The property owner and developer, Shapiro Development, recently informed the Town that a portion of each of these buildings may extend beyond the Building Envelopes established by the approved Nottingham Station PUD. Since a deviation from the approved PUD can create difficulties in financing, closing and other critical steps in the project development, the applicant requested an amendment to the PUD to clarify the boundaries and correct the encroachment, if any. Based on the initial information provided by the applicant, the amount of encroachment may be up to five feet. On May 14, 1996, the Town Council passed on first reading Ordinance 96-9, amending the Nottingham Station PUD. The Commission is now asked to review this ordinance, hold a public hearing, and then formulate and forward its recommendation to the Council. PUD Amendment Criteria Following are the criteria, as set forth in the Avon Municipal Code, for creating or amending a PUD. 1. Conformity with the Avon Comprehensive Plan goals and objectives. The proposed amendment to the building envelopes is generally not in conflict with any of the Goals and Objectives of the Comprehensive Plan. • Comprehensive Plan Goal A4 is to "Capitalize on the Eagle river as a focal point for fixture development." Objectives A and B under this goal are to emphasize the river corridor as a site for the development of recreational amenities and linkages. A pedestrian path will be located in Tract C, which is adjacent to the lot. Objective b under this goal is to promote the orientation of future development along the river corridor to the river as an asset and amenity. Extending the building envelopes does not appear to compromise these objectives. The extended building envelope does not interfere with a soft path being provided. 2. Conformity and compliance with the overall design theme of the town, the sub -area design recommendations and design guidelines adopted by the Town. The site is located within Subarea 10, the Riverfront District of the Comprehensive Plan. The plan identifies that the critical design issues are that any development should address visibility from U.S. 6/24, the preservation and enhancement of the riparian environment along the Eagle River, and public access along the river. All uses which are located within this district should be developed to create an attractive appearance from U.S. 6/24, with landscaped setbacks, and screened parking areas. The character of the river and its associated natural habitat should be preserved by sensitive site planning, architectural detailing, and appropriate setbacks, colors and scale of structures, as described further: • A minimum 30 foot building setback from the river • Provide a public access easement • Require development to provide reasonable access through their property to the river • Require screening or buffering of offensive uses • Buildings should be oriented to capitalize on the Eagle River as an amenity • Setback buildings from the river to preserve its natural character • Limit building heights to 3 to 4 stories. The intent is to establish a scale of development that is subordinate to the Town Center and compatible with the river environment. The proposed amendment conforms to these recommendations. All of the proposed building envelopes remain well outside of the 30 foot setback. A pedestrian path will be provided. A stairway will also be provided for public access to the river. Given the proposed placement of the buildings closer to the river, staff suggests that on grade patios and decks be minimized to provide a more natural appearance near the river. 3. Design compatibility with the immediate environment, neighborhood, and adjacent properties relative to architectural design, scale, bulk, building height, buffer zones, character, and orientation. The structures are still set back from the river and the wetland vegetation required to be preserved. The buildings are still oriented toward the river as recommended by the Comprehensive Plan. While the amendment proposes to site four buildings closer to the river than the approved envelopes, no building appears to be closer than approximately ten feet from the 30 foot stream setback. Building F, which is not being amended by this proposal, is already setback approximately five feet back from the property line and the stream setback. The proposed envelopes still exceed the minimum stream setback requirements and are no closer to the river than Building F is on the approved plan. Uses, activity, and density which provide a compatible, efficient, and workable relationship with surrounding uses and activity. Not applicable to this amendment. 5. Identification and mitigation or avoidance of natural and/or geologic hazards that affect the property upon which the PUD is proposed. The buildings will be located outside the 100 year flood plain and the 30 foot setback back from the mean annual high water mark. 6. Site plan, building design and location and open space provisions designed to produce a functional development responsive and sensitive to natural features, vegetation and overall aesthetic quality of the community. The site plan still preserves a river corridor, natural vegetation and walking path. The applicants propose amending the building envelopes for four of the nine buildings. Staff recommends that the amendment be limited to Buildings B, C, and D. Building A should not be located closer to the river. If need be, it can be shifted to the west to conform to the minimum building separation. 7. A circulation system designed for both vehicles and pedestrians addressing on and off site traffic circulation that is compatible with the Town transportation plan. Not applicable to this amendment. 8. Functional and aesthetic landscaping and open space in order to optimize and preserve natural features, recreation, views and function. The plan will continue to provide a river corridor and views, although the corridor will be reduced in width adjacent to the four proposed building envelopes. 9. Phasing plan or subdivision plan that will maintain a workable, functional, and efficient relationship throughout the development of the PUD. The phasing plan shall clearly demonstrate that each phase can be workable, functional and efficient without relying upon completion of future project phases. Not applicable. 10. Adequacy of public services such as sewer, water, schools, transportation systems, roads, parks, and police and fire protection. Not applicable. That the existing streets and roads are suitable and adequate to carry anticipated traffic within the proposed PUD and in the vicinity of the proposed PUD. Not applicable Staff Conclusion The proposed amendment does not compromise the 30 foot stream setback (the "no disturb limit") or the 100 year flood plain. The amendment corrects technical errors in and more completely describes Envelopes "A" through "I," and amends the limits and locations of Envelopes "A" through "D." Staff Recommendation Staff recommends approval with conditions. Recommended Motion: Approve Lot 4, Nottingham Station PUD, with the following conditions: 1. Building Envelopes "A" through "I" be described by metes and bounds on Exhibit "A" (attached). 2. Building Envelope "A" be amended to exclude the wetlands identified by the wetlands boundary. 3. The PUD amendment approval is subject to technical corrections by staff, including verification of the legal descriptions and building envelopes, building heights. 4. Substantial changes to grading and drainage, and placement of ground level decks be reviewed in accordance with Town design review regulations. 5. Canyon Run LLC shall be responsible for ensuring that this Planned Unit Development, as amended, complies with all state and federal wetlands and floodplain laws and regulations. 6. All requirements and restrictions contained in Nottingham Station, PUD Amendment No. 2, Lot 3, of Nottingham Station, Town of Avon, Eagle County, Colorado, other than the amendment to the building envelopes for Buildings B, C and D, and the further description of building envelopes for Buildings A through I shall remain unaffected by Nottingham Station, PUD Amendment NO. 3 and shall remain in full force and effect. 7. All conditions and requirements of Nottingham Station PUD Amendment No. 2, A Resubdivision of Lot 3, Nottingham Station, Town of Avon, Eagle County. Colorado, not specifically amended hereby shall be carried forward on the PUD' Plan for this Amendment.
