TY F3 MTST RezoningTown of Avon Rezoning Staff Report May 21, 1996 Planning & Zoning Commission meeting Report date May 17, 1996 Legal description Tract Y, Proposed Mountain Star Filing No. 3 Current zoning Open Space, Landscape, Drainage (OLD) Proposed zoning Industrial and Commercial (IC) Address Unassigned, Metcalf Road Introduction In 1994, the Town of Avon approved a Planned Unit Development (PUD) amendment rezoning to PUD land acquired by the Mountain Star L.L.C. from the United States Forest Service (USFS). The Tract Y parcel, originally part of the former USFS land, was intentionally excluded from that rezoning to accommodate a possible future site for a Town of Avon Public Works facility. That facility was subsequently located at the Swift Gulch location. As a result of this outcome, the owners of the Tract Y parcel now wish to rezone this parcel from its existing Open Space, Landscape ,Drainage (OLD) designation to a zoning designation of Industrial and Commercial (IC). The Tract Y parcel measures 7.188 acres and is located in the base of a minor drainage basin on the east side of Metcalf Road across from the existing Vail/Avon Commerche parcel ial Center. The parcel has over 600 feet of street frontage. The developable portion es ining areas consisting of steeply sloping hillsides. approximately one acre, with the rema Planning & Zoning Commission Recommendations The Municipal Code requires that the Commission hold a Public Hearing on this matter. Based upon the testimony and evidence presented at the hearing and upon an evaluation of the application in accordance with Section 17.28.080 of the Municipal Code, the Commission then recommends to the Town Council either to approve, approve with conditions, or deny either in whole or in part the requested amendment to the Zoning District Map Criteria for Review, Recommendation and Approval According to the Town of Avon Municipal Code, Section 1728.080, the following evaluations shall be made in reviewing applications to amend the zoning designation map: j: \p&z\052196\tracty. doc Town of Avon community Development (970) 949-4280 Fax modem (970) 949-4280 Tract Y. Is the proposed rezoning justified by changed or changing conditions in the character of the area proposed to be rezoned? Development during the past five years (both commercial and residential) has greatly increased the demand for support commercial and light industrial uses. Land available for these uses is limited, however. Tract Y is contiguous with the existing IC (Industrial Commercial) zone district, and includes a reasonable building site. 2. Is the proposed rezoning consistent with the town's Comprehensive Plan? The Tract Y parcel borders the Comprehensive Plan's Town Subarea # 5, known as the Metcalf Road Light Industrial District. The Comprehensive Plan designates this area as appropriate for its Industrial and Commercial zone district designation. Additionally, several goals and objectives of the Comprehensive Plan seem to support this proposed zone change. Goal A2 Locate land rises to make the most efficient itse of existing land and community resources. (a) Promote the development of ii fill parcels within the Town Core area. (b) Locate new development within or adjacent to existing developed areas. Though the Tract Y parcel is not specifically within the Town Core area, it is a viable site for infill development within the neighboring Metcalf Road Light Industrial District. Goal 9B2 Enhance the Town's role as a principal, year-round residential and commercial center in the Tail Lilley. (a) Provide for increased opportunities for development of service-oriented commercial and light industrial uses, with proper controls to ensure compatibility. Viable sites for development of service-oriented commercial and light industrial uses are limited in the Upper Eagle and Vail Valleys. Thus, the rezoning of the Tract Y parcel to IC appears to meet a need for not only the Town, but the region as well. Goal #G1 Ensure that the high quality, natural environment is preserved and integrated into the developed areas of'the ToWn. (a) Ensure that future development will minimize degradation of the environment, particularly in sensitive natural areas. (g) Work with the division of Wildlife to minimize impacts oil critical wildlife habitat, nesting and breeding areas, and migration routes. As part of the Environmental Assessment (EA) conducted by the Mountain Star L.L.C. for the above mentioned land exchange with the Forest Service, Tract Y was identified as a possible site for the Town of Avon to develop "a small public works maintenance area." This EA was reviewed by both the Division of Wildlife and the USFS. The above evaluations of the proposed amended zoning designation for the Tract Y parcel from OLD to IC appear consistent with the goals and objectives of the Comprehensive Plan. 3. Is the proposed use(s) compatible, with the surrounding area or uses? The proposed industrial and commercial uses for the Tract Y parcel are compatible with the light industrial uses existing in the surrounding Metcalf Road Light Industrial District. Are adequate facilities available to serve development for the type and scope suggested by the proposed zone? Adequate infrastructure facilities, i.e. utilities and access, exist to serve Tract Y's proposed uses. Staff Recommendation Based upon the above criteria for review, recommendation and approval, staff recommends the Commission forward to the Town Council a recommendation of approval for the amendment of the Zoning District Map to rezone Tract Y of the proposed Mountain Star Filing No. 3 from its current zoning designation of Open Space, Landscape, Drainage (OLD) to a zoning designation of Industrial and Commercial (IC), with the following condition: 1. The approval of the change in zoning designation be contingent upon recording of a final subdivision plat for Tract Y. Recommended Motion Approve Resolution 96-4 of the Planning & Zoning Commission recommending to the Town Council of the Town of Avon to approve the amendment of the Zoning District Map to rezone the Tract Y Parcel of the proposed Mountain Star Filing No. 3 from Open Space, Landscape, Drainage (OLD) to a Industrial and Commercial (IC), with the following condition: 1. The approval of the change in zoning designation be contingent upon recording of a final subdivision plat for Tract Y.
