I. Call to Order
The meeting was called to order at 5:05 pm.
II. Roll Call
All commissioners were present with the exception of Commissioner Struve.
III. Additions & Amendments to the Agenda
There were no additions or amendments to the agenda.
IV. Conflicts of Interest
Commissioner Losa was conflicted on Item VI due to his employer, Zehren Associates,
working on the Landscape Plan.
V. Consent Agenda
• Approval of the September 6, 2011 Meeting Minutes
Discussion: The Commission made corrections to the meeting minutes on the Consent
Agenda.
Action: Commissioner Clancy moved to approve the agenda as modified. Commissioner
Minervini seconded the motion and it passed 5-0.
VI. Minor Design and Development— ColorChange
Temporary Public Works Site Referral
Property Location: Lot 5, Filing 1, Village at Avon Subdivision; 375 Yoder Ave
Applicant. Town of Avon l Owner: Town of Avon
Description: The Town of Avon (the Town) submitted a design application to the Village (at
Avon) DRB (DRB) on May 2, 2011 for the development of Lot 5, Filing 1, Village (at Avon) as
a public works facility site. The DRB requested that the application be referred to the Town's
Planning and Zoning Commission for comment. The proposed improvements will allow the
Town to relocate non -transit operations from the Swift Gulch Public Works Facility (Swift
Gulch) to Lot 5, including offices, large equipment storage and material storage, prior to
Phase I construction of the Swift Gulch redevelopment project next spring.
Discussion: Commissioner Green overviewed the procedures for the Referral review that is
taking place. Commissioner Prince questioned if the Village at Avon DRB was aware of the
review that is taking place tonight. Jeff Schneider answered affirmatively.
Jeff Schneider presented the Referral to the Commission.
Commissioner Minervini questioned the location of the green railing.
Commissioner Anderson verified that the architectural interest of the modular building was
not to be addressed by this DRB.
Commissioner Prince, as PZC appointee to the Village at Avon DRB, overviewed the Village
at Avon DRB process that has occurred up to this point.

Commissioner Anderson commented that the landscaping appears sufficient and properly
screens the buildings. He commented that the use complies with the current zoning as it is
similar to construction offices. He stated he is in favor of the proposal but would not
comment on the architecture.
Commissioner Clancy commented that he has no reason why this doesn't comply with
zoning and comprehensive plans. He questioned the likelihood, in 5 years, that the Town of
Avon could create a better building. Staff responded that a bond is required to ensure that
removal of the temporary structures could occur in 5 years.
Commissioner Prince elaborated on the reasons why the Village at Avon DRB required the
bond.
Commissioner Minervini stated he agrees with Commissioner Anderson's comments. He
stated that the TOA DRB should encourage the Village at Avon DRB to approve the Lot 5
application.
Commissioner Prince stated that the Town has addressed the Village DRB's request for
bonding. He also stated that the proposal is in compliance with the zoning and allowed uses
on the site. He stated that the screening is adequate. He commented that the Village at
Avon DRB also requested a 3 year bonding for all landscaping. He stated that the
application is in substantial conformance with the Design Guidelines. He stated that the
Town has done a good job in meeting the Village at Avon DRB requirements.
Commissioner Green commented that he is in favor of striking recommended comments 3
and 4, and felt that 1, 2, 5, 6, and 7 are acceptable. He felt that adding an 6'" comment
would be beneficial. That comment should be:
"Upon review of the temporary nature of the building, its temporary nature has been
mitigated through the provision of temporary bonding and provision of adequate landscape
screening."
Commissioner Prince questioned the striking of comment 4. Commissioner dialogue ensued
regarding the comment.
Commissioner Prince did comment that the Lot 5 Application may have gone to vote at the
last Village at Avon DRB meeting, with the exception of Marcus Lindholm requesting that the
railings and pavement in front of Wal-Mart and Home Depot be addressed as a condition of
approval.
Action: Commissioners unanimously approved the staff recommended comments with the
following modifications:
• Strike comments 3 and 4.
Add comment 6 as follows, "Upon review of the temporary nature of the building, its
temporary nature has been mitigated through the provision of temporary bonding and
provision of adequate landscape screening."
First comment is "The TOA PZC encourages the Traer Creek DRB to approve the
Lot 5 application."
