Building A is 29,000 square foot commercial building to be used primarily for office and limited retail use in conformance with the approved PUD. The PUD was approved by Planning & Zoning Commission on May 7, 1996, and on May j28, 1996 by Town Council. Although the overall design concept was approved as this meeting. Design Review Considerations According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission shall consider the following items in reviewing the design of this project: 1. Conformance with the Zoning Code and other applicable regulations of the Town. • Allowed use: Conforms with the uses stipulated by the PUD plan and ordinance. • Lot Coverage: The proposed building coverage conforms with the footprints and building coverage established by the PUD. • Setbacks: The building setbacks exceed the minimum setback established by the PUD. The 30' setback from the mean annual high water mark should be clearly delineated and a note provided on the plan that this is a non -disturb area. • The proposed sign does not meet the 10 foot setback from the property line. The sign needs to be moved. A master sign program is required for the property. • Easements: There are no proposed encroachments in the easements. All easements need to be clearly labeled on the site plan sheet. • Building Height: The largest scaled height of 57 on the northeast elevation conforms with the 60' maximum limit established by the PUD. • Grading: The proposed grading plan appears to push some grading into the 30 foot non - disturb area adjacent to the river. There are slopes between the parking lot and easterly property line that exceed 2:1. The bike path may require retaining walls or slopes steeper than 2:1. • Parking: The parking meets the requirements established by the PUD which are 5.5 spaces per 1000 square feet of the first floor area and 4 spaces per 1000 square feet for all other floors, with a 15 percent reduction. The PUD and standard zoning require 139 spaces for this building and 147 spaces are provided. • Snow Storage: Submitted plans appear to meet requirements for 20 percent snow storage. The plan needs to delineate the snow storage areas and provide the calculations with the surface parking and area of snow storage provided. • Landscaping: Submitted landscape plan appears to exceed the standard requirement of providing an area equal to 25 percent of the site in landscaping. A chart indicating percentage of landscaping needs to be provided. • Lighting: there are two styles of outdoor lights. The pole lights are 15 feet tall with 150 watt bulbs. These lights conform to the 25 foot maximum height of lights stipulated by the design standards. The other lights are 42 inch bollard lights. 2. The suitability of the improvement, including type and quality of materials of which it is to be constructed and the site upon which it is to be located. The building design matches the approved PUD. The materials include wood, stucco and stone finishes with a metal seam roof. 3. The compatibility of the design to minimize site impacts to adjacent properties. The building is a high quality design that will enhance the neighborhood. The trash dumpster is located adjacent to the Sunridge Condominiums. The dumpsters should be moved closer to the building to minimize impacts to the adjacent residences. A landscaped berm with continuous screen shrubs and trees should be provided to minimize impacts from the eastern parking lot, located on the property line and close to the Sunridge Condominiums. 4. The compatibility of the proposed improvements with site topography. The building is located on a river terrace and does not require a significant amount of grading. 5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring properties and public ways. The building is of a high quality design that will be attractive from neighboring properties and Highway 6 and 24. 6. The objective that no improvement be so similar or dissimilar to others in the vicinity that values, monetary or aesthetic will be impaired. The building should enhance property values based on the high quality design. 7. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. The design is not in conflict with the adopted goals, policies and programs of the Town. It preserves the river setback area and a bike path will be provided. A master sign program be presented to and approved by the Planning and Zoning Commission. The program will include relocating the freestanding sign to meet the 10 foot setback. 2. The trash dumpster be moved away from the eastern property line and the adjacent residences. 3. The parking analysis on the plan sheet be revised on the site plan to reflect the mixed use formula that was used to calculate the parking requirement. 4. The grading plan be revised to address concerns including disturbance in the 30 foot setback and slopes exceeding 2:1. Details and materials need to be provided for all retaining walls. Any wall over four feet tall requires a P.E. stamp. 5. The river setback/ non disturb line be clearly delineated and labeled on the site plan. 6. All flues, flashings and galvanized metal will be painted to match surrounding materials. 7. All meters will be placed upon the building. 8. All easements need to be clearly labeled on the site plan sheet. 9. Approval to reduce the stock pass under US Highway 6 and 24 to a 36 inch CMP is conditioned upon receipt of written approval from the Colorado Department of Transportation. 10. Approval to relocate and pipe the irrigation ditch shall be conditioned upon receipt of written approval from ditch owner which specifically includes permission to reduce proposed pipe size to 42".
