During recent TCO inspections, staff discovered many project modifications made without staff or Planning & Zoning Commission approval. The changes relate to site plan, landscape plan and architectural modifications. The approved site plan indicates that the house is located on a sloping north -south ridge, and that below, or south of the structure, the limits of disturbance were to be limited to approximately 10 —feet. The natural grade and vegetation were to be maintained. During the project's construction, however, a significant amount of excavation material was deposited in this area to create a berm and raised bench that extends to the property line. As a result, the transition from the house to the ridge landform is essentially a flat yard. The landscape plan modification reduces the number of evergreen trees by two and increases the number of aspen trees by seven. The numerous architectural changes are listed on the attached correspondence from the applicant. The applicant is now asking for approval of the site, landscape, and architectural modifications. Design Review Considerations According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission shall consider the following items in reviewing the design of this project: 1. Conformance with the Zoning Code and other applicable regulations of the Town. • Grading: All proposed slope grades conform with the maximum of 2:1 slope guideline. However, it should be noted that the plans submitted as part of this application appear to indicate the driveway has grades of up to 13%. The approved plans, however, indicate the driveway would not exceed 10%. Staff believes these trees should be maintained in the landscape plan to provide relief along this elevation and an overall complete landscaping solution. 2. The suitability of the improvement, including type and quality of materials of which it is to be constructed and the site upon which it is to be located. All proposed architectural modifications appear suitable. 3. The compatibility of the design to minimize site impacts to adjacent properties. The grading modification effectively eliminates the drainage easement along the southern property line. Drainage flowing from behind the residence coupled with the area south of the structure is now directly shed onto the neighboring property. 4. The compatibility of the proposed improvements with site topography. The placement of fill south of the structure unnecessarily manipulates the site's topography. Staff believes the apparent objective to create a benched, sod lawn area could have been achieved without elevating the topography along this prominent ridge crest. 5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring properties and public ways. Creating the elevated benched sod lawn area atop this prominent ridge results in a green signature that will be visible throughout the subdivision. The two evergreens east of the structure should be maintained to proved visual relief of the structure's east elevation. The architectural modifications maintain a compatible, attractive appearance. 6. The objective that no improvement be so similar or dissimilar to others in the vicinity that values, monetary or aesthetic will be impaired. While there are examples of past projects within the subdivision that created similar berms or benched areas, staff believes these projects are contrary to the Town's design guidelines and should not be repeated. 7. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. Staff believes that both the proposed landscape plan and architectural modifications are in general conformance with the Town's design guidelines and standards. Staff, however, does not believe that the proposed site plan modification conforms to the Town's guidelines of minimizing both grading and its effects upon adjacent properties. Staff Recommendation Staff believes the proposed architectural and landscape modifications are acceptable, and recommends their approval, with one condition for the landscape plan. Staff recommends denial, however, of the proposed site modification based upon its incompatibility with site topography and its visual impact upon the ridge crest as viewed from neighboring properties. Moreover, staff recommends that the Commission require that the fill material be removed from the site and native vegetation restored to bring the project back into conformance with the approved site plan. That the two evergreen trees located directly east of the residence be reinstated into the landscape plan. 2. That the site be restored to conform to the original approved site plan, based upon the finding that the proposed site modifications fail to comply with design review considerations 3, 4, S, 6, & 7. Excess fill shall be removed and the pattern and density of the natural vegetation be reestablished on those areas beyond the approved limits of disturbance.
