L1 L2 B1 BC PUDTown of Avon Final Design Staff Report October 17, 1995 Planning & Zoning Commission meeting Date 9 October, 1995 Project Type Commercial - Seasonal Christmas Tree Sales Legal Description Lots 1&2, Block 1, Wildwood Resort Subdivision Zoning PUD Introduction Oscar Tang, owner of Lots 1 and 2, Wildwood Resort, has requested an amendment to the Wildwood Resort PUD to allow seasonal Christmas tree sales in November and December. He also requests approval for the temporary storage of nursery stock that is currently located on the site through June, 1996. The applicant is Marty Jones, of Colorado Alpine Ins. The PUD for the site currently allows a hotel and or lodge together with accessory uses and related commercial uses as allowed in the NC (Neighborhood Commercial) Zone District. The owner would like to allow the temporary uses requested until the permanent development on the site is established. On October 10, 1995, City Council passed the ordinance to amend the PUD on first reading and has referred the request to Planning and Zoning Commission for your review. The application includes a sketch of the proposed Christmas tree lot that the applicants are requesting approval of. PUD Amendment Criteria 1. Conformity with the Avon comprehensive plan goals and objectives. Lot 1 is designated for commercial use, which the proposed Christmas tree sales are in conformance with. The Christmas tree lot is not in conflict with any of the goals, policies, or programs of the town of Avon. Lot 2 is designated for mixed use development. The temporary storage of trees would not be in conflict with the mixed use designation or the goals, policies, or programs of the town of Avon. 2. Conformity and compliance with the overall design theme of the town, the sub -area design recommendations and design guidelines adopted by the town. The seasonal Christmas tree sales and temporary storage of trees are not in conflict with the commercial and mixed use designation. The comprehensive plan does not address a specific design theme for this area. The customary outdoor sales for Christmas trees is not in conflict with the design guidelines. 3. The temporary storage of trees and the short term sale of Christmas trees will be compatible with the surrounding area which includes commercial development and some undeveloped property. More information does need to be provided regarding lighting plans for the sales lot to ensure there will not be any problems with light trespass. 4. Uses, activity, and density which provide a compatible, efficient, and workable relationship with surrounding uses and activity. The temporary tree storage and short seasonal sale of Christmas trees should be compatible with the surrounding uses. A large parking lot will be provided so that adequate parking is available on site and there will not be parking on the road or at adjacent businesses. 5. Identification and mitigation or avoidance of natural and/or geologic hazards that affect the property upon which the PUD is proposed. There are no known natural or geologic hazards on the site which will affect the use of the property for the seasonal uses proposed. 6. Site plan, building design and location and open space provisions designed to produce a functional development responsive and sensitive to natural features, vegetation and overall aesthetic quality of the community. The site plan provides for a functional Christmas tree sales lot. It has an adequate parking area, and is anticipated to have adequate lighting for safety. The temporary use of both lots is not anticipated to change any natural features. The site will need to be restored to natural vegetation after the trees are removed on Lot 2. 7. A circulation system designed for both vehicles and pedestrians addressing on and off site traffic circulation that is compatible with the town transportation plan. The tree lot takes appropriate access from Buck Creek Road, which is an unpaved road at the time. This is appropriate access rather than having direct access from Nottingham road, which functions as an arterial street. The parking lot would allow for adequate parking and maneuvering space on the lot. 8. Functional and aesthetic landscaping and open space in order to optimize and preserve natural features, recreation, views and function. Due to the very limited duration of the proposed uses, no landscaping is proposed. Lot 2 will need to be restored with native vegetation after the trees are removed from the site. 9. Phasing plan or subdivision plan that will maintain a workable, functional, and efficient relationship throughout the development of the PUD. The tree sales will occur seasonally on the site as a temporary use until the site is developed for permanent uses in conformance with the PUD. 10. Adequacy of public services such as sewer, water, schools, transportation systems, roads, parks, and police and fire protection. The site will be furnished with lighting and telephone. The applicants will need to make arrangements for sanitary services such as renting portable toilets for the employees and customers. 11. That the existing streets and roads are suitable and adequate to carry anticipated traffic within the proposed PUD and in the vicinity of the proposed PUD. The access from Buck Creek road will be adequate for the limited use of the site. Staff Recommendation Staff recommends approval of the PUD amendment with the following conditions: 1. That portable toilets be provided on the site. 2. Any outdoor lighting be downcast and shielded so as to not generate off site glare (light trespass). 3. The use of the tree lot shall not commence until November 15th of each year the sales lot is to be used. 4. The Christmas trees and all items such as fences, portable toilets, and any litter be removed from the site by January 2nd (one week) after the Christmas tree sales have been completed for the season. 5. Lot 2 shall be restored to its natural condition and the area be restored with seeding or other appropriate revegetation as determined by staff by August 1, 1996.
