The applicant requests a modification to the final landscape design to allow the use of clumped
aspen trees instead of the 2 inch caliper individual size now standard for Town of Avon deciduous
trees. The approved landscape plan specified 38 aspen of 2 to 3 inch caliper. The landscape
supplier interprets caliper widths to mean a clump of aspen would each meet this minimum width.
The site has 28 trees meeting the planting widths and 18 trees below the 2 inch caliper width.
There are a number of additional aspens in the clumps. The applicant has installed three additional
8 foot spruce trees. The landscaper has offered to provide five two inch caliper trees in addition .
Design Review Considerations
According to the Commission's Procedures, Rules & Regulations, Section 6. 10, the Commission
shall consider the following items in reviewing the design of this project:
1. Conformance with the Zoning Code and other applicable regulations of the Town.
The policy of the Planning and Zoning Commission is to have a minimum of 2 inch caliper
deciduous trees. However, because this is a policy and not an adopted ordinance, the
Commission may approve the aspen clumps if they meet the intent of the design guidelines.
2. The suitability of the improvement, including type and quality of materials of which it is to be
constructed and the site upon which it is to be located.
The property is located adjacent to a natural aspen grove. The aspen clumps approximate the
trees found in a natural grove. The clumps provide for more trees than the number specified.
With the additional spruce trees and the additional aspen the landscaper is willing to provide,
staff believes the landscape materials are suitable.
3. The compatibility of the design to minimize site impacts to adjacent properties.
The trees are sufficient to enhance the property and screen the buildings from adjacent
property.
4. The compatibility of the proposed improvements with site topography.

5. The visual appearance of any proposed improvement as viewed from adjacent and neighboring
properties and public ways.

The landscape modification still provides an attractive landscape plan from the road.
6. The objective that no improvement be so similar or dissimilar to others in the vicinity that values,
monetary or aesthetic will be impaired.
Not applicable.
7. The general conformance of the proposed improvements with the adopted Goals, Policies and
Programs for the Town of Avon.
The aspen clumps can still be found to be in conformance with the Town's Goals, Policies,
and Programs. A significant number of trees and shrubs have been provided on the property
and the landscaping provides for an attractive townhome development.
Staff Recommendation
Staff recommends approval with the condition that the additional three aspen trees of two inch
caliper be installed on the property
