No. 02-13TOWN OF AVON PLANNING & ZONING COMMISSION RESOLUTION NO. 02-13 A RESOLUTION RECOMMENDING APPROVAL OF A REVISED FEE SCHEDULE FOR ZONING AND DESIGN REVIEW APPLICATIONS, TOWN OF AVON, EAGLE COUNTY, COLORADO WHEREAS, the Planning & Zoning Commission recognizes the importance of fee schedules accurately reflecting the cost of labor and overhead involved with all application processes as stipulated in Titles 17, of the Avon Municipal Code and in the Town of Avon Residential, Commercial, and Industrial Design Review Guidelines; NOW, THEREFORE, BE IT RESOLVED, that the Planning & Zoning Commission of the Town of Avon, Colorado, hereby recommends to Town Council approval of the revised fee schedule as attached to this Resolution as `Exhibit A', specifically revising fees for all zoning and design review applications in the Town of Avon, Eagle County, Colorado. Review fees charged by a state or federal agency shall be made payable to the reviewing agency based on current rates and paid at the time of application. 2. For Final Plats, the applicant will be responsible for paying any plat check fees that are in excess of 25% of the Final Plat application fees. Review Costs Assessable Prior to passage of the annexation, eondominiumization or subdivision ordinance, or ratification of the preannexation agreement, or approval of a Planned Unit Development, by the Hoard of Trustees, the developer shall pay to the Town the actual cost to the Town for engineering, surveying, consultant planning services provided tinder the direction of the Town by any person not a regular full-time employee of the Town, and legal services rendered in connection with the review of the subdivision plans, planned unit development or development permit application plans, plats, and supporting documents, plus the cost of making corrections or additions to the official Town map, and the fee for recording the final plat with the County Clerk. The fees for review for Subdivision as found in 4,03.080,C. La. and 4.03.080.C, 1.b shall apply to all subdivisions except requests for Lot Line Adjustment which requests shall pay a review fee of 5150. D. Inspection Fee for Public Improvements Annlicahilily Prior to approval and acceptance of the construction and installation of public improvements in a subdivision, the subdivider or developer shall pay to the Town the actual cost of all inspections of such improvements, including but not limited to, streets, curbs, gutters, sidewalks, sanitary sewer system, storm drainage system, water distribution system, street signs, and street lighting facilities, made or conducted at the direction of the Town Administrator or Town Engineer. In addition, the subdivider or developer shall pay to the Town the actual cost of incorporating the as-builts into the official town mappine system. 2. Public improvements Inspection DLvosit Prior to the beginning of construction and installation of any public improvement in a subdivision or development, unless otherwise provided in the subdivision improvements agreement or development permit, subdiv ider or developer shall submit to the Town a deposit in the sum of Three Hundred Fifty Dollars (5350.00), plus an additional amount per acre, as calculated in accordance with the following schedule; a. First five acres, or any fraction thereof (0-5.0), 575.00 per acre; b. Next five acres, or any fraction thereof (5.0+-10.0), $50.00 per ncrc; C. Next ten acres, or any fraction thereof (10.0+-20.0), $25.00 per acre; d_ For each additional acre or any fraction thereof in excess of 20.0 acres, 510.00 per acre. No additional deposit in excess of Three Thousand five 1 iundred Dollars (33,500,00), shall be required. The required deposit shall be tendered to the Town Clerk. If the Town's public improvements inspection expenses have exceeded ilia Initial deposit, the subdivider or developer shall pay to the Town an additional deposit equal in amount to the initial deposit no letter than thirty (30) days after receiving notice from the Town of said requirement.
