No. 2011-03 (2)Exhibit C TOWN OF AVON, COLORADO PLANNING COMMISSION RESOLUTION 11-03 SERIES OF 2011 A RESOLUTION APPROVING A SPECIAL REVIEW USE FOR A TEMPORARY PARKING LOT ON LOT 61, BLOCK 2 OF THE BENCHMARK AT BEAVER CREEK SUBDIVISION WHEREAS, Beaver Creek Resorts, initiated a Special Review Use (SRU) Application for a Temporary Parking Lot on Lot 61, Block 2, Benchmark at Beaver Creek Subdivision in accordance with Section 7.16. 100 of the Avon Municipal Code; and WHEREAS, the Town of Avon Planning and Zoning Commission held a public hearing on February 22, 2011, after posting notice of such hearing in accordance with the requirements of the Avon Municipal Code, and considered all comments provided before taking action; and WHEREAS, it is the Planning and Zoning Commission's opinion that the health, safety and welfare of the citizens of the Town of Avon would be enhanced and promoted by the adoption of this SRU approval; and WHEREAS, the Planning and Zoning Commission finds that the a temporary parking lot for the purpose of accommodating overflow skier parking for the remainder of the 2010/2011 ski season meets the criteria for a Special Review Use as set forth in Section 7.16.100(e) of the Avon Development Code. NOW THEREFORE, BE IT RESOLVED, that the Town of Avon Planning and Zoning Commission hereby approves the Special Review Use application for a temporary parking lot on Lot 61, Block 2, of the Benchmark at Beaver Creek Subdivision for the purpose of accommodating overflow skier parking for certain weekends during the remainder of the 2010- 2011 ski season with the following conditions: 1. The Applicant may use Lot 61 to accommodate overflow skier parking on February 26`h and every Friday, Saturday and Sunday in March, 2011; 2. The temporary parking lot must be accessed from the existing driveway on Benchmark Drive: 3. The temporary parking lot shall be surfaced with gravel or another semi -permeable surface approved by the Town Engineer; 4. No lighting or structures shall be installed or erected on the lot as a result of this approval; 5. Temporary signage approved by the Town Staff shall be installed prohibiting overnight parking on the lot; 6. The Applicant shall be solely responsible for cleaning any portion of the public right-of- way where mud and debris has accumulated due to the use of the temporary parking lot; and Res11-03 Special Review Use for Temporary Parking Lot Page 1 of 2 2-1&11 This approval is temporary and shall expire on April 17th, 2011, unless approved by the Planning and Zoning Commission for an extension.
