No. 2011-10 Revising the Fee Schedule for Zoning, Subdivision and Design and Development Review ApplicationsTOWN OF AVON, COLORADO RESOLUTION NO. 11-10 SERIES OF 2011 A RESOLUTION REVISING THE FEE SCHEDULE FOR ZONING, SUBDIVISION AND DESIGN AND DEVELOPMENT REVIEW APPLICATIONS. WHEREAS, the Town Council may enact and update fee schedules to accurately reflect the cost of labor and overhead involved with all application processes as stipulated in Chapter 7 of the Avon Municipal Code; and, WHEREAS, the Town has determined that a revised fee schedule is necessary to include a new review process established with the adoption of Ordinance 11-06; and, WHEREAS, the Town Council has determined that it is in the best interest of the Town to revise the fee schedule for zoning, subdivision and design and development review applications, setting the fees for such applications; and, WHEREAS, this Resolution does hereby amend the fee schedule adopted by Resolution 10-34. Summary The Community Development Fee Schedule will need to be updated with an additional fee for the newly adopted Temporary Use permit and application process. Section 7.02.100 of the Avon Development Code (ADC), requires "all development applications to ... pay the Town in full for all costs incurred for the review of a development application". Background The Community Development fees are intended to represent the approximate staff time required to process an application pursuant to the ADC. Based on the procedural requirements of the review, staff believes that a temporary use application would require approximately two (2) hours of staff time, which equals $100 dollars. The staff review time includes an initial meeting with the applicant, referrals to other departments if necessary (police, public works, etc), and a follow up site inspection after the temporary use has commenced. Staff has reviewed other resort jurisdictions in Colorado that regulate temporary uses and has found that the application and permit fees range from between $50 to $100. As with all development review applications, a temporary use application that require less than 2 hours of staff review will be reimbursed the unused portion of the $100 application fee. Applications that require more than 2 hours of staff review time will be billed for the additional staff time. An interested citizen (see attached e-mail) has requested that the Council consider a fee waiver for non-profit entities. ADC Sec. 7.04.100, Fees, currently allows the Council to reduce development fees and to waive the payment in full requirement incurred for a development application review. (c) Payment In -Full Required. All development applications shall be required to pay the Town in full for all costs incurred for the review of a development application. Payment in full to the Town of the costs incurred for development application review shall be a condition to each and every development application. The failure to pay the Town in full for the costs incurred for development application review within thirty-five (35) days of final approval shall render any such approval null and void. The Town Council may waive this requirement, reduce fees, or extend the time period for payment. This provision enables any applicant to petition the Council to reduce or waive any development review application fee. I did read through the temporary use proposed regulations though and I am unclear if a car wash would require a permit; technically it is the team or club hosting the event (not our shop) and it would be a different group every week, I was hoping that you might present the following at the meeting tonight on my behalf. I think it is an obscure case. If you think it can wait until the next meeting, I will be able to attend the June meeting. The point I would like to make is that we are offering our site (no charge) so kids can fund raise and a fee would eliminate this as an opportunity for them. Not for profit events should be exempt from fees. With regard to your FYI , administrative review and approval.... does that mean with the $100 fee or without? In an effort to give back to the community, Avon Auto & Truck would like to make their site available to the teams and clubs of Battle Mountain High School who would like to host a car wash as a fund raising event for their team or club. We would like to offer the following dates and allow the teams and clubs to sign up to secure our space for their car wash event. We will provide the water and supplies needed as well as coffee and doughnuts. Additionally, we may provide newspaper advertising. These will be not for profit events for Avon Auto and Truck. All donations will go directly to the BMHS team or club hosting the event. The dates we would like to make available are as follows: June 11,18,25 July 2,9,16,23,30 August 6,13,20,27 With consideration that the Town is currently amending it's special event requirements, I would like to propose that events such as these would be exempt from any associated permitting fees.
