Res. 99-14 L5 NTST PUDTOWN OF AVON PLANNING & ZONING COMMISSION RESOLUTION NO. 99-14 SERIES OF 1999 A RESOLUTION RECOMMENDING TO THE TOWN COUNCIL OF THE TOWN OF AVON APPROVAL OF A PUD DEVELOPMENT PLAN AND DEVELOPMENT STANDARDS, FOR LOT 5, NOTTINGHAM STATION PUD, TOWN OF AVON, EAGLE COUNTY, COLORADO. WHEREAS, Maurice and Nancy Nottingham have applied for a PUD Development Plan for Lot 5, Nottingham Station Subdivision, and WHEREAS, after notices required by law, a public hearing was held by the Planning & Zoning Commission of the Town of Avon, at which time the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed zone change and PUD Development Plan, attached hereto as Exhibit "A," and WHEREAS, pursuant to Section 17.20.110.H. of the Avon Municipal Code, the Planning & Zoning Commission has considered the following design criteria: 1. Conformity with the Avon comprehensive plan goals and objectives; 2. Conformity and compliance with the overall design theme of the Town, the sub -area design recommendations and design guidelines adopted by the Town; MTSERVERTILE SERVER\P&Z\Resolutions\ Res_99\99-14lot5nottinghamstation.doc 3. Design compatibility with the immediate environment, neighborhood, and adjacent properties relative to architectural design, scale, bulk, building height, buffer zones, character, and orientation; 4. Uses, activity, and density which provide a compatible, efficient, and workable relationship with surrounding uses and activity; 5. Identification and mitigation or avoidance of natural and/or geologic hazards that affect the property upon which the PUD is proposed; 6. Site plan, building design and location and open space provisions designed to produce a functional development responsive and sensitive to natural features, vegetation and overall aesthetic quality of the community; 7. A circulation system designed for both vehicles and pedestrians addressing on and off-site traffic circulation that is compatible with the Town transportation plan; 8. Functional and aesthetic landscaping and open space in order to optimize and preserve natural features, recreation, views and function; 9. Phasing plan or subdivision plan that will maintain a workable, functional and efficient relationship throughout the development of the PUD. The phasing plan shall clearly demonstrate that each phase can be workable, functional and efficient without relying upon completion of future project phases; 10. Adequacy of public services such as sewer, water, schools, transportation systems, roads, parks, and police and fire protection; 11. That the existing streets and roads are suitable and adequate to carry anticipated traffic within the proposed PUD and in the vicinity of the proposed PUD. NOW, THEREFORE, BE IT RESOLVED, THAT the Planning & Zoning Commission hereby recommends to the Town Council of the Town of Avon, Eagle County, Colorado to approve the PUD Development Plan and Development Standards for Lot 5, Nottingham Station Subdivision, as described on the attached Exhibit A, based upon the following findings: MTSERVERTILE SERVERT&z\Resolutions\Res_99\99-14lot5nottinghamstation.doc 1. That the PUD is consistent with goals and objectives of the Town's Comprehensive Plan, is compatible with surrounding neighborhood and is consistent with the public interest. 2. That the PUD development plan and development standards complies with each of the Town of Avon's PUD design criteria and that this proposed development is consistent with the public interest. Subject to the following conditions: 1. The existing shed that encroaches into the 25 foot front yard setback shall be removed from the property and all inoperable vehicles and materials stored outside, with the exception of firewood, ,shall be remoxed or stored inside within 60 days of approval of the PUD ordinance by Town Council". 2. That the project title be changed to Lot 5, Nottingham Station PUD.
