The plans were approved with 20" overhangs and the applicant has constructed the project with 12" overhangs for the entire project excluding gutters. The gutters will create the appearance of larger overhangs and when dimensioned will measure 18". Design Review Considerations The Commission's Procedures, Rules & Regulations, Section 4.10, require the following consideration in reviewing the design of this project: 1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning Code. The applicant contends that the reason for diminishing the overhangs was to avoid any problems with the required setbacks. 2. The conformance with other applicable rules and regulations of the Town of Avon. The applicant did not notify staff of the modifications. The overhangs on the project have already been installed at 12" and the Town of Avon regulations require 18" overhangs. If you include the gutters, the applicant is in compliance. 3. The type and quality of materials of which the structure is to be constructed. 4. The design of site grading and drainage to minimize impacts to adjacent sites, rights-of-way and easements. 5. The compatibility of proposed improvements with site topography, to minimize site disturbance, orient with slope, step building with slope, and minimize benching or other significant alteration of existing topography. 6. The appearance of proposed improvements as viewed from adjacent and neighboring properties and public ways, with respect to architectural style, massing, height, orientation to street, quality of materials, and colors. The reduced overhangs do not have any negative impact to the adjacent properties and still provide an aesthetic design. The objective that no improvement be so similar or dissimilar to others in the vicinity that monetary or aesthetic values will be impaired. 8. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. Staff Recommendation Staff recommends approval for the modifications to the approved plans. Recommended Motion "I move to approve the modifications to the approved plans for Lot 51, Block 1, Benchmark at Beaver Creek Subdivision as depicted on the application dated October 8, 1999."
