08-04-2015 Decision for VAR15002Avon COLORADO RESOLUTION 15 -15 AVON PLANNING AND ZONING COMMISSION FINDINGS OF FACT AND RECORD OF DECISION CONCERNING THE VARIANCE FOR A TEMPORARY SIGN FOR LOT 1A, BUCK CREEK SUBDIVISION, FILING #2, TOWN OF AVON, STATE OF COLORADO The following findings of fact and record of decision are made in accordance with the Avon Development Code ( "Development Code ") §7.16.100: 1. Application Submitted. A Variance for a Temporary Sign Application #SGN15010 ( "the Application "), was submitted to the Community Development Department of the Town of Avon (the "Town") on July 17, 2015 by Stacey Hall representing NexCore Group, LLC (the "Applicant "). 2. Complete Application. The application was reviewed by the Director and determined to be complete and compliant with the general criteria for all development applications in accordance with §7.16.020(f)(1)(i -iii). 3. Sufficient Notice. The Planning and Zoning Commission's review and consideration of# the Application was published, posted and noticed in accordance with the development review procedures contained in Chapter 7.16 of the Avon Municipal Code. 4. Staff Report to Planning and Zoning Commission (PZC). Brian Garner, Town Planner, submitted a staff report for the PZC meeting held August 4, 2015. 5. Review by the PZC. The PZC reviewed the Application at the August 4, 2015 meeting and considered staff s analysis of conformance with the applicable review criteria of the Development Code and held a public hearing. 6. Compliance with Review Criteria. The PZC makes the following findings in regard to compliance with the applicable review criteria: FINDINGS OF FACT AND PZC ACTION LOT 1A, BUCK CREEK SUBDIVISION, FILING #2 Page 1 of 2 PZC FINDINGS FOR CASE #SGN15010: a. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties in the vicinity; b. That the variance is warranted for one (1) or more of the following reasons: 2. There are exceptional or extraordinary circumstances or conditions applicable to the site of the variance that do not apply generally to other properties in the vicinity. Specifically, the following exceptional or extraordinary characteristics are found: • The large -scale commercial development is the first of its kind in the neighborhood • The building is a high- profile 50,000 square foot medical facility • The site is zoned mixed -use commercial and is adjacent to a right -of -way on three (3) sides. PLANNING AND ZONING COMMISSION RECORD OF DECISION FOR CASE #SGN15010: The PZC APPROVED the Variance for a Temporary Sign Application with two (2) conditions: 1. That the temporary sign is restricted to no more than 50 square feet in size. 2. That the sign shall be removed the earlier of either twelve (12) months or at the time a temporary certificate of occupancy is issued for the building.
