north side of the house. The wall would be less than 4 feet from the neighboring
property and existing four plex on Lot 38, Block 3. Because of the retaining wall's height, it is
very likely that the neighbor's property would be disturbed during construction. Resulting loss of
adjacent support would likely also threaten the existing building.
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
2. The suitability of the improvement, including type and quality of materials of which it is to be
constructed and the site upon which it is to be located.
3. The compatibility of the design to minimize site impacts to adjacent properties.
4. The compatibility of the proposed improvements with site topography.
5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring
properties and public ways.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity that
values, monetary or aesthetic will be impaired.

The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
Recommended Action
Even though the design was approved over two years ago, staff is concerned about the potential
impact of the retaining wall. The experience of projects built on steep sites subsequent to that
approval illustrates the problems inherent in this approach. In addition, Wildridge design
guidelines specify that retaining walls over six feet tall should be multiple structures with
landscape planters on terraces. If the Commission elects to re -approve the plan as presented, staff
recommends that the Commission table the application until the applicant:
1. submits a certified grading plan, demonstrating that the building and adjacent property not be
threatened.
2. submits written permission from the neighboring property owners to the north for disturbance
during construction.
3. indemnifies the Town against any liability damages to adjacent structures and property.
4. modify the landscape plan to provide dense planting to screen the wall.
The grading plan should then be reviewed by staff and submitted to the Commission for final
review.
