During recent TCO inspections, staff discovered a number of design modifications made without staff or Planning & Zoning Commission approval. At the July 17 meeting, the Commission approved site, landscape and architectural modifications. The applicant is now asking for approval of two new exterior light fixtures. The approved light fixtures were placed on the majority of the building; however, fixtures with clear glass were placed at the secondary front door and at the lower south patio. Design Review Considerations According to the Commission's Procedures, Rules & Regulations, Section 4. 10, the Commission shall consider the following items in reviewing the design of this project: 1. The conformance with setbacks, massing, access, land use and other provisions of the Zoning Code. 2. The conformance with other applicable rules and regulations of the Town of Avon. 3. The type and quality of materials of which the structure is to be constructed. 4. The design of site grading and drainage to minimize impacts to adjacent sites, rights-of-way and easements. 5. The compatibility of proposed improvements with site topography, to minimize site disturbance, orient with slope, step building with slope, and minimize benching or other significant alteration of existing topography. 6. The appearance of proposed improvements as viewed from adjacent and neighboring properties and public ways, with respect to architectural style, massing, height, orientation to street, quality of materials, and colors. 7. The objective that no improvement be so similar or dissimilar to others in the vicinity that monetary or aesthetic values will be impaired. 8. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. Section 4.23 Subsection C of the P&Z Procedures, Rules and Regulations states: 1. Area lighting shall generally be by metal halide, cut-off type fixtures with a maximum mounting height of 15 feet for walkways and 25 feet for parking areas. Floodlights are discouraged except as accent for architectural features. Light spillover to adjacent properties must be minimized. Staff Recommendation Staff recommends denial of the proposed exterior light fixtures. Recommended Motion "I move to deny the proposed exterior light fixtures for the secondary front door and the south patio for Lot 19, Block 3, Wildridge Subdivision as depicted on the application dated July 29, 1998, based on the finding that the fixtures will cause light trespass and therefore do not comply with section 4.23 C 3. of the P&Z's Procedures, Rules and Regulations.
