I recently learned that the town is looking into allowing short term rentals on portions of Nottingham Rd. As a Nottingham Rd homeowner, I'd like to say that I am 100% in favor of allowing Nottingham Rd residents make their properties available for short term rentals. It is my understanding that most (all?) of the properties on the the south side of 1-70 are zoned to allow for short term rentals, and I think that it is unfair that Nottingham Rd is not. In a resort community such as ours, it significantly can effect our property values to not be included in this zoning. Although I do not currently have plans for using my own property as a short term rental, I'd be interested in learning about converting the zoning to allow for short term rentals for my own Nottingham Rd property as well. It allows the homeowners to reside at their properties with the extra advantage of using their homes when not home for short term rentals. I have not rented my property out, ever. But if the day does come where I would choose to do so, it would be nice for the opportunity. We do understand that for properties where short-term rentals are allowed they must obtain a sales tax license (no fee) through the Town of Avon and submit all applicable taxes to the Town of Avon. Properties found short term renting without submitting appropriate sales (4%) and accommodations (4%) taxes will be responsible to pay back taxes, penalties, interest and additional fines. Determining this is an administrative expense. We also understand that VRBO & Airbnb are popular in the Vail Valley because they allow visitors more options on short-term housing. However, a conflicting and competing issue is the need in the Vail Valley for more affordable six-month employee housing during the ski and summer seasons and for more affordable long-term rentals for year-round residents. Allowing transient short-term rentals of less than 30 days on Nottingham Rd will fiirther decrease the number of units available as more affordable seasonal and long-term rentals to employees and residents of the Valley. We understand that there are certainly pluses and minuses to short-term rentals: • Short-term rentals increase Avon tax revenues through Avon taxes on sales (currently 4%) and accommodation (currently 4%)), but these are additional costs to ownership; and • Short-term rentals increase rental income options for owners, but might be offset by added costs of furnishings, utilities, cleaning fees, advertising, and Avon taxes. We realize that if the Town of Avon allows short-term rentals on Nottingham Rd, then property owners may choose to rent long- or short-term. But short-term rentals leave long-term tenants not knowing who might be moving in next door for the night or the week. This could result in potential security and safety issues on the property. We realize that some Home Owners Associations (HOAs) on Nottingham Rd may prohibit short-term rentals. If allowed by the Town of Avon, the HOAs may need to amend Declarations of Covenants and Restrictions to prohibit short-term rentals. Chambertin Townhouses is an area where short-term rentals are not currently allowed. Should the Avon Town Council allow them on Nottingham Rd, we will work diligently with the Chambertin Townhouses owners and Board of Directors to prohibit short-term rentals in Chambertin units. We strongly urge the Town Council to not approve short-term rentals on Nottingham Rd. According to the Town Ordinance a process already exists for short-term rentals to be allowable in the excluded areas: property owners need to apply for a PUD amendment to include short-term rentals as an allowable use. While there I read the article in your local newspaper "Notttingham Road Rentals", residents are asking the Town Council to have the zoning law change on Nottingham Road to allowed homeowners to applied for a BB or short term rentals applaction. Our family loves to visit Avon and look forward to be able to stay as close to our family or dear friends as possible. We find It a challenge to find the right accommodations or not able to even fine a place to stay in Avon because of full hotels. I'm just the visitor, that enjoys to come to sunny Avon, and find this "short term rentals" a very welcome alternative way to enjoy our visit with family in your town of Avon. My name is David Rice and it has been brought to my attention that there is to be a meeting regarding short term rentals in Avon soon. I lived in the Vail Valley for many years. I owned a business in Edwards and have been involved with Moe's Original Bar-B-Que nearly since it's inception. When I lived in the Valley there was no such thing as short term rentals. Therefore, it could be somewhat difficult to find reasonable accommodations for family and friends. Short term rentals allow people of normal means the ability to afford a vacation in the Vail Valley. They also allow families or groups the ability to stay together. I have brought my family to the Vail area every year since I have left. It is nice to have an option to be able to make somewhere your 'home' for a stay rather than having to deal with getting in and out of hotels. We still spend plenty of money at restaurants, grocery stores, etc.. It is my hope that the council will look at this issue from the side of people like myself and the people that are operating short term rentals and do the logical thing and approve that the Nottingham home owners by allowed to use their homes as short term rentals. After living in the Vail Valley for several years, I have been back to vacation at least once a year with my family. The prices in Vail for hotels are crazy expensive and there is no way I could ever afford this for my family. Short term rentals make it possible for us to make a vacation in the Valley, without this option we would not be able to afford this yearly vacation. While we are visiting we are eating meals out, buying groceries and skiing on the mountain, etc. supporting the Vail Valley. Also, we find the short term rentals much more comfortable as a family, other than staying in hotels or lodges. Our short term rental experiences have been fantastic, if this rental option were not available then we would not be able to vacation in Vail. After reading the Vail Valley News, I was shocked by the headline story of eliminating short term rentals, this is a must in the Vail Valley. I sincerely hope it is the committees decision to approve for short term rentals in Avon, so families like mine can continue to enjoy the Vail Valley as we have for years. Sincerely, Suzanne R. Jones Avon Town Council, I am writing to offer my comments on the Nottingham Road short-term rental issue to be discussed at the September 12th, 2017 Town Meeting. While I am sympathetic to the need for long-term rentals in the valley, I do not believe that it is the responsibility of a few private residence owners on Nottingham Road to solve that issue for the towns and businesses. They should have the same right as town core property owners to rent to anyone they choose and pay the proper taxes to the town. The overlay only excludes this road which I understand was an original oversight. From my understanding, it was originally included with Wildridge. Wildridge was dropped because it was part of a PUD, but Nottingham Road should not have been. While we would not short-term rent and would prefer to have a long-term tenant, we would like to have the option to short term in the future. If the rentals were allowed, it would not affect properties whose HOAs do not allow them. Those few who do not have HOA restrictions should not be responsible for solving the need for long term housing for the community. That needs to be addressed by Vail Resorts, the towns and business owners and not fall on the shoulders of a few small property owners trying to offset the cost of living in this expensive community.
