TN B3 BMBC TMP Fuel TankTown of Avon Final Design Staff ortRep September 3, 1996 Planning & Zoning Commission meeting Report date August 30, 1996 Project type Temporary above ground fuel tank Legal description Tract N, Benchmark at Beaver Creek Subdivision Zoning Government, Park and Employee Housing (GPEH) Introduction This is an application to change the location of a temporary above ground fuel tank at the Avon Wastewater Treatment Plant. The tank was approved on the south side of the treatment plant on June 18, 1996. The applicants were informed by the State Oil inspector that the tank must be moved 25 feet away from the building. This would put it in a driveway area. The applicants are requesting to move it to the western side of the site, just north of the existing barn building. The new site would be in proximity of the Sunridge I condominiums The above ground tank has concrete walls (Convault) that can be painted to match the nearby building. The tank is eight feet tall, eight feet wide and thirty-six feet long. Code currently does not allow permanent above ground fuel tanks (Section 17.50.090). However, the applicants are requesting the temporary approval while the Town evaluates whether to change its regulations. There have been significant environmental problems with leaking underground storage tanks (LUSTS) throughout the nation. It is now very difficult and costly to meet federal regulations for the underground tanks. The Fire Marshall supported the previous application. This will need to be reviewed by the Fire Chief or Fire Marshall. Design Review Considerations According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission shall consider the following items in reviewing the design of this project: 1. Conformance with the Zoning Code and other applicable regulations of the Town. The tanks are outside any easements and setbacks. However, the above ground storage tanks can only be approved as a temporary use to conform to Town Code. 2. The suitability of the improvement, including type and quality of materials of which it is to be constructed and the site upon which it is to be located. The above ground tanks are a better environmental solution in this location which is adjacent to the Eagle River. The convault tanks are suitable for this treatment plant site. 3. The compatibility of the design to minimize site impacts to adjacent properties. A solid wood fence and large coniferous trees should be provided to screen the area. The applicants state that about 10 vehicles will fuel at the tank every day. The applicants also need to indicate if lighting is proposed with these fuel tanks. Staff assumes the fueling station will be available to employees 24 hours a day. Any proposed lighting should be down shielded to minimize glare to residents. The residential area is located above the plant site. Any lighting should be at as low a height as possible to minimize impacts on the residential area. 4. The compatibility of the proposed improvements with site topography. The tanks are proposed on a level portion of the site. No significant changes to the topography are proposed. 5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring properties and public ways. If the tanks are screened with tall evergreen trees they will not be visible from neighboring properties. The barn building will screen the view of the tanks from the river. There are no public ways that will have a view of the tanks other than from the railroad tracks. 6. The objective that no improvement be so similar or dissimilar to others in the vicinity that values, monetary or aesthetic will be impaired. Not applicable 7. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. The proposal does not conflict with any adopted Goals, Policies and Programs for the Town of Avon. Staff Recommendation Staff recommends approval with conditions. Recommended Motion Approve Tract N, Benchmark at Beaver Creek Subdivision, above ground fuel tanks for a two year time period with the following conditions: 1. A six foot solid wood screen fence be provided along the property line in the vicinity of the tanks. 2. The applicants provide a landscape buffer of eight foot tall evergreen trees to the west of tanks, for staff approval.
