07-07-2015 Decision for TMP15005Avon COLORADO RESOLUTION 15 -14 AVON PLANNING AND ZONING COMMISSION FINDINGS OF FACT AND RECORD OF DECISION CONCERNING THE TEMPORARY USE PERMIT FOR LOTS 1, 2 & 3 WILDRIDGE POINT SUBDIVISION, TOWN OF AVON, STATE OF COLORADO The following findings of fact and record of decision are made in accordance with the Avon Development Code ( "Development Code ") §7.16.100: 1. Application Submitted. A Temporary Use Permit Application #TMP15005 ( "the Application "), was submitted to the Community Development Department of the Town of Avon (the "Town ") on June 3, 2015 by Dave Dantas (the "Applicant "). 2. Complete Application. The application was reviewed by the Director and determined to be complete and compliant with the general criteria for all development applications in accordance with §7.16.020(f)(1)(i -iii). 3. Sufficient Notice. The public hearing considering the Application was published, posted and noticed in accordance with the development review procedures contained in Chapter 7.16 of the Avon Municipal Code. 4. Staff Report to Planning and Zoning Commission (PZC). Brian Garner, Town Planner, submitted a staff report for the PZC meeting held July 7, 2015. 5. Review by the PZC. The PZC reviewed the Application at the July 7, 2015 meeting and considered staffs analysis of conformance with the applicable review criteria of the Development Code and held a public hearing. 6. Compliance with Review Criteria. The PZC makes the following findings in regard to compliance with the applicable review criteria: PZC CONDITONS FOR CASE #TMP15005: 1. The Applicant shall be responsible for restoring the condition of the property to preexisting conditions upon completion of the temporary use. 2. The topographic map of Lot 33 and 34 Wildridge dated 10/22/12 shall be used to establish the elevations for restoring the condition of the property to preexisting conditions upon completion of the temporary use. 3. Lots 1, 2 & 3 Wildridge Point Subdivision shall only be available for storage of excavation materials coming from the construction site located at Lot 10, Block 3 addressed as 4010 and 4012 Wildridge Road West. The silt fence containing the excavated material shall be continually maintained by the Applicant utilizing best management practices for the duration of the temporary storage. PZC FINDINGS FOR CASE #TMP15005: 1. The site is isolated from adjacent uses to the extent that the proposed temporary excavation material storage will not negatively affect the use and enjoyment of adjacent property. 2. The temporary storage of excavated material does not place an undue burden on community services, utilities or sensitive environments. 3. The temporary storage of excavated materials will not pose a clear and present danger of injury to persons and property.
