Re: Lot 8, Block 4, Wildridge Subdivision - Simon Residence; Special Review Use of a
Residential Bed and Breakfast
On August 20, 1996 the applicant was denied a Special Review Use permit to operate a
Residential Bed and Breakfast. The Commission stated in their resolution for denial, "That the
potential outdoor activities and increased traffic of the proposed use as presented in testimony
and correspondence from the public are not compatible with the adjacent residential uses." The
applicant appealed the Commission's decision to the Town Council which voted to uphold the
Commission's decision.
The applicant has re-applied for a Special Review Use permit to operate a Residential Bed and
Breakfast.
Staff Recommendation
Attached is the staff report for the August 20, 1996 Planning & Zoning Commission meeting. In
that report, staff recommended approval with conditions to grant a Special Review Use permit
(see attached report). The recommended conditions of that report are no longer relevant for the
following reasons:
1. This application does not include the provision for special occasions beyond the customary
lodging operations of a Residential Bed and Breakfast.
2. This application does not include the serving of alcohol as part of the operations of the
proposed Residential Bed and Breakfast.
Recommended Motion
Approve Resolution 96-12, granting a Special Review Use Permit to operate a Residential Bed
and Breakfast for Lot 8, Block 4, Wildridge Subdivision, based upon the finding that the
proposed use satisfies the three considerations for a Special Review Use as stipulated in Title 17
of the Avon Municipal Code.
