L1 MTST Seasonal SalesTown of Avon Minor PUD Amendment Staff Report Date Project Type Legal Description Zoning Introduction November 3, 1998 Planning & Zoning Commission meeting October 30, 1998 Seasonal Christmas Tree Sales Lot 1, Wildwood Resort Subdivision PUD Marl- Walker has submitted an application to sell Christmas trees on Lot 1, Wildwood Resorts, currently owned by Tanavon, Inc. Colorado Alpines, Inc. previously sold Christmas trees as well as operated a garden center on this site. The establishment of any uses on this lot requires a PUD amendment by ordinance because the previously approved PUD has expired. Staff recommends that if this use is approved, that it be approved until development of the lot occurs rather than requiring a PUD amendment each year PUD Amendment Criteria 1. Conformity with the Avon Comprehensive Plan Goals and Objectives. The interim sale of Christmas trees is not in conflict with this commercial use designation. 2. Conformity and compliance with the overall design theme of the Town, the sub -area design recommendations and design guidelines adopted by the town. The temporary use of the site for tree sales is not in conflict with the more permanent design recommendations. 3. Design compatibility with the immediate environment, neighborhood, and adjacent properties relative to architectural design, scale, bulk, building height, buffer zones, character, and orientation. Christmas tree sales are compatible with neighboring businesses and residential uses. 4. Uses, activity, and density which provide a compatible, efficient, and workable relationship with surrounding uses and activity. See # 3 above. 5. Identification and mitigation or avoidance of natural and/or geologic hazards that affect the property upon which the PUD is proposed. N/A 6. Site plan, building design and location and open space provisions designed to produce a functional development responsive and sensitive to natural features, vegetation and overall aesthetic quality of the community. A circulation system designed for both vehicles and pedestrians addressing on and off site traffic circulation that is compatible with the town transportation plan. Access and circulation are acceptable. Driveway and parking areas are defined with boulders. 8. Functional and aesthetic landscaping and open space in order to optimize and preserve natural features, recreation, views and function. N/A 9. Phasing plan or subdivision plan that will maintain a workable, functional, and efficient relationship throughout the development of the PUD. The phasing plan shall clearly demonstrate that each phase can be workable, functional and efficient without relying upon completion of future project phases. N/A 10. Adequacy of public services such as sewer, water, schools, transportation systems, roads, parks, and police and fire protection. Adequate services are available for the temporary use. 11. That the existing streets and roads are suitable and adequate to carry anticipated traffic within the proposed PUD and in the vicinity of the proposed PUD. This temporary use will have significantly less impact than the anticipated permanent uses. Staff Recommendation Staff recommends approval with conditions. Recommended Motion Adopt Planning Resolution 98-11, recommending approval of Christmas tree sales on the lot, subject to the following conditions: 1. Portable toilets to be provided on site. 2. Outdoor lighting shall be downcast and shielded to minimize off site glare. 3. Dust control measures shall be implemented by the operator as necessary. 4. Christmas trees and related items, plus litter shall be removed from the site by January 2. 5. A letter of credit covering clean up costs shall be posted.
